Each member of the City Council having received copies of the Minutes of February 5, 1962, reading of the Minutes was dispensed with and approved as mailed, on motion of Councilman Heinly, seconded by Hubbard and carried. No. 355 Jesse Ojeda Ordinance This being the date set for the continued hearing on the adoption of an Ordinance establishing drainage fees; Harry Martin, 500 Dyer Road, requested clarification o~ the various proposed drainage fees, and stated if all the undeveloped areas were subdivided and drainage fees were charged on the 50% basis, it would amount to abot~t $2,000,000.00 of the $12,000,000.00 Drainage Master Plan. Royse, 1413 No. Eastside Avenue, the Clerk submitted a petition previously submitted on November 20, 1961, signed by approxfm~tely 292 persons, in opposition to Amendment Application No. 355, filed by Jesse OJeda. On motion of Councilm, n Hubbard, second- ed by Heillly and carried, the petition was received and filed. Frederick J. Ackerman, 1518 No. Eastside Avenue, complimented the Planning Department on the fine job of preparing Special Study 18, and stated the residents consider this sec- tion to be a fine residential area and desire it to remain as such. Mr. Ackerman further stated an 80 foot street is a better buffer between residential and commer- cial property than a block wall; the approxfmately 100 people attending the Counci1 and Planning Co,,,tssion meetings disagree with the recommendations of the C~issi~ and agree with the Planning Department, and requested that Special Study 18, pre- pared by the Planning Department be read. Special Study 18 was read by the Clerk. Hearing closed. On motion of Councilman Hubbard, seconded by Schlueter and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change District classification on Amendment Application No. 355 and amending Sectional District Map 8-5-9 (Exhibit A.A. 355B Corrected)" reclassifying from the R-1 to the C-5 District, as rec~amended by Exhibit A.A. B55B Corrected, for the depth of 265 feet from the center line of 17th Street, was introduced~ considered and placed on file for second reading. Continued hearing mAmend. Appl. No. 366 IlA. L. Marshall Ordinance This being the date set for the continued hearing on Amendment Application No. 366, i filed by A. L. Marshall, amending Sectional District Map 2-5-9, to reclassify fro~ A-1 District to the R-1 or R-3 District, property on the north end of Deodar Street~ north of 17th Street, all as shown on Exhibits A.A. 366A and A.A. 3663, com~Aanica- tion was presented frum the Planning Department, dated January 16, 1962, stating the Planning Department has prepared a study concerning the use of the property and possible street arrangements in the area bounded by Santa Clara Avenue, Tustin Free~ way, 17th Street and Tustin Avenue. Attorney Milford W. Dahl, 401 West Eighth Street, representing the applicant, stated the hearing had been postponed to obtain further studies from the Planning Department, which have now been made, and pointedl out diagrams prepared by the Planning Department showing the existing condition. Mr. Dahl further stated the street limitation deprives this property of access; pointed out a large garden type apartment to the west, and stated although the Appl%- cation was for R-3, it was filed before the R-4 was available and it is the R-g in which they are interested. Mr. Dahl stated he would like to retract his statement m~de at the December 18th meeting that they would stand or fall on the R-3 Zoning and now submit the R-1 if not the R-~ District. Approximately 30 people stood in opposition to Amendment Application No. 366. Arthur Cooper, 13751 Deodar Street, stated he opposed any zoning that would bring apartments into this area, a petition. had been presented at the December 18th meeting that set forth the basic arguments against multiple zening, the R-1 Zoning would bring a fair profit for the owners, and further requested the City Council to accept the Resolution of the Planning Com~ission as it reflects the interests of the residents in the co~mmnity. Mr. Dahl stated this property has been owned by these people for g3 years and he does not believe they purchased the property as a speculation, and the property is hem- med on the east by the Freeway and on the west by an R-g development. Eugene B. Erbentraut, 13911 Deodar Street, stated the amount of traffic which will cross Deodar Street should be taken into consideration as there will be off-ramps at Chap- man Avenue, First Street and 17th Street, but 100 percent of the traffic into Sant~ Ana will flow across Deodar Street at 17th Street. Councilman Heinly stated he wanted to review the zoning of the property on the west where the R-3 apartments are located and advised seven notices were posted surrounding the property, not less. than 300 feet from the property, and a notice of public, hearing was published in the newspaper; at the hearing there were no protests on the rezoning of that property. Mrs. Esther Cooper, 13751 Deodar Street, and pamala Day, 13852 Deodar Street, stated no one had seen the notices regarding the rezoning of the property to the west of the subject property as they were posted in an orchard. It was moved by Councilman Brewer that the property on the north end of Deodar Street, nort~ of 17th Street, be reclassified frem the A-1 District to the R-1 District, as shown on Exhibit A.A. 3663, Amendment Application No. 366, filed by A. L. Marshall. Motion lost for lack of a second. Warren Smith, 13912 Deodar Street, stated there is a matter of ingress and egress, if this property becemes income property it wil~ increase the traffic through a residential section, and though we are not opposed to income property, we are opposed to heavy traffic on a residential street. Barnes, lO16 North Broadway, representing the applicant, requested that action be taken later on Amendment Application No. 375, filed by D. P. Leonard, and that ac- tion be taken at this time on Preliminary Record of Survey 249, filed by Doxander P. Leo~ard, creating and combining two lots located about llOO feet east of Bristol Street and on the north side of Memory Lane. On motion of Councilman Heinly, secon~- ?reliminary Record of Survey 249 Doxander P. Leonard ed by Hubbard and carried, the request was granted. Ccmmmmication was presented from the Planning Department recommending denial of Pre~ liminary Record of Survey 249~ filed by Doxander P. Leonard, creating and combiningll two lots located about 11OO feet east of Bristol Street and on the north side of Memory Lane. Attorney Robert S. Barnes, lO16 North Broadway, representing the ~Ppli- cant, stated it is impossible to develop the property into R-4 Garden Apartments with a 30-foot dedication on the east side of the property as it would create a los~ of five two-bedroem units, and the development of the units as planned are in ex- cess of the requirements of the City; this is a legit'~m~te R-4 use of the prol:erty and in view of the existing type of restriction it would be impossible to constructl with a 30-foot dedication. Mr. Barnes further stated this is proper planning for this area as it is adjacent to an R-3 use and a Church, and the Garden apartments will have a total of 49 units. Also, rather than a 60-foot street the sidewalks could be narrowed or eliminated on the Church side. Tom Ridgeway, the developer, 465 North June Street, Los Angeles, stated this property would not be using the Hearing Amend. Appl. No. 377 Andrew J. Davis, Jr. Ordinance street. At the request of the applicant and on motion of Councilman Heinly, se- conded by Brewer and carried, action was continued until the next meeting on Pre- liminary Record of Survey 249, filed by Doxander P. Piper, and Mr. and Mrs. Eugene Smith, owners of the property involved, stated his clients have owned their property from 12 to 20 years, and there was a request on the part of people who have R-1 property to have the property of his clients rezoned, and that his clients did not wish their property rezoned to R-4. Mr. Steiner presented pictures, and stated with the unsightly R-3 apartments across the street, no one would develop the subject prop- erty into garden apartments, and it would be almost impossible to develop the prop-i erty R-1 or R-2 because the lots are 260 feet deep. Keith Johnson, lllO North Linwood Avenue, stated they preferred to keep two or three story apartments out of this area. Mr. Southard, 1325 Grace Street, stated his property has been excluded since the original petition was signed. Communication was presented from the Director of Public Works advising the signa- tures on the petition for Assessment District No. 213, to provide sanitary sewer mains and laterals to serve the area in Tracts 1550, 1R89, 1288, and 1287 have been checked against the assessor's last equalized roll and the valid signers represent 68.2~ of the area.
