A RESOLUTION OF THE CITY COUNCIL OF TIlE
CITY OF SANTA ANA APPROVING VARIANCE NO.
93-005, TO ALLOW A REDUCTION IN MINIMUM
SETBACK AND TO ALLOW A FENCE EXCEEDING
}{EIGHT LIMITS IN THE SETBACK AREA FOR A
PROPOSED ENLARGEMENT OF AN AUTOMOBILE
REPAIR BUILDING LOCATED AT 2002 WEST
FIRST STREET
WHEREAS, this Council held a public hearing on December 6,
1993, on Variance Application No. 93-005, to allow:
(i)
A reduction in minimum building setback standards from 15
feet to 9 feet; and
An eight-foot high wrought iron fence within the setback
area.
for a proposed enlargement of an automobile repair building located
at 2002 West First Street;
NOW, TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing
this Council finds and determines as follows:
A. Because of special circumstances applicable to the subject
property, the strict application of the minimum lot size and
minimum planter size requirements in the zoning regulations
would deprive the subject property of privileges not otherwise
at variance with the intent and purpose of the provisions of
this chapter;
Because of the triangular shape of the property and
adjacent land uses, the strict application of the 15 foot
setback and fencing requirements would require an unduly
large percentage of the property to be maintained as
landscaping and prevent effective security fencing.
B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial property
rights;
The granting of the variance is necessary to allow proper
development of the site in accordance with the intent of
community development standards and to provide effective
protection from impacts associated with neighboring
uses.

C. That the granting of a variance will not be materially
detrimental to the public welfare or injurious to surrounding
property;
The granting of the variance will not detrimentally
impact the vicinity of the project and will facilitate
the clean-up of the site and area.
D. That the granting of a variance will not adversely affect
the General Plan of the City;
The granting of the variance will not adversely affect
the goals,objectives and policies of the General Plan.
2. The approval of Variance No. 92-008 is subject to the
conditions set forth in Exhibit A, attached hereto and incorporated
herein by reference.

Conditions for Approval
Should Amendment Application No. 1063 and Variance No. 93-5 be approved, the project
must comply with all applicable sections of the Santa Ana Municipal Code, the
California Administrative Code, the Uniform Fire Code, the Uniform Building Code and
all other applicable regulations. In addition, it shall meet the following:
A. Planninq Division
A minimum of half of the required trees along Walnut Street shall be
upgraded in size from 24 inch box to 36 inch box trees.
2. All perimeter security gates shall remain open during business hours.
The site shall be developed in accordance with site plan review DP No.
93-41.
The perimeter security fencing shall satisfy minimum Police Department
security standards while including an upgraded decorative design.
There shall be no posting of signs or banners, temporary or permanent,
on the perimeter security fence.
B. Buildinq Department
The project owner/developer shall designate a contact person who has
the authority to act on behalf of the owner to coordina%e and provide
consistency for all of the plans required for the project including
landscaping, grading, pedestrian protection, architecture, structural,
electrical, mechanical and plumb£ng. Note on the drawings contact
person's name, position, business address, and telephone number.
C. Public Works Aqeucy
1. Prior to issuance of utility release:
Process, receive City Council approval and record the abandonment
of the area at the corner of First Street and Walnut Street
between the existing 50'-0" radius property line and the back of
existLng sidewalk.
Modify the existing traffic signals at F£rst Street and Townsend
Street per approved traffic signal plans.

Relocate the existing "No Stopping Anytime" sign to be 10'-0"
from the easterly top of "X" of the new drive approach which
aligns with the centerline of Townsend Street per approved
improvement plan on First Street.
Close the existing easterly drive approach with sidewalk, curb
and gutter per approved improvement plan on First Street.
Construct a new drive approach per City Standard #1112, Case 1,
W=28'. A=44', X=4' per approved improvement plan on Walnut
Street.
Relocate the existing "No Stopping--Street Sweeping" sign out of
the path of the proposed drive approach per approved improvement
plans on Walnut Street.
Remove the existing 1'-0" wide asphalt patch across the sidewalk
adjacent to the existing street light located midpoint along the
property's parkway and replace with concrete per approved
improvement plan on Walnut Street.
Construct street tree wells and plant minimum 24-inch box trees
per City Standard #1124 on First and Walnut Streets at locations
£n accordance with approved improvement plans.
Close two existing Walnut Street driveways with curb and sidewalk
per approved improvement plan.
Relocate crosswalk striping per approved signal and striping
plan.
Close existing wheelchair ramp on First Street with curb and
sidewalk per approved improvement plan.
Construct a new wheelchair ramp per approved improvement plan.
Modify existing pedestrian push button bases on First Street as
required per approved signal and striping plan.
Restripe existing striped medtan on First Street per approved
signal and striping plan.
