Hereafter referred to as Finding 3. The City of Santa Ana Community Development Agency is the lead agency involved in the establishment of the Community Faciliti~ Improvement Plan, which ir the project os defined by Section 21065 of the Government Code. In compliance with CE~b4, the Santa Ana Community Development Agency has prepared a Environmental Impact Repor~ (EIR). The F_JR for the project provides a discussion of the environmental setting and evaluates potential environmental impacts of the Plan, as well as the impacts which may occur as result of projects funded under the Plan. Further, the Planning Commission is recommending to the Cay Council determination that the EIR is complete and has been prepared in accordance with CEQA and the CEO./4 Guidelines. Therefore, the following findings are set forth herein pursuant to Section 15091 of the CEQ, A Guidelines. 0 0 0 0 A) EARTHAND GEOLOGY Potentially Significant Effect: The terrain within the project area is relatively flat with no major differences in local relief According to past seismic studies conducted in the project area, no known or suspected active fault traces pass through the project area. Howev~, the City is in a seismically active reglon. A ma]or earthquake occurring along 58'8 F_~iHIBIT 'A ' P~'IGE 2 any of the major active fault traces in the region would be capable of producin~ effects in the project area, though the risk is no .?e~te~. than that for ~ are~ther~ California region. Also, new public stntctut~ (critical facilities) within the pm]~ct t~rea shall be incorporated tnto the Cio?s/County's Emergency Preparedness Plan (Office of Emergency Preparedness Multifunctional Hazard Management Plan), which include procedures for responding to ~.rgencles. These measures can reduce potential impacts to insil~nificant levels. Potential Significant Effect: The adoption of the Santa Ana Community Facilities Improvement Plan will nog by ~elf, result in any air quality impacts. Rather, the adoption of the Redevelopment Plan will permit an implementation of ~e plan which will promote development within the project area. Potential air quality impacts will be coff~[~ around those actions arising from the development of ne~ facilities provided for by the Plan. The Plan's implementation will result in the rehabilitation of ~isting uses with minimal displacement. Where replacement will occur, new development is not lll~ly ~o generate substantially greater mobile or stationary emissions over that generated by wdsting development. In addition, new and rehabilitated development will be constructed or retrofitted with equipment using the best available control technoloD,, resulting in lower stationary emissioos over wdsting. In addition, clean air standards for both vehicles and machineo~ continue to be effective in reducing emissions from the. vt sources. Finally, future activities will be required to comply with the SCAQMD's measures and~prograrnt designed to reduce emissions. A number of parks may undergo expansion which will involve the removM of existing residences or commer~lul businesses. The Santa Ana Stadium txpanslon, the Zoo a~'pansios, major park development In existing facilities, and the addition of five new parks will generate vehicle tro~tc with emissions exceeding SCAQMD thresholds. Mobile emissions will be further reduced with the Impltmentation of TDM and the SCAQ. MD rideshadng measures (Regulation XIO. Finding: Finding 3 Facts in Support of the Findings: Individual projects that will be approved in the cour~ of the plan's implementation will be required to obtain the necessary air quality permits and to implement any mitigation measures required a~ pa~ of the projects' approvals. These include: 1. Construction equipment shall be properly maintained and serviced to minimize exhaust emissions. ( ' 7he use o/Iow sulfur fuel for construction equipment shall also be encouraget~ where feasible. EXHIBIT P~4GE 3 2. Grading activities shall ceast during l~iOds of high winds. High winds are generally considered as winds with speeds over 25 miles an hou~.~ConsOuction activities shall cease during local Stage One smog alerts. Dust control measures shall be practiced during wvcavation and grading activities. These include regular watering minimizing cleared areas, paving seeding ar landscaping right after grading activities, the use of water tracks or spttnlder systems, regular street sweeping and use of soil stabilizers and binders. Tracks transporting debds and excavated/fill material shall be covered at all times, and trucks shall be washed down with water before leaving the site. Redevelopment projects shall comply with Federal, State and SCAO. MD regulations on air quality and pollution control regulations prior to development. New stntcturez should utilize solar energ), Or other Title 24 measures for lighting hetm'ng and power, as much as is feasible. Tot lots, athletic fields, school facilities, and other active park areas shall be located away from busy roads and intersections to avoid locations near emissions hot spots. ~ Those projects requiring major construction will be required to undergo en~t~rIh~t~J~ o~ an individual basis. Futura l~roject could have air quality impacts that~a~t.~rlgi~ifica~t.~a~ ad~rse None of the proposed projects envisioned unq the Comrn~l~aclllt~es l~~t~t~lt result in any significant increases in groundwater detl~etion o~tttion ~resources. The gret~est ]~4i~zourc~..g~f~c'Knsumption witl be related to water used to maintain the turf and landscaped areas in~he e~ng'~hd proposed parks. The maintenance and expansion of open space will also have a beneflcidl,4~i~pact in that there will be more land area available for groundwater recharge. Finding: Finding 1 Facts in Support of Finding: Hazards posed by floodwaters can be prevented by requiting compliance with the City's standards on floodplain deve!opmen~ limitation on paving construction to withstand flooding and prevention of onsite ponding. ~4lso, to assist in water conservation efforts, thc use of reclaimed water for landscaped areas shall be encouraged as much as possible. Potential impacts can be mitigated to insignificant levels. PLANT AND ANIMAL LIFE Potential Signlfcant Effect: The construction of individual projects under the Community Facilities Improvement Plan will not likely impact any habitats that contain rare or endangered or candidate species. However, the eMsting parks do serve as habitats for birds and small mammals that would be commonly found in a natural setting. Construction activities may result in small mammals and rodents moving to adjacent parcels to escape construction related noise and other disruption. New development in areas located in the vicinity of remaining undisturbed areas (such as near Santiago Creek) or involving larger parcels of land should be 589 590 EXHIBIT ',4' P.,4GE 4 ~arveyed prior to construction. The proposed park improvements may involve the removal of mature trees. -- Mitigation measures should be considered to .avoid the destruction and/or removal of mature trees. Finding: Finding Facts in Support of the b3ndings: Impact. v on existing plant and animal life can be reduced to iusignificant levels by consultation and coordination and with the rez~oousible resource agencies, including the Califomin D¢lnmment of Fish and Game, the U.S. Fish and P, rddiife Ser~tce, : and the California Native Plant Society when projects are proposed in areas located within or ad]acent to undisturbed areas. Recommended improvements to Santiago Park will require necessmy field investigation and Army Corps of Engineers permitting prior to improvement. Also, the City shall obtain the nece. vsary approvals prior to the disturbance of coast live oak, holly oak, California ocamore$, or other mature trees. Stands of oak, ocamore, or eucalyptus trees shall be incorporated into the prolect design if at all possible. Environmental revlon, for future redevelopment projects, in accordance with CEQ.4, will allow mitigation of any significant adverse impacts on sensitive plant and animal habitats. E) NATURAL RESOURCES Potential Significant Effect: .As indicated previously, there art no mineral or resource waraction activities within tbe City. As a resu& future development would not adversely impact any ongoing mining or extn~ction activities. Potential impacts art associated with the construction of new facilities that will require construction aggregate and other resources and materials commonly used for construction purpases. NOISE Potential Significant Effect: Thc adoption of the Redm~lopment Plan will nog by itself~ result in noise impacts. Pottntial noise impacts will be centered around individual pro]ects arising from their constntction and implementation of the Plan. Local traffic noise I~vels will increase in the vicinity of the major facilities. The I~vel of noise increase will not likely be perceptible to ad]ocent uses. i Finding: Finding 1 Facts in Support of the Findings: Individual projects will have to be reviewed on a case-by-case basis to ensure that appropriate mitigation measures for noise are provided. Potential adv~e noise impacts are likely to center around demolition and construction activities or the introduction of more intensive recreational uses near noise sensitive aren~ (homes, schools, etc.). Construction activities shall be limited to the hours of &.O0 a~m. to 6.'00 p.m. Monday through F~duy, and 9:.00 a.m~ to 5:00 p.m. on Saturdays. G) RISK OF UPSET AND HUMAN HEALTH Potential Significant Effect: The projects envisioned under the Community Faci~tie~ Improvement Plan include parks, community centers, cultural centers, fire station improvements, and facilities for the police department. These type of land uses will not typically involve the large scale us~ ~torage, or production of hazardous materials. No facilities envisioned under the proposed Community Paciiltie.~ Improvement Plan will involve the closure or otherwise restrict the use of a~erial roadways that would be used for evacuation routes. The addition of law enforcement and fire protection facilities will improve the level of public safety services. The Community Facilities Improvement Plan will al~o involve the renovation and construction of new community a~d recreation centers which may be used for treatment/evacuation center~ in the event of a major disaster. These are benefu~al impoct~. Finding: Finding I Facts in Support of Finding: The projects envisioned under the Community Facilitiet Improvement Program will not result in any adverse significant impacts in term~ of risk of upset. Ha~,~,ver, the City and school districts will still be able to ~cercise their delegated power~ of eminent domain to obtain land for public improvements. Future redevelopment projects are cons~ent with the City's General Plan and Zoning Code, no specific changes in land use designations will occur. Projects under the Community Facilities Improvement Plan will be subject to wdsting and future land use regulations. Finding Finding 1 Facts in Support of Finding: All future public development mu~t be consistent with the City's General Plan, Zoning Ordinance, and other adopted community plans. Under current Federal and State laws, public agencies are required to provide just and fair compensation for real property obtained through an agency's use of polic~ powers. The just and fair compensation provisions require that property ownen must receive payment for bath the acquisition of real properly (based on fair market value appraltah) az well as other costs for relocation, etc. As indicated previously, the Redevelopment Agency will not be permitted to use eminent domain powers for this Plan. At any time when ~ncy fundr~ will l~ u~ed to acquire additional land for the facilities envisioned under this Plan, additional CEO. L) PUBLIC SERVICES Potentially Significant Effect: Overall, the proposed Community Facilities Improvement Plan will benefit education, recreation, fire protection, and law enforcement services. The construction of new community facih'ges may require additional police and fire protection services In the City. The plan will also assist in the financing of educational facilities. Fireflow demand is estimated by the Fire Department according to the Department's Guide for the Determination of Fire flow. Structures are then rcquired to be redesigned to provide adequate fire flow or include water systems and fire hydrant improvements. The addition of seven neighborhood parks and the expansion of vdsttng facilities may place additional service demands on law enforcement. Finding: Finding 1 Facts in Support of the Finding: While beneficial impacts on public services are expected, adverse impacts may occur with park development. Implementation of the following mitigation measures will reduce public service impacts to a level of insignificance: New development shall comply with the Uniform Fire Code, the Uniform Building Code, all applicable state codes, the National l~re Protection Association Fire Code and the Santa .,ina Municipal Codes on fire safety, fire prevention and fire protection measures in new construction, as reflected in approved building plans. Plans for development shall undergo review by the Santa Ana Police Department for crime prevention design and measures promoting security and defensible space. 3. New development shall have automatic fire sprinklers in all stntctures, if possible. One deputy fire inspector as on-site fire inspector shall be provided during the construction phase (starting at constraction of first building to sinai sign-off on last shell of a structure). Security arrangements must be reviewed by the Santa Ana Police Department when development plans are known. Solid waste generated by community facilities is subject to fluctuations due to seasonal influences such as school vacations, and greater use of parks during the summer. Finding: Finding I Facts in Support of Finding Impacts on utilities can be reduced to levels of insignificance by requiring a drainage analysis and improvements, source reduction and recycling programs, and other utility upgrades needed to adequately serve individual projects. Planned capital improvement projects will also prevent adverse impacts on utilities. N) CULTURAL RESOURCES Potentially Significant Effect: Potential environmental impacts could result from the demolition of culturally significant structures or the disturbance of a previously unknown site of prehistoric or historic significance. The expansion or development of a park in an area that has only been marginally disturbed may result in the discovery of artifacts. A number of park improvements are recommended in existing parks and any excavation may uncover a previously unknown site. New development may involve the demolition of existing onsite improvements. Appropriate surveys need to be undertaken to ensure that the stractures slated for demolition are not historically significant. Where agencies have taken action resulting in environmental damage without explaining the reasons which supported the decision courts have invalidated the action. Where the decision of the public agency allows the occurrence of significant bffects which are identified in the final EIR but not mitig~et~ the agency must state in writing the reasons to support its action based on the final EIR and/or other information reconis. This statement may be necessu~y if the agency also mal~s the finding under Section 15091 (a) (2) or (a) (3). If an agency makes a Statement of Overriding Considerations, the Statement shouM be included in the record of the project approval and shouM be mentioned in the Notices of Determination." IBIT B MITIGATION MONITORING AND REPORTING PROGRAM The Santa Ana Redevelopment Agency is prop0si~g to establish a Community Facilities Improvement Plan on approximately 43.5% df the' ~s land area. The Draft and Final EIRs for the proposed redevelopment plan has been circulated and the Plan is being considered for adoption. As part of the CEQA review process, this mitigation monitoring and reporting program has been prepared to ensure that the recommended mitigation measures are applied to projects funded by the Plan. The California t~nvffonment Quality Act (CEQA) was amended in 1989 to a~tion 21081.6 (to implement Assembly Bill (AB) 3180), which requires a public a~gu~j~i~t ~monitoring and reporting program for assessing and ensuring ~omp~th ~ll~'.~recl~raitigation measures applied to proposed developments. ~.~gKd in Se~~.~ of ~he Public Resources Code, .~~. ~/i.~~~ L' ~' ':..the public agency shall adopt~ l~Jllbh~or rnonit~t~Y~n~m for t~h~ ~ ~q the project which U has adopted, ~r made a co~itio~ect~. ~~~J,& · mitigateoravoidsignificanteffe~nth~e~er~.~~ Sect,on 21081.6 provides general gu'~~'torin~ and/or reporting mitigation programs.
