HomeMy WebLinkAbout94-013 - Denying Variance Application No. 93-008RESOLUTION NO. 94-0]5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DENYING VARIANCE APPLICATION NO. 93-008, WHICH SOUGHT TO ALLOW AN OFF-PREMISE ADVERTISING SIGN TO BE MAINTAINED AT VARIANCE WITH THE OFF- PREMISE SIGN REGULATIONS AT 3151 SOUTH STANDARD AVENUE WHEREAS, this Council held a public hearing on March 7, 1994, on Variance Application No. 93-008, which sought to allow relief from the City's off-premise advertising sign regulations and nonconforming use regulations for property located at 3151 South Standard Avenue; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: A. The strict application of the zoning regulations will not deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter; The subject property located at 3151 South Standard Avenue is a flat, rectangularly shaped parcel with no special circumstances related to its size, shape, topography, location or surroundings. A viable use of the land is available through the use of the structure on-site. The property has not been deprived of any privileges accorded any nearby properties as these properties are also located in a Critical Development Area and are governed by the same Off-Premise Commercial Advertising Sign Ordinance. The strict application of these codes would not deprive the subject property of privileges securable to other property sites within the area. B. That the granting of a variance is not necessary for the preservation and enjoyment of one or more substantial property rights; The property owner's substantial property rights will continue to be preserved and an adequate means of benefit will remain available to him by the continued use of the building on-site. C. That the granting of a variance will be injurious to RESOLUTION 94-013 295 Page 2 surrounding property; The granting of a variance for the proposed 59 feet high off-premise commercial advertising sign with a south facing sign face of 864 square feet and a north facing sign face of 540 square feet would be creating a hazard to motorists traveling on the freeway by allowing a excessive distraction and create an unattractive environment or blight in an area deemed as to have paramount importance to the future economic growth and stability of the City. In addition, it would be granting a special privilege to the property owner as the surrounding properties would not be permitted to have an off-premise commercial advertising sign of this height and size. D. That the granting of a variance will not adversely affect the General Plan of the city; The proposed off-premise commercial advertising sign is in direct conflict with the implementation program and the goals and objectives for the Scenic Corridors Element of the City of Santa Ana's General Plan. The billboard is in far excess of the size and height limitation permitted for off-premise commercial advertising signs and as proposed would contribute to an unattractive environment (blight) in the surrounding industrial area. 2. Variance Application No. 93-008 is hereby denied. ADOPTED this 21st day of March , 1994.
