RESOLUTION NO. 92- 011
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA FINDING THAT THE
PROPOSED AMENDMENT TO THE SOUTH HARBOR
REDEVELOPMENT PLAN WILL NOT NECESSITATE
FORMATION OF A PROJECT AREA COMMITTEE
WHEREAS, the Santa Ana Redevelopment Commission (the
"Commission") has undertaken proceedings to amend the South Harbor
Redevelopment Plan; however, the amendment will not enlarge the
project area; and
WHEREAS, Section 33385 of the California Health and
Safety Code does not require formation of a Project Area Committee
to amend a Redevelopment Plan, but Section 33385.5 does require
review of the amendment by the Project Area Committee if one
exists, or expansion of an existing Project Area Committee if the
amendment will enlarge the project area; and
WHEREAS, a Project Area Committee for the South Harbor
Redevelopment Project Area does not currently exist; and
WHEREAS, the proposed amendment to the South Harbor
Redevelopment Plan does not include extension of the Agency's power
of eminent domain.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SANTA ANA that the City Council hereby determines that the
proposed amendment to the South Harbor Redeveloment Plan will not
enlarge the project area boundaries nor extend the Agency's power
of eminent domain and, therefore, does not necessitate formation of
a Project Area Committee.
