A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA ESTABLISHING
A UNIFOP~M SCHEDULE OF FEES AND
REPEALING RESOLUTION NUMBER 92-058
WHEREAS, the City of Santa Aha performs special
services for the benefit of a limited number of persons
to whom such services are of value; and
WHEREAS, the cost of rendering such services should be
borne by that limited group who are the beneficiaries
rather than the citizenry at large; and
WHEREAS, the City Council is of the opinion also that
the charges established for such services should equate
to the direct cost thereof to the City of Santa Aha;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SAIqTA /%NA: That the following fees for
services and miscellaneous sales are hereby fixed and
established, to be effective from and after the first day
of July, 1993:

HAZARDOUS MATERIALS RELEASE RESPONSE PLANS AND INVENTORIES
RANGE DETERMINATION:
For the purposes of this Resolution, each business in the City of Santa Ana which is required to submit a
business plan and/or inventory pursuant to the Health & Safety Code, Chapter 6.95 of Division 20, shall be
assigned a "range" consisting of a "range-number" and a "range-letter" determined as follows:
RANGE-LETTER:
The range-letter of a business shall be based upon the total number of hazardous substance and hazardous
waste categories listed on the inventory of the business which is submitted to the City in accordance with the
following schedule:

Each submission of a business plan (as defined in health and Safety Code Section 25501) and each
certification provided pursuant to Health and Safety Code Section 25505 (c) and each submission of an
annual inventory pursuant to Health and Safety Code Section 25505 (d) (other than inventories which are
submitted as part of a business plan or certification) shall be accompanied by a fee based upon the 'range"
of the subject business in accordance with the following schedule:

Add up the quantities of all the various chemicals (or materials)
in each Of the three categories (gallons, cubic feet, pounds).
Use the highest quantity Of chemicals (or materials) listed to
determine the number range (1,2,3..)
Count the number of chemicals (or materials) !isted to
determine the proper letter range (A,B,C..)
Using the combined Range figures (Number and Letter, l-A,
2-C, ete) determine the proper fee from the schedule.
LATE FILING PENALTY
The Fire Chief shall impose a late filing penalty based on additional administrative costs incurred due to the
late filing of any business plan, certification, or inventor/. The amount of such penalty shall be 25 percent of
the fee for such filing. Non-payment of the fee and penalty shall incur 10 percent interest on the amount of
the billing starting 30 days after the date issued.

_ ADMINISTRATIVE PENALTY FEE SCHEDULE
This fee schedule utilizes a base penalty for each of the listed offenses and assesses a surcharge to that
penalty expressed as a percentage of the base penalty for those factors as outlined in H&S Code Section
25514.5(f) which include, but are not limited to, the following considerations, but shall not exceed $5,000 for
each day the violation occurs:

a. Extent of harm caused by the violation - surcharge to 500 percent.
b. The nature and persistence of the violation - surcharge to 500 percent.
c. The length of time over which the violation occurs-surcharge to 100 percent.
d. The frequency of past violations - surcharge to 100 percent.
e. Action taken to mitigate the violation - surcharge to 100 percent.
f. Financial burden on the violator - will be considered.
The following base penalties shall be assessed for the below-listed violations:
1. H&S Code Section 25503.5
Failure to establish and implement a business plan for
emergency response.
2. H&S Code Section 25503,6
Failure to notify real property owner that a business plan is
required.
3. H&S Code Section 25503,7
Failure to notify administering agency that hazardous substance
is being stored in railroad car.
4. H&S Section 25503.8
Failure by business, which is required to submit chemical
inventory pursuant to Federal Law, to establish and implement
a business plan.
5. H&S Code Section 25504
Failure to provide a complete business plan.
6. H&S Code Section 25505
Failure to correct, revise, or review business plan. Failure to
sumit annual inventory disclosure.
7. H&S Code Section 25509
Failure to provide complete inventory disclosure
8. H&S Code Section 25509.3
Failure to include estimated amounts of hazardous waste on
annual inventory.

Zoo Amphitheater/Picnic Area
By reservation only,includes Zoo admission. Larger groups will be
__ permitted at the discretion of the Zoo Manager and will be charged per
100 for each additional 100, or fraction of 100, persons up to a
maximum of 400. NOTE: Special permits require Park Ranger
supervision. Staff supervision is mandatory if facility use is beyond
normal working hours of facility supervisor and may be imposed for
any use determined by the facility supervisor to required such specific
supervision.

Copies of maps, documents, graphs, or special work may be furnished upon the payment of the cost of printing
and preparation. For such items for which a regular established price is unavailable, the Department Head, in
collaboration with the Director of Finance & Management Services, may establish a price consistent with the
cost of printing and preparation thereof. The Director of Finance & Management Services shall report such
.xceptions to the City Manager. It shall be the responsiblity of the City Manager to review costs annually and
,~lake such recommendations to the City Council as required to keep the charges consistent with the costs. All
governmental agencies and their official representative shall be exempt from paying these charges for single
copies for offical use.
