On recommendation of the Manager, and on motion of Councilman Brewer, seconded by
Heinly and carried, the lowest aud best bid of The Iowa Company, Inc., was accepted
in the total amount of $~,286.00, and all other bids rejected.
This being the date set for the continued hearing on Amendment Application No. 382
filed by Ralph J. Cover, amending Sectional District Map 16-5-10, to reclassify
fron the R-2 and A-1 Districts to the R-3 and C-1 Districts, property at the north-
east corner of Sugar (McFadden) Avenue and Newhope Street (a parcel approximately
437 feet on Sugar Avenue by 371 feet on Newhope Street), all as shown on Exhibit
A.A. B82A; Planning C~l~.,~ssion rec ...... ended denial. Delbert W. Michael, 917 South
Toland Street, stated the residents in the area favor Planning Department Study
19, and are opposed to the proposed rezoning, as it would be hazardous to have com-
mercial bus--sos opposite the school; it would lower the value of the surrounding
property; and requested Council to continue the good work it has done in the past
by helping to build t~e area in question properly. Douglas Clark, 1510 North Mar-
Less Drive, stated there should be consistency on the thinking of the Council and
the Planning C¢-.i...tssion regarding zone changes, and in keeping with Study 19, which
was presented to and approved by the Council, this area should re~ain R-1 as nearly
as possible, and this area, though not very well developed at the present time, has
a possibility of being a fine residential sectidn of the City. Mrs. Mary P. WaverS,
718 South Gates Street, stated she and her husband have lived in Santa Ana for sev~
years, and are opposed to commercial businesses near their residence. Hearing
closed. It was moved by Councilman Heinly, and seconded by Brewer, that Amendment
Application No. 382, filed by Ralph J. Cover, be denied.

Appeal Application No. 61 of Hubert Melton was presented on Variance Application Nc
1636, filed by A. C. Markel and John Jezowski, to re-establish a cement contractor'
office and equipment-materials yard in the C-1 District, at 2517 West Edinger Ave-
hue, wherein the appellant appeals the denial of the Zoning ~dmtnistrator. Jack
Hall, Civil Engineer, 219 East 17th Street, stated the applicant and the appellant
are trying to effect a beneficial exchange by moving the contractor's office and
equipment-materials yard approximately 170 feet east of its present location. Mr.
Hall further stated the property is now operating under a County Variance, and the
City Variance, if granted, would be more restrictive. Charles Swenson, 2221 South
Towner Street, an employee of Nessrs. Markel and Jezowski, stated more room is re-
quired gs the business has been very successful and is expanding. Mr. Arnold,
1426 Sullivan Street, questioned who would pay the cost of the alley, and whether
a wall would be built around the alley. The Council having unanimously waived the
readiD~ of the Resolution, on motion of Councilmmu Heinly, seconded by Schlueter

of the Zoning Administrator. C~am~nication was presented from Union Sign Co. re-
questing the withdrawal of Appeal Application No. 62, and the reikmd of the $15.00
appeal fee, if possible. On motion of Councilman Heinly, seconded by Brewer and
carried, the ccmmaunication was received and filed, the request of Union Sign Co.

Cr..---Anication was presented from Mrs. Clara E. Vose, 1320 Memory Lane, requesting
another three year extension on Variance Application No. 3~9, granted in 1953 for
three years, for a real estate office at 1320 Memory Lane; and stating no changes
have been made on the property and none are anticipated. On motion of Councilman
Brewer, seconded by Schlueter and carried, the request was approved, and a three-
year extension granted on Variance Application No. 3h9, filed by Mrs. CLara E. Vose

questing an audience with the Council regarding dedication of property and alley
improvements, reference Variance Application No. 1~9, granted March 6, 1961, to

construct a ~ %unit apartment building at 501 Cypress Avenue; and Variance Applica-
tion No. 1609, filed February 16, ~62, to construct a six-unit apartment building
on the southwest corner of North Van Ness Street and Washington Avenue. Gor~o~ M.
Hicks, 1123 East llth Street, stated the Planning Department has required the dedi-
cation of a strip 15 feet by 132½ feet for the widening of Washington Avenue, and
the improvement of the alley, as conditions of approval on Variance Application No.
1609, which the applicant is willing to do; but the Planning Department will not
grant the Variance until the alley at 501 Cypress Avenue has been improved, which
alley improvement was one of the conditions of approval on Variance Application No.
14~9, and as the alley improvement was approved by an employee of the Department of
Public Works, a notice of completion was filed, and the building has since been
sold. Mr. Hicks further stated it was not reasonable to deny one Variance Applica-
tion on the basis that a condition of improvement had not been met on another Vari-
ance Application. On motion of Councilmau Heinly, seconded by Brewer and carried,
the communication was ~eceived and filed, and the matter referred to the Planning
Department f~r appropriate action.
C ....... ~nication was presented from the Planning Department recommending approval of
Revised Preliminary Record of Survey 249, filed by Dcxander P. Leonard, creating
and combining lots located on the north side of Memory Lane approximately 1,000
feet east of Bristol Street, subject to conditions. Tom Ridgw~y, $201 Wilshire
Boulevard, Los Angeles, stated, with regard to Variance 1627, that the Planning
Department and Department of Public Works have reviewed the three schemes presente~
for the revision of Pre~tmtuary Record of Survey 2~9, and recon~ended disapproval
of Scheme 3, since the extension to the north of this street would require

relocation or removal of a house, both Scheme land 2 are acceptable to these De-
partments, and requested approval of Scheme 1, with the option of a slight yaria-
tion to conformwith the new street pattern. On motion of Councilman Heinly, sec-
onded by Brewer and carried, Revised Preliminary Record of Survey 249, filed by
Dcxander P. Lec~ard, was approved in accordance with Scheme 1, subject to condi-
tions as imposed, and the further conditions, that the shaded area as shown on the
map, with the exception of the easterly one foot for the entire length of the prop-
erty, be dedicated for street purposes; the applicant grant to the City, in fee
title, the easterly one foot of said property; and the plot plan previously sub-
mitted be substantially c~,~lied with.
Com~nunication was presented from O. A. Peters, District Superintendent, Garden
Grove Elementai'y SChool District, stating the Board of Trustees passed the follow-
ing Resolution at their meeting held May 14, 1962: "Motion: That the Garden Grove
School District request an adult crossing guard at the Rosita School pending a
thorough study of all phases of the crossing guard problem including the Safety Boy
Patrol," and requesting an audience with the Council for Mr. John C. Hedlund, Presi
dent of the Board of Trustees of the District, for the purpose of discussing with
the Council the matter of a crossing guard at the Rosita School. John C. Redlund,

tary School District, stated alth~,gb it has been the policy in the past not to use
the school boy.patrol, the School Board is willing to investigate and obtain all
available inf~ormation regarding their use, and requested temporary relief, by the
.placement of an adult crossing guard, at the Rosita School, as there are not en~!~
fifth and sixth graders at the present time to form a school boy patrol at this$i
location. It was moved by COuncilm~u Heinly, seconded by Schlueter and carried,
that the c~ication be received and filed, and the staff authorized to employ a
guard at the Rosita School for the balance of the school year, and a c~munication
be sent to the Board of Trustees, Garden Grove Elementary School District indicat-
ing that this is only a temporary relief for the balance of this semester, and
there will not be a,.erossing guard at this location in September.
Communication was presented from JJoseph Horn, Chairman, Firework~ Sales, Boy Scou~
Troop~7, requesting permit to operate a retail "safe and sane" fireworks stand at~
the southwest corner.:of McFadden Avenue and Center Street, on the school grounds o~
the rmmaculate Heart of Mary Church. On motion of Councilm-n Brewer, seconded by
Schlueterand carried, approval was granted for the issuance of the permit to
operate a 'safe and sane" fireworks stand, subject only to the approval by the Fire
Department and in accordance with the us,m1 procedure.
On motion of Councilman Hei~'ly~ seconded by Schlueter and carried, proper official
were authorized to execute agreement with Luminart Neon Company, Inc., Lyndy's
Coffee Shops and James A. Freeman, to relocate an electric sign at 1241 West 17th
Street, which extends over and upon the established setback line.

On motion of COU~CilmaU Heinly, seconded by Schlueter and carried, the Minute Or-
der adopted May 7, 1962, was rescinded, reference letter from the City Attorney
requesting authorization for the Director of Public Works to enter into an agree-
merit with Land Acquisition Service to fix the value of the property necessary to
be taken as a preliminary step for the widening of Edinger Avenue from Broadway to
Flower Street, State Gas Tax Project No. 136, and Edlnger Avenue from Flower Stree
to Bristol Street, State Gas Tax Project No. 137.
On motion of Cou~cilm~ Heinly, seconded by Schlueter and carried, the request of
the Department of Public Works was granted~ and the plans and specifications
approved, for Project 131, construction of Talbert Avenue (new) between a point
approximately 600 feet east of Harbor Boulevard and Greenville Street; and Project
132, construction of Fairview Street between Talbert Avenue (new) and Talbert Ave-
nue (old).
On motion of Counc~lm-n ~einly, seconded by Schlueter and carried, the written
rec~m~endation of the Manager, dated May lC, 1962, was approved for salary step
increases for nine employees, effective June l, 1962.
On motion of Councilman Heinly, seconded by Schlueter and carried, the request of
the Manager was approved for transfer of funds from Fund 23-265 Recreation and
Parks Department-Civi~ Center Maintenance to Fund 2~-26~ Recreation and Parks-
Price Property~ in the amount of $350.00.
On motion of Councilman Heinly, seconded by Schlueter and carried, the request of
the Manager was approved for transfer of funds from unallocated reserve monies in
Fund 51 General Capital Outls~ Fund to Fund 51-171 Finance Department-Accounting
Division, in the amount of $1,5OO.OO.
On motion of Counc~lm~u Heinly, seconded by Schlueter and carried, the request of
the Purchasing Agent was approved, to sell by negotiation, whenever and wherever
possible, obsolete spare street sweeper parts, per list submitted.
On motion o~ Councilman Heinly, seconded by Schlueter and carried, the applicatioz
of Santa Ana Unit ~131, American Legion Auxiliary, was approved to sell American
Legion poppies on May 24, 25, and 26, 1962.
On motion of Council-~n Heinly, seconded by Schlueter and carried, the applicatioz
of Salk Building Fund, Orange County C~=.,fttee, was approved to solicit funds June
1 to July 15, 1962, to build the Salk Institute for Biological Studies, San Diego.
On motion of Councilman Heinly, seconded by Schlueter and carried, the request of
Alpha Beta A~e Markets, Inc., was granted to hold an auction May 23, 1962, of the
equipment located in the market at 1010 South Main Street, as per list submitted.
Auction to be conducted by Sol Megibow of Kohn-Megibow Company, Los Angeles.
A petition was presented, signed by approximately seven persons, requesting the
formation of an Assessment District over Posey Street, from Newhope Street wester-
ly approximately 579 feet, for the construction of a 22.5 foot street with gutters
and paving improvements; and for the construction of a sanitary sewer main, servi¢
laterals, and manholes, Assessment District No. 223. On motion of Councilman
Heinly, seconded by Brewer and carried, the petition was referred to the Depart-

Carrier.

ley P.T.A., requesting careful consideration of good traffic control at the inter-
section of Edinger Avenue' and Greenville Street. Mrs. Helen Mudd, 1805 South
Forrest Avenue, stated the traffic at this location is extremely heavy and hazard-
ous, and requested the Council to install a traffic signal for the safety of the
school children. On motion of Councilman Heinly, seconded by Schlueter and carried
the c ....... onication was received and filed, and the request denied.
On motion of Councilman Heinly, seconded by Schlueter and carried, the request of
the Manager was approved for transfer of funds from unallocated monies in Fund 51
General Capital Outlay Fund to Fund 61-119 Civic Center Acquisition and Constructio
in the amount of $5,000.00.
On motion of Councilman Heinly, seconded by Schlueter and carried, the request of
the Manager was approved for the creation of Activity No. 51-114 City Council-
Property Acquisition, and the transfer of funds frem unallocated monies in F{tnd 51
General Capital Outlay Fund to Fund No. 51-114, in the amount of $61,000.00.
On motion of Councilman Heinly, seconded by Brewer and carried, the request of the
Manager was approved, and the Mayor authorized to sign agreement appointing the
Bank of America as paying agent for the City for the Water Revenue Bond issue.
