McFarland, Reformed Presbyterian Church. This being the date set for hearing to vacate a twenty-foot alley 150 feet east of Main Street beginning 170 feet south of Central Avenue; on motion of Councilman Hubbard, seconded by Heinly and carried, the Affidavit of Publication was rmceived, filed, and the hearing closed; action was continued until the next meeting on the adoption of the Resolution ordering the vacation. This being the date set for hearing on the proposed constr~ction of the grade separation on East First Street at the A.T. & S.F. Railway tracks; Ken Drimlow, 516 Orangewood Avenue, Anaheim, prospective owner of property at Hathaway and First Streets, objected to the underground crossing as it would be detrimental to his particular type of business; Kenneth Gabriel, representing Diamond Ice Co., ll06 East First Street, and several other businesses in the area, protested the pro- posed grade separation as no definite need has been shown at this time, and since this matter has been brought to the public's attention the owners of business buildings have been unable to lease said buildings as they are unaSle to advise prospective tenents whether or not they will have access to First Street; Robert L. Stevens, 13321 Country Lane, Tustin, owner of property at the northeast corner of First and Hathaway Streets, stated the Garden Grove Freeway is soon to be construct~ which will eliminate considerable traffic on First Street, Fourth Street is started at Irvine Boulevard into Santa Aha which is not completed and also Edinger Street is not completed and before an underpass is constructed a survey should be made to determine the volume of traffic these thoroughfares would take of and how much traffic would be eliminated on First Street. The Mayor declared the hearing closed. On motion of Councilman Brewer, seconded by Hubbard and carried, the Affidavit of Publication was received and filed. The Director of Public Works orall~i reported as to the volume of traffic on East First Street, the approximate time of the completion of the Newport Freeway to divert traffic from First Street, and that action should be taken on the application for the grade separation at this time. It was moved by Councilman Brewer that no further action be taken in regard to the pre- posed construction of the grade separation on East First Street at the A.T. & S.F. Railway tracks. Motion lost for lack of a second. On motion of Councilman Heinly, seconded by Hubbard and carried, the oral report of the Director of Public Works Appeal Appl. No. 50 Edwin R. Wellington IV Variance Appl. No. 1568 Resol. No. 61-2~3 Granting Variance was accepted, and the Department of Public Works instructed to proceed with the application for the grade separation. . Appeal Application No. 50 of Edwin R. Wellington IV, was presented on Variance Application No.1568, to build a new retail market building in the R-1 District, at llgO South Sullivan Street, wherein the Applicant appeals the denial of the Zoning Admininstrator. Communication was presented from Curtiss O. Woodall, 242~ West McFadden Avenue, protesting granting of the Variance, and requesting a six-foot block fence along the east property line as one of the conditions, if granted. On motion of Councilman Heinly, seconded by Hubbard and carried, the communication was received and filed. 355 T.D. MacBird, Architect, 1601 East Washington Avenue, representing the Applicant, stated the existing building is a fire hazard; that the proposed building would be fire resistan~ and of modern construction; there would be adequate offstreet parking; that the six-foot block wall that Mr. Woodall requested is part of their proposal; and the proposed market would be an asset to the neighborhood. Mr. MacBird presented a petition, signed by approximately 31 adjacent property owners in favor of the proposed new market. On motion of Councilman Hubbard, seconded by Heinly and carried, the petition was received and filed. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Brewer, seconded by Heinly and carried, the following Resolution entitled: "Resolution No. 61-293 granting Variance No. 1568 on Appeal Application No. 50 filed by Edwin R. Hall None None Appeal Application No. 51 of the City Council was presented on Variance Application No. 1564, filed by William Wenke and Harry Tancredi, to allow a "reading institute" in the professional district, at 2006 North Broadway, wherein at the meeting of December ~, 196~ the City Council determined to appeal the denial of the Zoning Administrator. William Wenke, 2727 Olive Lane, stated this was not the "Commercial" type of school in that they issued no Certificates, Diplomas, or the like, but gave professional help to people who had difficulty with reading or reading comprehension. H.H. Reisman, 1608 Spurgeo~ Street, owner of property at 2020 North Broadway, objected to the congested parking problem that would be added to by daytime students, and questioned how many students would be attending! the daytime classeS. Mr. Reisman stated he had no objection after his question was satisfactorily answered by Mr. Hansen from the audience. It was moved by Councilman Heinly, seconded by Hubbard and carried, the Appeal Application be continued and in thel meantime the Planning Director and his staff be directed to present the problem to the !1~ Planning Commission to make a determination based upon the Ordinances of the City; that said determination be furnished this Council at the earliest practical date to be a part of this Appeal to be determined at that time, with instructions to the Manager that every thing is Status Quo until that hearing date. Appeal Application No. 52 of Alvin Stauffer and Max Norman, was presented on Conditional Use Permit No. 80, filed by Neal D. Minter, to establish a 58-unit trailer park in the C-1 District, on property located north of the northwest corner of Bristol Street and Memory Lane, wherein the Appellant appeals the approval of the Planning Commission. Max Norman, 2526 North Baker Street, stated the basis for the Appeal is that a trailer court would not be compatible with the district and also the understanding that there is going to be an application for a second trailer park. Alvin Stauffer, 1232 Park Lane, stated the homes in this area are valued between $25,000.00 and $75,000.00, that a trailer park would change the character of the present highly desirable neighborhood, would tend to lower present property values, and the Planning Department recommended denial. Louis Clemmons, 1026 River Lane, stated it is becoming more difficult to find desirable residential districts in the City, that this area should remain a high class residential area and requested the Council to uphold the Appeal and deny the permit. Neal Minter, 14052 Memory Lane, stated he has lived on this property for 53 years, and further stated 356 Request Veterans Industries, Inc. West, President, Veterans Industries, Inc., was granted, for the waiving of off-street parking requirements at 311 East Fourth Street, as prescribed by Section 9230.225 of the Zoning Ordinance. Communication was presented from the Planning Department recommending denial of Preliminary Record of Survey Map No. 230, filed by Henry C. Cox, creating four lots located north and east of the intersection of Flora and Salts Streets. On motion of Councilman Heinly, seconded by Hubbard and carried, Preliminary Record of Survey Map No. 230, filed by Henry Preliminary Record of Survey Map No. 231 Henry C. Cox C. Cox was denied. Communication was presented from the Planning Department recommending approval of Prelimina~.4Y Record of Survey Map No. 231, filed by Henry C. Cox, creating four lots located north and east of the intersection of Flora and Salts Streets, subject to conditions. On motion of Councilman Heinly, seconded by Hubbard and carried, Preliminary Record of Survey Map No. Preliminary Record of Survey Map No. 227 John Magarro 231, filed by Henry C. Cox was approved, subject to conditions. This being the continued action on Preliminary Record of Survey Map No. 227, filed by John Magarro, creating four parcels on property on the south side of Sugar Avenue approximately 850 feet west of Harbor Boulevard, communication was presented from the Planning Department recommending approval of Preliminary Record of Survey Map No. 227, subject to conditions. James E. Walker, Attorney, 310 Spurgeon Building, representing the Applicant, stated it was almost impossible to comply with the alley requirements on Parcels Nos. 1, 2 and 3, as it would serve no purpose to the present owners, or any owners in the foreseeable future and called attention to the proposed Ordinance which would permit Council to grant exceptions to the alley requirements, Hugh Halderman, 136 West Washington Avenue, Engineer for Mr. Magarro and the Subdivider, stated the present records show parcels Nos. 2 and 3 as two i Preliminary Record of i Survey Map No. 233 l!Boyle Engineering & ! On motion of Councilman Heinly, seconded by Hubbard and carried, Preliminary Record of Survey Map No. 227, filed by John Magarro, was approved, subject to conditions, the first condition being that Lots 2 and 3 as shown on the Record of Survey Map be considered to be one lot and that the final Record of Survey Map have that line deleted, that Conditions A, B, C, D, E, F, G, H, I, J, K, M and N as recommended by the Planning Department be complied with, and consistent with the proposed Ordinance that no alleys are required. Communication was presented from the Planning Department recommending approval of Preliminar~ Record of Survey Map No. 233, filed by Boyle Engineering and Martin E. Lindsay, et ux, creating two parcels located at the southwest corner of Chestnut and Lyon Streets, subject to conditions. 357 !ITentative Tract iMap No. 4503 J.B. Greenberg Jack Rimel, Attorney, 310 North Main Street, presented a letter and two plats regarding their objections to certain conditions. On motion of Councilman Hubbard, seconded by Heinly and carried, the communication and two plats were received and filed. Attorney Rimel stated they had no objections to any of the Conditions except E, F, G and H. It was moved by Councilman Heinly and seconded by Hubbard, that Preliminary Record of Survey Map No. 233, filed by Boyle Engineering and Martin E. Lindsay, et ux, be approved, subject to the conditions as recommended by the Planning Department with the exception of Conditions G and H, whereby the City will waive the requirement for improvements in exchange for the dedication of .19 acres of land.
