RESOLUTION NO. 93-046 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING AND REGULATING FEES AND CHARGES FOR THE ADMINISTRATION AND ENFORCEMENT OF CHAPTERS 7 AND 8 OF THE SANTA ANA MUNICIPAL CODE AND REPEALING RESOLUTION NO. 90-088 499 WHEREAS, The City Council of the City of Santa Ana finds and determines that the fees and charges hereinafter set forth are established in amounts sufficient to provide revenue equal to the costs of administration and enforcement of the provisions of Chapters 7 and 8 of the Santa Ana Municipal Code, and are reasonable and fairly allocated on the basis of burdens imposed and benefits received by the persons required to pay such fees and charges: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA that fees and charges for permits, plan checks, inspections, and investigations pursuant to Chapters 7 and 8, of the Santa Ana Municipal Code are hereby established and regulated as follows: GENERAL PROVISIONS Unless otherwise provided, payment of fees and charges as established herein shall be made to the Building official or his authorized representative at the time of initial application or request for the permit or service for which a fee is charged or imposed. No permit shall be issued to any person, firm or corporation unless all fees therefor have been paid in full. Exception: Waiver of Fee No permit or plan check fees required by this resolution will be charged for public improvement projects performed by construction contractors and subcontractors pursuant to contract with the City of Santa Ana or the Community Redevelopment Agency of the City of Santa Aha nor for any work performed by employees of the City in the course of their employment. However, this fee waiver does not exempt any party from obtaining a permit for such work nor exempt such party from conforming to the procedures established by the City nor from compliance with all applicable city and State ordinances regulating such work. 5OO RESOLUTION NO. 93-046 PAGE 2 B. Upon written request from the permittee, refunds of permit fees may be made to the permittee in an amount equal to eighty percent (80%) of the permit fee in excess of twenty dollars ($20.00) paid; except that no permit fees shall be refunded under any of the following circumstances: (1) After 180 days has elapsed from the date of the issuance of the permit. (2) If any inspections have been performed by the Building Safety Division. If a permit has been issued for a project located in an area outside of the jurisdiction of the City, one hundred percent (100%) of the permit and plan check fee may be refunded. If a permit has been erroneously issued, one hundred percent (100%) of the duplicated permit and plan check fee may be refunded. If a plan check fee has been paid and the plan is withdrawn by the applicant prior to the plan check, refunds of plan check fees may be made to the permittee in an amount equal to eighty percent (80%) of the plan check fee in excess of twenty dollars ($20.00) paid. In no other case may any plan check fees be refunded. A special investigation fee shall be charged by the Building official for any investigation of a building structural work, reports, certification, or any other related work requested by an owner or his authorized agent. Said fee shall be assessed in an amount sufficient to reimburse the City for the costs actually incurred by the city based upon a rate of fifty dollars ($50.00) per hour but in no case shall be less than fifty dollars ($50.00). Do VIOLaTION/INVESTIGATION & PENALTY FEES When any work for which a permit is required has been commenced without the authorization of such permit, an investigation may be required before a permit will be issued for such work. An investigation fee shall be assessed in an amount sufficient to reinburse the City for costs actually incurred by the city based on a rate of fifty dollars ($50.00) per hour but in no case less than fifty dollars ($50.00) shall be collected. In addition to the investigation fee and regular permit fee, a penalty in an amount equal to the amount of the total permit fee shall be required, but in no case less than one hundred and twenty-five dollars ($125.00). 501, RESOLUTION NO. 93-046 PAGE 3 ~UILDIN~ RECORDS REPORT Whenever a request is received for documentation by a written report or for information necessitating a search of documents, records, or plans, a fee shall be assessed in an amount sufficient to reimburse the City for actual costs incurred by the city, but in no case shall be less than thirty- five dollars ($35.00). FJ ~EPARTMENTAL APPROVAL FOR BUSINESS CERTIFICATE OF OCCUPANCY Whenever a Business License Tax application requires processing by the department for approval of a Business Certificate of!Occupancy, a fee of fifty dollars ($50.00) shall be paid to the Finance Director when the application is filed and deposited by him into Revenue Fund 11-417. DEMOLITION PERMIT The fee for a permit to demolish a building or structure shall be based upon the contract price but in no case less than fifty dollars ($50.00). When a building is demolished, the owner shall provide the city with a cash or surety bond as described in Section 8-1768 through 8-1771 of the Santa Ana Municipal Code. For the purpose of lot cleanup and capping of the sewer lateral, the value of the bond is to,be established by the Building Official but in no case shall the bond be less than one thousand dollars ($1,000.00) per building. A single family dwelling and garage shall be considered as one building for bonding purposes. (Note: A demolition permit fee is separate from and additional to the fee for any other permit which may be required by code provisions other than those specifically regulating demolition.) H. FLOODPLAIN CONSTRUCTION STANDARDS VARIANCES The fee for an application for a variance from the floodplain construction standards of the City shall be one hundred-fifty dollars ($150.00). I. APPEALS The fee for an appeal to the Uniform Code Appeals Board shall be seven'hundred dollars ($700.00), payable at the time of filing of the appeal. 502 RESOLUTION NO. 93-046 PAGE 4 RELOCATION INSPECTIONS The fee for an inspection on a building or structure, as required for its proposed relocation, shall be two hundred fifty dollars ($250.00) for each main building or structure and fifty dollars ($50.00) for each accessory building or structure. If the buildings or structures to be inspected are outside of the city, reimbursement for mileage traveled at the rate of $0.50 per mile and travel time at the rate of fifty dollars ($50.00)per hour is additionally required. K. APPLICATION PROCEEEING AND PLaN CHECKING FEES An application processing fee and plan checking fee shall be paid to the Building official at the time of submitting plans for checking. Such fee shall be equal to sixty-five percent (65%) of the building permit fee as set forth in this resolution. In addition, for all occupancy buildings, such fee shall also include a surcharge for state mandated energy enforcement equal to $22.00 for each 1,000 square feet of building area, or fraction thereof, up to 4,000 square feet, and $11.00 for each additional 1,000 square feet of fraction thereof. ne MICROFILM RECORDS Whenever plans are submitted which are required by any law or City procedure to be maintained as a permanent record, the following fees are to be charged for the purpose of creating and maintaining permanent files. Each sheet $2.00 RESEARCH AND PROCESSING FEES Whenever the Building official is requested to approve alternate materials or methods of construction in accordance with Section 105, Uniform Building Code, Section 201 Uniform Plumbing Code, Section 105(a) Uniform Mechanical Code or Section 105 of the Uniform Administrative Code provisions for the 1990 Edition of the National Electrical Code, the research and processing fee shall be $150.00 Whenever the Building official is requested to approve a modification of code in accordance with Section 106, Uniform Building Code, Section 201 Uniform Plumbing Code, Section 106 Uniform Mechanical Code or Section 106 of the Uniform Administrative Code provisions for the 1990 Edition of the National Electrical Code, the research and processing fee shall be $150.00 503 RESOLUTION NO. PAGE 5 93-046 STRUCTURAL ENGINEERING PLANC~CK Fees for structural engineering plancheck services for structures requiring a dynamic structural analysis in accordance with Chapter 23, UBC, or in accordance with State AB 3249, shall be charged to the applicant. Said charge shall be the actual costs incurred by the City for such service and shall be paid in addition to o~her applicable fees listed herein. ~PECIAL INSPECTOR REGISTRATION FEE The fee for registration of special inspectors in accordance with 8-100 SAMC is to be fifty dollars ($50.00) for each inspectidn specialty. NOTICE OF VIOLATION AND NOTICE AND ORDER BONDS Prior to issuance of permits to correct work required by a Notice of Violation or Notice and Order, the Building Official may require a cash or surety bond as described in sections 8-1769, 8-1770 and 8-1771 Santa Ana Municipal Code. The amount of the bond shall be established by the Building Official, but shall not be less than $200.00 for each Notice of Violation or Notice and Order. ,504 RESOLUTION NO. PAGE 6 93-046 II. SPECIFIC CODE FEES AND CHARGES BUll,DING CODE Any person desiring a permit required by the Building Code shall, at the time of filing an application therefore, pay a fee equal to $17.00 plus the sum of the fees for the work to be done under the permit as set forth in the following schedule, provided, however, that the minimum fee for the issuance of a building permit shall be fifty dollars ($50.00). The determination of total valuation shall be made by the Building Official. The value to be used shall be the total value of all construction work for which the permit is issued using the building valuation data based upon in the most recent edition of Building Standards published by the International Conference of Building official. ELECTRICAL CODE Any person desiring a permit required by the Electrical Code shall, at the time of filing an application therefore, pay a fee equal to $17.00 plus the sum of the fees for the work to be done under the permit as set forth in the following schedule, provided, however, that the minimum fee for the issuance of any permit shall be forty dollars ($40.00). (NOTE: An Electrical Code permit fee is separate from and additional to the fee for any other permit which may be required by code provisions other than the Electrical Code.) GRADING PERMITS Any person desiring a grading permit required by the Building Code shall, at the time of filing an application therefore, pay a fee equal to $17.00 plus the sum of the fees for the work to be done under the permit as set forth in the following schedule: (NOTE~ a Grading Code permit fee is separate from and additional to the fees for any other permit which may be required by code provisions other than those specifically regulating grading.) (NOTE: These fees do not include permit fees for any parts of the solar energy system which are subject to the requirements of other applicable codes.)
