A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA AHA ESTABLISHING
A UNIFORH SCHEDULE OF FEES AND
REPEALING RESOLUTION NUNBER 90-069

WHEREAS, the City of Santa Aha performs special services for the benefit of a
limited number of persons to whom such services are of value; and
WHEREAS, the cost of rendering such services should be borne by that limited group
who are the beneficiaries rather than the citizenry at large; and
WHEREAS, the City Council is of the opinion also that the charges established for
such services should equate to the direct cost thereof to the City of Santa Aha;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: That
the following fees for services and miscellaneous sales are hereby fixed and established,
to be effective from and after the first day of July, lggl:

For the purposes of this Resolution, each business in the City of Santa Ana which is
required to submit a business plan and/or inventory pursuant to the Health and Safety
Code, Chapter 6.95 of Division 20, shall be assigned a "range" consisting of a "range-
number" and a "range-letter" determined as follows:

Fee Schedule:
Each submission of a business plan (as defined in Health and Safety Code Section
2550]) and each certification provided pursuant to Health and Safety Code Section
25505 (c) and each submission of an annual inventory pursuant to Health and Safety
Code Section 25505 (d) (other than inventories which are submitted as part of a
business plan or certification) shall be accompanied by a fee based upon the "range"
of the subject business in accordance with the following schedule:

Unit Charge
Add up the quantities of all the various chemicals (or materials) in each of the three
categories (gallons, cubic feet, pounds). Use the highest quantity of chemicals (or
materials) listed to determine the Number Range (1,2,3,...).
Count the number of chemicals {or materials) listed to determine the proper Letter
Range (A,B,C,...).
3. Using the combined Range figures (Number and Letter, l-A, 2-C, etc.) determine the
proper fee from the schedule.

Late Ftlinq Penalty
The Fire Chief shall impose a late filing penalty based on additional administrative
costs incurred due to the late filing of any business plan, certification, or inventory.
The amount of such penalty shall be 25 percent of the fee for such filing. Non-payment
of the fee and penalty shall incur 10 percent interest on the amount of the billing
starting 30 days after the date issued.
ADMXNISTRATIVE PENALTY FEE SCHEDULE
This fee schedule utilizes a base penalty for each of the listed offenses and assesses
a surcharge to that penalty expressed as a percentage of the base penalty for those
factors as outlined in H & S Code Section 25514.5(f) which include, but are not limited
to, the following considerations, but shall not exceed $5,000 for each day the violation
occurs:
Extent of harm caused by the violation - surcharge to 500 percent.
The nature and persistence of the violation - surcharge to 500 percent.
The length of time over which the violation occurs - surcharge to ]00 percent.
The frequency of past violations - surcharge to 100 percent.
Action taken to mitigate the violation ~ surcharge to 100 percent.
Financial burden on the violator - will be considered.

* For group activities, those groups for which at least $1% of participants either live
or work in the City of Santa Aha, the resident rate shall be applied.
From time to time, privately taught leisure and instructional classes will be offered by
various agency divisions. The announcement of same will be made by printed fliers or in
the quarterly Program Booklet mailed to each residence in the City. Programs, so offered
will be conducted on a 4 to 10 week format. Charges for each class offered will be
established by the Executive Director, Recreation and Community Services Agency. The
City of Santa Aha will receive 30% of the total fees collected from each of these leisure
of instructional classes.

Copies of maps, documents, graphs, or special work may be furnished upon the payment of
the cost of printing and preparation. For such items for which a regular established
price is unavailable, the Department Head, in collaboration with the Director of Finance
and Management Services, may establish a price consistent with the cost of printing and
preparation thereof. The Director of Finance and Management Services shall report such
