This being the continued hearing on Amendment Application No. 388, filed by Joe L. Serna, amending Sectional District Map 16-5-10, to reclassify frc~ the R-2 District to the C-1 District, property at the northwest corner of Newhope Street and McFadde (Sugar) Avenue with approximately 230 feet of Newhope Street frontage and approxi- mately 160 feet of McFadden Avenue frontage, all as shown on Exhibit A.A. 388A; Planning Cc~mission recammended denial. Ralph Jensen, ll04 East 17th Street, EmplG ee of Harry Tancredi, stated this property would not be suitable for R-2 developmentll as it fronts on an 85-foot street with a traffic signal at the intersection, control~ led cu~amercial development would not be detrimental as the property in question is 4 9 3 Co~uunicat ion obert S. Douglas Clark~ 1510 North Mar-Less Drive~ stated as we have Study 19~ which was ap~roved~by the Planning Commission, for the West Santa Ana area, south of Bolsa Avenue, there should be consistency of action~ and we should try to retain the remaining residential area. This City should make plans for the future as other cities are doing. A Master Plan, and Study 19, is a step in the right direc tion, and we need something to go on for the next 20 years. Mr. Clark pointed out the possiblility of the applicant applying for a Variance if the request for a change is denied, and stated a Variance would be as undesirable as a zone change, also, the Planning C~ission has recomended denial of this application. Ann Rigoni, 916 Tolaud Street, stated a visitor to her home informed her there ~as no reason for any objection to the zone change, and stated the reason for the objec- tion is the close pro. fruity of the High School and she does not feel the students should be subjected to commercial zoning near the school. William F. Watkins, West Toy Place, spoke in favor of the Amendment App~C&ti~n ~ and stated he had re ceived and analyzed quite thoroughly, a copy of Special Study 19 and it appeared to him it would be the same thing if he and his neighbors had prepared a Study 20 to advise the Council how to operate l?th and Bristol Streets. Mr. Watkins stated the people in the immediate area are in favor of commercial zoning on the property in question, the change would not affect the people who are objecting as they are not closeby, and c~mmercial zoning has a tendency to increase the value of surrounding property. Lloyd ~nsley, 4209 West Flight Avenue, speaking also Delbert W. Michael, 917 S~th Toland Street, who wes unable to attend the meeting~ cc~m~ended the Planning C~mmtssion, and stated the residents are opposed to any mercial zone changes in the neighborhood as they prefer the area to r~in resi- dential, and there is a shopping center in the vicinity large enough for any neigh borhood. Mr. Jensen stated Study 19 has its merits, but it is a blanket study. Regarding the intersection, it is not suitable for residential purposes, no one adjacent to or near the property in question has offered any opposition to the posed commercial zoning. Mrs. Rlgoni stated the people in favor were appro~tel 90 per cent renters who have no interest in whether or not the value of the ty increases or decreases. Mr. Watkins, and N. W. Quick, 610 South Newhope Street each stated the people in favor were predominately home owners who had been in the neighborhood longer than the individuals in opposition. Mr. Clark stated even tho~ he ~as not in the immediate vicinity of the proposed zone change, he felt that everyone should take an interest in the development of the City; and as far as his individual interest in the proposed zone change, he was instrumental in the annexation to the City of this particular area in 1959; and further stated there are approximately ~00 residents opposed to any zone change in this area, as the value of the residential section would decrease if apartmentm or c~ercial is permitted. On motion of Councilman Hubbard, seconded by Brewer and carried, Amendment Application No. 388~ filed by Joe L. Serna, was denied as rec~ended the Planning Ccmmaission. L. and Juanita Conkle, amending Sec- tional District Map 16-5-10, to reclassify from the A-1 District to the R-3 and C-1 Districts, property at the northeast corner of Verano and Sugar Streets, all /494 Variance Appl. ~o. 1642 Oran~me County Heart Association Reso. No. 62-113 Establish Council Policy on uses in area surrounding Civic Center Appeal Appl. No. 63 Conditional Use Permit No. 107 Edward B. Whitaker as shown on Exhibit A.A. ~81A. On motion of Councilman Hubbard, seconded by Schlueter and carried, the c~lcation was received and filed. Variance Application No. 16~2, fi~ed by Orange County Heart Association, to con- struct a professional office building in the R-2 District, at 104B West Eighth Street, was presented frcm the Planning C0~mmission for a Council policy relative to office development on Eighth Street, west of the presently zoned Civic Center area. Howard G. Buswell, Executive Director, Orange County Heart Association, stated the plot plan meets all requirements of the Zoning Ordinance for "P" Dis- trict, it will be a one-story building for use by the Heart Association, all con- ditions imposed will be cc~plied with, and this would be a logical location as Immediately south of the property in question similar non-profit organizations are located in the Ctl~H~.mity Center buildings. On motion of Councilman Brewer, sec- onded by Hubbard and carried, Variance Application No. 1642, filed by Orange Count Heart Association, was approved subject to the conditions as imposed by the Depart ment of Public Works and the requirements for the "P" District, with the further condition that a six-foot solid block wall be constructed along the north boundary of the parking lot, except 20 feet to be four-foot high for vision purposes. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Heinly, seconded by Hubbard and carried, the following Resolution en- titled: "Resolution No. 62-113 establishing policy of the City Council on uses in the area surrounding the Civic Center" whereby the COUncil believes the integrity of the Civic Center area should be main tained; that all requests for variances or changes of zone should be examined to first determine that the proposed new use will be cc~patible with the development of the entire area; that said area surrourzling the Civic Center has as its highest and best use the location of office buildings and similar uses; that the ccmmercia trade uses of wholesale and retai~or mechanical services are not generally compatible and generally would not be the highest type use facing or adjacent to the Civic Center area as now established, was considered and passed by the following vote: Ayes, Councilmen Royal E. Hall Noes, Councilm~en None Absent, Councilmen None Appeal Application No. 63 was presented on Conditional Use Permit No. 107, filed by Edward B. Whitaker, 1026 South Driftwood Drive, to establish a six-guest infir- mary for physically and/or mentally handicapped children in the R-1 District at 1026 South DriftwoodDrive, whereas the applicant appeals the denial of the Plan- ning C ......fsslon. Dorothy Whitaker, 1026 South Driftwood Drive, stated these chil- dren are physically and mentally handicapped and, as they .are crib patients, would never leave their beds. There has been an increase of mentally retarded children in the State, and as there is still a 600 bed waiting list at Fairview State Hospital it will be two or threeyears before these children can be admitted Mrs. Whitaker presented a Statement frc~ the State Department of Mental Hygiene and quoted frc~the Statement: "The broad range of services needed bymentally ill and mentally retarded person~ requires not only hospital and institutional service but the type of care that can only be given in a licensed residential home. It is the responsibility of the zoning authorities of the cities and counties to provide the areas in which all these community-based programs can function." On motion of 495 Councilman Hubbard, seconded by Schlueter and carried, the Statement was received and filed. Mrs. Whitaker further stated she proposed to convert her garage into living quarte~s and there will be more than required area per child. One of the objections from the residents in the vicinity is they believe it will degrade the neighborhood. The outside of my home will not change, the garage will be closed, and as I have a corner lot there will be more than adequate parking for the few, ii any, visitors. There are objections stating it would set a precedent for similar requests in the neighborhood, and as there are several employees fr~n Fairview Stat. Hospital residing in the area, I questioned them and they stated the eight hours a day at the hospital are enough, and they have no desire to start an infirmary in their home. Mrs. Whitaker presented and read a letter of recommendation from Mae E. Robinson, Registered Nurse, 505 Fullerton Avenue, Newport Beach, setting forth the capabilities of Mrs. Whitaker, and stating there is a great need for this type of care. On motion of Councilman Hubbard, seconded by Schlueter and carried, the letter of raccmmendation was received and filed. Mrs. Whitaker stated a petition with ~6 signatures in favor of her proposal is attached to the Application for the Variance. In the audience is Gall Eagleton, Attorney for Equitable Savings & Loan Association, which has an equity interest in the tract, and his main objection is h~ believes the infirmary would degrade the neighborhood, and they are interested in getting a return on their investment. If a buyer came into the neighborhood, he would not even look at my hc~e because there would be no outside chauge, except per haps improvements, and there would be no indication that children were inside. There have been only two other similar requests this year which were granted and their neighbors do not feel that the infirmary has degraded the neighborhood. Mrs. Whitaker presented letters of reccm~nendation from Robert C. Hoffman~ lO14 Driftwood Drive, Bishop and Mrs. George A. Grayson, 5009 Crystal Lane, and Mrs. Dorothy Berry 491~ Crystal Lane. On motion of Councilm~u Brewer, seconded by Eubbard and carried the letters were received and filed. Mrs. Whitaker stated her main interest was to give loving care to these children and relieve the parents of the burden of attemp- ing to care for them. Mrs. Marion A~am% 821 North Mountain View Street, stated there is a great need for this type of care, and in the six months that her own in- firmary has been open several people have cu~aented on how quiet it is, no one realizes the children are there, and the value of her property has increased, and the improvements that are made will increase the value of the area. A child under the age of two cannot be entered at Fairview State Hospital, and Private hospitals cannot keep a new born baby Of this type. The Mayor asked those in the audience in favor of the proposed Variance to stand. Approximately five people stood. Bill Bembardier, 1029 South Driftwood Drive, stated he lived directly across the street from Mrs. Whitaker and is in favor of the proposed infirmary, and the appearance of her home wOUld improve, and thereby increase the vslue of his o~n. Mrs. Fagin, 101L McLean Drive, stated her home is located in the same tract, they have expended approximately $6,000.00 in improvements, and have no objection to Mrs. Whitaker caring for these children in her home, and the people who do object do not quite understand the situation. They have not had any contact with this type of child, and do not understand the need for heine care. The Mayor asked those in the audi- ence opposed to the granting of the Variance to stand. Approximately six persons stood. Gail Eagleton, Attorney~ representing Equitable Savings & Loan Association, 496 .speal ApplJ No. 64 Variance Appl. No. 164~ F. Lavelle Sanders Bellflower, stated they were in no way opposed to the purpose of the proposal, but felt the infirmary should be established in an appropriate zone, and as,unfortunat ly, this is a distress tract, and in order to encourage future ownership by single family residents, they are opposed to the granting of the Variance. Nario Siracus ll09 South Corta Drive, stated he lived about one block away, and he objected be- cause he believed others would make similar requests. It was moved by Councilman Heinly that a Resolution be adopted overruling the Planning Commaission and grantin the Variance. Motion lost for lack of a second. It was moved by Councilman Hubbard, and seconded by Schlueter, that Appeal Application No. 63 be denied and the decision oF the Planning Commission upheld. Motion not carried. On motion of Councilman Brewer, seconded by Heinly and carried, the matter was tabled. Council man Hubbard voted no. Appeal Application No. 6h was presented on Variance Application No. 16h4, filed by F. Lavelle Sanders, to convert a rear portion of the lot in the R-1 District into off-street parking, at 1622 North Fairmont, where~n the applicant appeals the deni al of the Plaz,,~ing Commission. Attorney Charles G. Elizabeth Livingston, 1606 Oakmont Place, stated the only objection to a postponement is that a lot of valuable time has been wasted by the interestedi parties that have already attended several meetings regarding this matter, and questioned the possibility of the matter also being postponed at the next meeting. On motion of Colluc~lman Eubbard, seconded by Heinly and carried, action on Appeal Application No. 64, filed by F. Lavelle Sanders, was postponed to the next meeting Cummo_nication was presented from the Planning C~ission referring the matter of the proposed abandonment of Riverine Street between Eighth and Tenth Streets to th Council with certain conditions of approval reco~anended in the event this portion of Riverine Street is abandoned. On motion of Councilm~n Hubbard, seconded by Brewer and carried, the communication from the Planning Co,~mission was received and filed, and the staff instructed to take the necessary steps relative to the abandonment of Riverine Street between Eighth and Tenth Streets. Communication was presented from the Planning Department recommending approval of Preliminary Record of Survey 267, filed by David Claussen, creating two lots lo- cated on the southwest corner of McFadden (Sugar) Avenue and Harbor Boulevard, sub Ject to conditions. On motion of Councilman Hubbard, seconded by Brewer and car- ried, Preliminary Record of Survey 267, filed by David Claussen, was approved sub- Ject to conditions. Communication wes presented from Attorney Edwin P. Martin, 811 North Broadway, filed by Mr. and Mrs. Hubert Melton, reference conditions imposed on Prel~m~uary Mmps 232 and 256~ stating the Sub- Division Regulations of the Municipal Code, and in particular Section 9325, pro- vides for the reservation of strips to control access .to alleys for the protection of a substantial property right. Mr. and Mrs. Melton propose to dedicate a 20-foo right of way for the required alley plus a one foot reserved strip to the north of said alley to the City Council so that the City Council may control the access to the alley way on the north, with the request and upon the condition that if the property owner to the north desires to take advantage of the alley access, he be required to reimburse Mr. and Mrs. Melton for fifty per cent of the value of the improved alley, and requesting acceptance of the proposal by the City Council. 497 ~stall Traffic Signal System Edinger Avenue and reenville Street Attorney Edwin P. Martin, 811 North Broadway, representing Mr. and Mrs. Melton, requested permission to reserve a one-foot control strip on Mr. Melton's property to control access to the alley as they believe the adjoining property owner is aware that the City will require the Meltons to install an alley, and thel property owner believes he will be able to take advantage of this situation, which will substantially enhance the value of his land without having to share in the cost of the improvement. Mr. Martin requested that the one-foot control strip be granted to the Council or retained by Mr. and Mrs. Melton to recoup some of the cost in- volved. It was moved by Councilm~n Heinly, seconded by Hubbard and carried, that Preltm~uary Record of Surveys 232 and 256 be amended to impose an additional con- dition that the applicant, Mr. and Mrs. Melton, amend their Maps to provide a one- foot reserved strip to the north of said alley and grant a deed in fee to the City. and proper authorities of the City be authorized to enter into an agreement with Mr. and Mrs. Melton, said agreement to provide for the reimbursement of the on a pro-rata share of the cost of the alley and of the improvements,to be from any person granted access to said alley in the future, said access to be in effect for only ten years. Approximately 25 persons stood. The Manager presented a written report from the Department of Public Works, reference recommended tra ~f~ic signal location and cost estimate for traffic signal on Edinger Avenue near Diemon, Elementary and Smedley Junior High Schools, initiated by the Council at the meet- ing of June 4, 1962, and orally reported after considering such factors as pedes- trian and vehicular volume in the vicinity of the two schools~ areas of pedestrian generation, expected actions of various-age students and other factors, it is re- c~ended that the traffic signal on Edinger Avenue be located at Center Street. The cost estiraate of a Non-Standard Flashing Yellow, Two Faced Signal System is approx!mately $4,600.00, it is our recommendation that this type not be used, our recommendation is that we go forward with a standard type signal conforming to both State and National standards, at the estimated cost of $6,500.00. On motion of COuncilm~u Hubbard, seconded by Schlueter and carried, the report from the De- partment of Public Works was reCeived and filed. Norris H. Mayes, 1619 South ToWn Street, President, Southwest Santa Ana Civic Association, Inc., presented and read a report stating that at a specially called meeting of the Association and cummGni ty residents a motion was made, and passed by unanimous vote, to recommend the place ment of the proposed mechanical signal at the intersection of Greenville Street and Edinger Avenue because: (1) Closer to business area. (2) Will accommodate more adult residents as well as children. (3) Closer to bookmobile. (~) Child- ren and adults living in area southwest of intersection of Edinger Avenue and Green ville Street will have more direct access to school facility (Diamond School). (5) Edinger Avenue and Greenville Street intersection is a more central location. (6) It will accommnodate autcmobile drivers who park on south side of Edinger Ave- nue. (7) It will facilitate pedestrian delivery and pick-up in front of Diamond School. Mr Mayes further stated the people who attended the meeting unanimously agreed to go along lO0~ with the decision of the Council. On motion of Councilman Hubbard, seconded by Brewer and carried the comm~uication frem the Traffic Engineer, Automobile Club of Southern Californi was received and filed, requesting that the new signal installed to control traffi on Edinger Avenue, near Smedley Junior High School and Diamond Elementary School, be of the standard design for traffic control signals in accordance with the best current practice; and that the traffic signal be of the type that its use by pedes trians, as well as motorists on the side street, creates the least possible delay to the main flow of traffic. It was moved by Councilman Brewer that the proper authorities be instructed to proceed with the installation of the traffic signal as recommended by the Manager.. and the Department of Public Works, and in addition the construction of a pedestrian walkway along the south side of Edinger Avenue frcm the existing service station at Greenville Street and Edinger A~enue to the Frosty Freeze at the southwest corner of Edinger Avenue and Center Street, to be replaced by a standard city sidewalk when the streets are improved, and that the school boy patrol be used in conjunction with the new signal.
