HomeMy WebLinkAbout93-056 - Establishing Underground Utility District No. 29RESOLUTION NO. 93-056 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING UNDER- GROUND UTILITY DISTRICT NO. 29. WHEREAS, by Minute Order dated March 15, 1993, a public hearing was called for June 7, 1993, at the hour of 6:00 p.m., at the Council Chambers of the City Hall, 22 civic Center Plaza, Santa Ana, California, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, and the underground installa- tion of wires and facilities for supplying electrical co~mmunication or similar or associated service, for the formation of the Underground Utility District No. 29 within that certain area of the City described as follows: That portion of the area within the Santa Ana City Limits bounded easterly and westerly by lines 100 feet from the centerline of Bristol Street, southerly by line 350 feet from the centerline of Warner Avenue, and northerly by the SR 22, Garden Grove Freeway. Also, said portion of the area bounded north- erly and southerly by lines 100 feet from the centerline of First Street, westerly by the centerline of Hesperian Street, and easterly by line 400 feet from the centerline of Bris- tol Street; the area bounded westerly by the centerline of Hesperian Street, easterly by the centerline of Bristol Street, northerly by the centerline of Wilshire Avenue, and south- erly by the centerline of Elder Avenue; the area bounded easterly by the centerline of Magnolia Avenue, westerly by the centerline of Bristol Street, northerly by the centerline of McFadden Avenue, and southerly by the center- line of Edinger Avenue. WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Santa Ana: 1. That pursuant to Santa ana Municipal Code Sections 37-1 to 37-13, the above-described area is hereby declared an Underground Utility District and is designated as Underground Utility District No. 29 of the City of Santa Ana. Attached hereto, 0 q 0 0 0 0 RESOLUTION 93-056 Page 2 marked Exhibit "A," and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. 2. That for that portion of Underground Utility District No. 29 located between Warner Avenue and Myrtle Street, the City Council does hereby fix December 1, 1994 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 29 on or before June 15, 1995. 3. That for that portion of Underground Utility District No. 29 located between Myrtle Street and Washington Avenue, the City Council does hereby fix December 1, 1995 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 29 on or before June 15, 1996. 4. That for that portion of Underground Utility District No. 29 located between Washington Avenue and the Garden Grove Freeway (SR 22), the City Council does hereby fix December 1, 1996 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 29 on or before June 15, 1997. 5. That 20A funds will be charged for installing up to 100 feet behind right-of-way for each customer's service lateral. Undergrounding of individual electric services in excess of 100 feet will be at the expense of the property owner. 6. That the Clerk of the Council is hereby instructed to notify all affected utilities and all affected property owners within Underground Utility District 29 of the adoption of this Resolution within ten (10) days after the date of such adoption. Such notification shall be made by mailing a copy of this Resolu- tion, together with a copy of said Santa Ana Municipal Code Sections 37-1 to 37-13 to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. 7. That the City Council of the City of Santa Ana hereby finds and determines as follows, upon the basis of the evidence presented at said hearing; that the public necessity, health, safety, and welfare require the removal of poles, overhead RESOLUTION 93-056 Page 3 015 structures within said area of the City, and the underground installation of wires and facilities for supplying electric, communication, and similar or associated services, so as to eliminate hazards caused by fallen lines and poles and to improve visibility of pedestrian traffic to vehicle drivers.
