HomeMy WebLinkAbout94-021 - Final Environmental Impact Report for the North Harbor Specific Plan361 RESOLUTION NO. 94- 021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA CERTIFYING A FINAL ENVIRONMENTAL IMPACT REPORT FOR THE NORTH HARBOR SPECIFIC PLAN, MAKING CERTAIN FINDING WITH REGARD TO THE ENVIRONMENTAL EFFECTS OF THAT PROJECT, AND ADOPTING A MITIGATION MONITORING PROGRAM FOR THAT PROJECT. REL :5/9/94. WHEREAS, the Executive Director of the Planning and Building Agency has prepared and submitted to the City Council a proposed specific plan (as defined in sections 65451 and 65452 of the Government Code of the State of California) for a portion of Harbor Boulevard and its environs, entitled the "North Harbor Specific Plan," and recommends the amendment by the City Council of the general plan and zoning district amendments of the City of Santa Ana as necessary to adopt the said North Harbor Specific Plan; and WHEREAS, an environmental impact report (consisting of a document entitled "North Harbor Boulevard Specific Plan Draft Environment Impact Report" dated August 11, 1992, a second document entitled "Response to Comments Environmental Impact Report (SCH No. 90010334) North Harbor Boulevard Specific Plan," dated October 19, 1992), and a third document entitled "Final Addendum, North Harbor Boulevard Specific Plan Environmental Impact Report," dated May 6, 1994) (the "E.I.R.) has been prepared for the North Harbor Specific Plan and the attendant general plan and zoning district amendments; and WHEREAS, the Planning Commission, after duly noticed public hearing on April 11, 1994, recommended in favor of the adoption of the proposed North Harbor Specific Plan and the attendant general plan and zoning district amendments, and likewise recommended certification by the Council of the E.I.R.; and WHEREAS, the California Environmental Quality Act and the State CEQA Guidelines require that, prior to any approval of the Project, the city Council must make certain certifications and findings; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The city council hereby certifies that the E.I.R. has been completed in compliance with the California Environmental Quality Act, and that the E.I.R. has been presented to the City Council, and that the City Council has reviewed and considered the information contained in the E.I.R. prior to approving the Project. RESOLUTION 94-021 EXHIBIT A CALIFORNIA ENVIRONMENTAL QUALITY ACT STATEMENT OF FINDINGS AND FACTS FOR THE NORTH HARBOR BoUL~iaRD SPECIFIC PLAN GENERAL PLAN~MENDMENT AND ZONE CHAN~E 365 I. INTRODUCTION The California Environmental Quality Act (CEQA) and the State CEQA Guidelinee (Guidelines) provide that: "No public agency shall approve or carry out a project for which an Environmental Impact Report (EIR) has been completed and which identifies one or more significant environmental effects of the project unless the public agency makes one or more written findings for each of those significant effects, accompanied by a brief explanation of the rationale for each finding." (CEQA Guidelines Section 15091) The EIR for the North Harbor Boulevard Specific Plan identified significant effects which may occur as a result of the proposed Plan. In accordance with the Guidelines, the City of Santa Aha hereby adopts the findings in this report as part of the approval of the North Harbor Boulevard Specific Plan. The City of Santa Ana has prepared an EIR for the proposed Specific Plan in accordance with CEQA and the requirements of the State Guidelinee. As mandated by legislation in the State of California, the EIR was subject to review and approval by the City of Santa Ana City Council. At a public meeting held on May 16, 1994, the EIR was certified by the City Council as adequate, in compliance with the provisions of CEQA. In adopting this Statement of Findings and Facts, the City of Santa Ana City Council approves the implementation of the North Harbor Boulevard Specific Plan. The certification entails approval by the City Council of various planning documents, or changes to documents or ordinances pursuant to the approved plan. These documents and changes include a General Plan Amendment to the General Plan Land Use Map and a zone change. Any future redevelopment projects, subsequent maps, grading permits or building permits will also be reviewed based on the documentation in the EIR. The City of Santa Ana has developed a Mitigation Monitoring Program to monitor and report the implementation of the mitigation measures identified for the Specific Plan as part of the environmental review process. II. DESCRIPTION OF THE APPROVED SPECIFIC PLAN In order to optimize the evaluation of the Specific Plan, the study area for the Specific Plan encompasses approximately 1,000 acres, 366 ssonu o 4-o 1 ' an area larger than the Specific Plan area. The study area is located in the northwest portion of the City of Santa Ana and is bounded by Westminster Avenue to the north, the northern Fountain Valley City limit to the south, Newhope Street to the west and the Santa Ana River to the east. The Specific Plan area encompasses a smaller portion of the study area and is 424.6 acres. The plan area includes parcels along Harbor Boulevard in the north/south direction, along Fifth and First Street in the east/west direction and along the Pacific Electric right-of-way, between Westminster Avenue and Fountain Valley City limits. The primary goal of the Specific Plan is to establish land use and development controls that would enhance the economic viability and residential character of the various sub-areas encompassed by the Redevelopment Plan. The objectives of the Plan are to achieve visual and design control of future redevelopment; enhance the economic viability of the area, expanding its role as a significant regional commercial district; eliminate blighting conditions; improve the quality of life in residential neighborhoods; achieve visual consistency throughout the project area by the use of design g~idelines and development standards;, improve vehicular and pedestrian circulation; and to provide adeqllate infrastructure to support proposed land uses. The North Harbor Boulevard Specific Plan contains the following components: Land use concept plan, land use standards, design standards, circulation improvements, and implementation mechanisms. No site specific redevelopment proposals are being considered at this time. The General Plan Land Use Map shall be amended by Resolution to assist in the success of the Specific Plan. This would make the zoning and land use proposals consistent with the General Plan. The City Zoning Ordinance must be amended by Ordinance to ensure conformance between the General Plan and the Zoning Ordinance. The entire Specific Plan area will be rezoned to SP-2 (Specific Plan NO. 2) which would regulate the proposed Specific Plan. ALTERNATIVES TO THE PROPOSED PLaN Three alternatives to the proposed plan were evaluated in the EIR. These alternatives included the No Project/No Development, Implement General Plan with Upgrades to Public Facilities and Aesthetic Improvements, and the Long Range Concept - More Intense Commercial and Office Development Alternatives. NO PROJECT/NO DEVELOPMENT ALTERNATIVE The No Project/No Development Alternative assumes the continuation R SOLUT ON 94-02 38 ? of existing conditions without any signficant changes to land uses and activities in the plan area and no future redevelopment. IMPLEMENT THE GENERAL PLAN WITH UPGRADES TO PUBLIC FACILITIES AND AESTHETIC IMPROVEMENTS ALTERNATIVE Under the Implement General Plan with Upgrades to Public Facilities and Aesthetic Improvements Alternative, existing General Plan land use and circulation policies would be implemented; Harbor Boulevard would be devoted primarily to general strip commercial development. Improvements to the internal circulation system as identified in the General Plan would be implemented including various street widenings and intersection improvements. Virtually all improvements to the plan area would occur in existing public street rights-of-way and in required setbacks for commercial and residential properties along Harbor Boulevard, First Street, and Westminster Avenue. Any land use changes would be sponsored soley by private parties and would be consistent with the General Plan. This alternative aims at achieving a strongly upgraded and unified visual image. LONG RANGE CONCEPT - MORE INTENSE COMMERCIAL AND OFFICE DEVELOPMENT ALTERNATIVE This alternative involves the creation of a large commercial office center based around the potential SR57/Orange County Light Railway interchange in the area north of Fifth Street. Office development with related residential areas would capitalize on Willowick Golf Course. The rest of the plan area would remain local in character with the remainder of North Harbor Boulevard providing local commercial and hard goods services. IV. FINDINGS OF F~CT The City of Santa Ana City Council has reviewed the Final EIR for the proposed North Harbor Boulevard Specific Plan and has considered the public record on the Plan. The public record for the Plan is composed of the following elements: City of Santa Ana Planning Commision public hearing held on September 14, 1992. Draft North Harbor Boulevard Specific Plan EIR and Technical Appendices (City of Santa Ana, August 11, 1992). Response to Comments Received on the Draft North Harbor Boulevard Specific Plan EIR (city of Santa Ana, October 19, 1992). 388 RESOLUT O 94-02 Record of the city of Santa Ana Planning Commission public hearing held on April 11, i994. Record of the City of Santa Ana City Council public hearing held on May 16, 1994 There are three possible findings under CEQA with respect to the significant effects of a project: Findina 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Findina 2: Such changes or alterations are within the responsibility or jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such other agency or can and should be adopted by such other agency. Findinq 3: Specific economic, social or other considerations make infeasible the mitigation measures or project alternatives identified in the EIR. After reviewing the Final EIR and the public record on the Plan, the City of Santa Ana hereby makes the findings in Sections V, VI and VII, regarding the significant effects of the proposed North Harbor Boulevard Specific Plan, pursuant to Section 15091 of the State CEQA Guidelines. RESOLUTION 94-021 38 ~ Vo EFFECTS DETERmiNED TO BE H~T~G~T~BLE TO ~ LEVEL OF ~N~I~N~FIC~CE AIR QUALITY Significant Effect Plan implementation would create short term construction dust and emissions. Findinq Findinq 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in support of the Findina The short term construction related air quality impacts would be mitigated to a level of insignificance through the implementation of the following mitigation measures: Prior to submittal of applications for grading permits, future applications shall submit a report to the Planning and Building Agency and Public Works Agency, demonstrating compliance with City policies and conditions regarding local adherence to SouthCoast Air Quality Management District Rules 402 and 403. Construction equipment shall be fitted with the most modern emission control devices and be kept in proper tune to minimize emissions. This measure shall be monitored by the contractor and is subject to periodic inspection by City staff. SOILS AND GEOLOGY Sianificant Effect Construction activites associated with Plan implementation would result in exposed soils which could increase wind and water erosion. Findin~ Findin~ 1: Changes or alterations have been required in, or incorporated into, the project which avoid or ~ubstantially lessen the significant environmental effect identified in the Final EIR. 5 RESOLUTION 94-021 Facts in Support of the Findin~ Implementation of the following mitigation measure, which has been incorporated into the proposed Plan, will substantially reduce erosion effects to a level of insignificance. Prior to any site preparation, the applicant shall obtain a grading permit from the Building Agency and the Public Works Agency in accordance with applicable ordinances of the City. Significant Effect The Plan area may be subject to ground shaking in the event of seismic activity along regular fault zones. Finding Finding i: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SumDort of the Findinq Implementation of the following mitigation measure, which has been incorporated into the proposed Plan, will substantially reduce ground shaking effects to a level of insignificance. In order to ensure maximum structural safety in the event of an earthquake, all structures shall be constructed in accordance with the seismic requirements of the Uniform Building Code, subject to the review of the Building Agency. Significant Effect Sandy soils with high groundwater may result in liquefaction and subsidence during a severe earthquake. Finding Finding 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in Support of the Findinq Implementation of the following mitigation measure, which has been incorporated into the proposed Plan, will substantially reduce liquefaction and subsidence effects to a level of insignificance. 1. The Planning and Building Agency shall require the preparation 6 of geotechnical studies within those identified areas that are susceptible to subsidence and liquefaction. Sianificant Effect The Plan area may contain contaminated soils due to former commercial and industrial uses. Findina Findinq 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SuDport of the Finding Implementation of the following mitigation measure, which has been incorporated into the proposed Plan, will substantially reduce contaminated soils effects to a level of insignificance. The Planning and Building Agency shall review all projects proposed on industrial areas on a proposal-by-proposal basis and shall require affected applicants to submit soils studies to the City. In the event contamination exists, the site will be subject to appropriate Federal, State and local remediation and removal procedures. Significant Effect Cumulatively, the Specific Plan will increase exposure of Dopulations to seismic hazards in the Southern California region. Finding Findin~ 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in support of the Findin~ Implementation of the following mitigation measure, which has been incorporated into the proposed Plan, will substantially reduce earthquake effects to a level of insignificance. SiGnificant Effect In order to ensure maximum structural safety in the event of an earthquake, all structures shall be constructed in accordance with the seismic requirements of the Uniform Building Code, subject to the review of the Building Agency. 37Z RESOLUTION 94-021 HYDROLOGY Sianificant Effect New development pursuant to the Specific Plan would be subject to flooding in the event of a lO0-year storm without adequate mitigation measures since the plan area is located within the 100- year flood plain. Findina Findin~ 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SUPPort of the Findina Implementation of the following mitigation measures, which have been incorporated into the proposed Plan, will substantially reduce flooding effects to a level of insignificance. Risks resulting from flooding would be reduced to acceptable levels because all new structures would be required to meet flood plain management requirements. In conjunction with the submittal of applications for grading permits, future applicants shall submit to the City Public Works Agency, detailed drainage studies showing that the future grading, in conjunction with the drainage conveyance systems, would allow future building pads to be safe from inundation from the 100-year flood. In conformance with current City policy, buildings within the flood zones shall be required to meet flood plain standards. Sianificant Effect Larger volumes of urban pollutants including rubber hydrocarbons, and metal particles from vehicle operations would enter drainage areas. Findin~ Findin~ 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. 8 RESOLUTION 94-021 3?3 Facts in Support of the Finding Implementation of the following mitigation measure, which has been incorporated into the proposed Plan, will substantially reduce urban pollutant effects to a level of insignificance. Prior to issuance of grading permits, if surface water is collected anywhere for discharge as a point source, or if a point source discharge is contemplated, the applicant shall obtain an Elimination System Permit (NPDES) from the Regional Water Quality Board. SiGnificant Effect The Specific Plan in conjunction with other development pursuant to the General Plan would cumulatively place demands on the City's storm drain system. Finding Finding l: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SUPPort of the Findin~ Implementation of the following mitigation measures, which have been incorporated into the proposed Plan, will substantially reduce cumulative effects on the City's storm drain system to a level of insignificance. Risks resulting from flooding would be reduced to acceptable levels because all new structures would be required to meet flood plain management requirements. In conjunction with the submittal of applications for grading permits, future applicants shall submit to the City Public Works Agency, detailed drainage studies showing that the future grading, in conjunction with the drainage conveyance systems, would allow future building pads to be safe from inundation from the 100-year flood. In conformance with current City policy, buildings within the flood zones shall be required to meet flood plain standards. TRAFFIC AND CIRCULATION SiGnificant Effect The Specific Plan increases traffic by 1,446 trips or fourteen percent more than the General Plan. 9 374 RESOLUTION 94-021 Findina Findina 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in Su~Dort of the Findinq The following mitigation measures have been incorporated in the proposed Plan to reduce the traffic impacts generated by the Plan to a level of insignificance. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to provide those City-wide circulation improvements that are proposed in the Specific Plan, General Plan, and any other City circulation improvement plans. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to monitor those circulation improvements that are proposed in other neighboring jurisdictions which may benefit the Specific Plan and shall provide input at appropriate times to ensure implementation of those improvements. The City shall review all future proposals within the Specific Plan area on a project-by-project basis and shall impose appropriate conditions and mitigation to ensure that any circulation impact would be alleviated to the extent feasible. Sianificant Effect The following intersections will operate at LOS E or LOS F upon implementation of the Plan: Fairview at 17th Street, Harbor Boulevard at Trask Avenue, Newhope Street at Westminster Avenue, and Newhope Street at First Street. Findina Findinq l: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SumDort of the Findina The following mitigation measures have been incorporated in the proposed Plan to reduce the traffic impacts generated by the Plan to a level of insignificance except for the intersection of Fairview at 17th Street which will operate at LOS E after 10 RESOLUTION 94-021 375 improvements called for in the Santa Ana General Plan and additional improvements called for in the specific plan are implemented. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to provide those City-wide circulation improvements that are proposed in the Specific Plan, General Plan, and any other City circulation improvement plans. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to monitor those circulation improvements that are proposed in other neighboring jurisdictions which may benefit the Specific Plan and shall provide input at appropriate times to ensure implementation of those improvements. The City shall review all future proposals within the Specific Plan area on a project-by-project basis and shall impose appropriate conditions and mitigation to ensure that any circulation impact would be alleviated to the extent feasible. Significant Effect The Specific Plan would affect bus transit, transportation systems, circulation movements, patterns, and parking. Findin~ Findin~ 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in Support of the Findin~ The following mitigation measures have been incorporated in the proposed Plan to reduce the traffic impacts generated by the Plan to a level of insignificance. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to provide those city-wide circulation improvements that are proposed in the Specific Plan, General Plan, and any other City circulation improvement plans. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to monitor those circulation improvements that are proposed in other neighboring jurisdictions which may benefit the Specific Plan and shall provide input at appropriate times to ensure 11 RESOLUTION 94-021 implementation of those improvements. The City shall review all future proposals within the Specific Plan area on a project-by-project basis and shall impose appropriate conditions and mitigation to ensure that any circulation impact would be alleviated to the extent feasible. NOISE Sianificant Effect Implementation of the Plan would create disturbances due to construction activities. temporary noise Finding Findinq 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SUPPort of the Findina The following mitigation measures have been incorporated in the proposed Plan to reduce the construction noise impacts generated by the Plan to a level of insignificance. Construction near residential development shall be limited to the hours of 7:00 a.m. to 7:00 p.m. on Monday through Friday. Construction on weekends shall only be allowed on a case by case basis after authorization has been given by the City to the contractor. 2e To the extent feasible, construction activities shall be screened from adjacent noise-sensitive land uses with fencing. Ail construction equipment, fixed or mobile, operated within 1,000 feet of a dwelling unit shall be equipped with properly operating and maintained muffler exhaust systems. Stationary equipment shall be placed such that emitted noise is directed away from sensitive noise receivers such as residential areas. Se Stockpiling and vehicle staging areas shall be located as far as practical from occupied dwellings. 12 RESOLUTION 94-021 377 LAND USE Sianificant Effect Construction of future proposals and improvements would create disturbances and some land use incompatibilities. Findina 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in support of the Findinq The following mitigation measures have been incorporated in the proposed Plan to reduce the disturbances and land use incompatibilities generated by the Plan to a level of insignificance. The City shall review all future land use proposals and circulation improvements on a pro~ect-by-project basis to ensure that proposals would be designed, developed, and constructed in accordance with standards and requirements of the North Harbor Boulevard Specific Plan and the Zoning Ordinance and all other appropriate laws and regulations. Additionally, the City shall establish design, development, and construction requirements, as appropriate, to ensure that land use incompatibilities and potential construction-related disturbances would be alleviated to the greatest extent possible. Prior to construction, proponents of future redevelopment and construction within the Specific Plan area shall acquire all required permits, including demolition, grading, and building permits. SiGnificant Effect The plan would implement objectives and recommendations of the City's General Plan, North Harbor Boulevard Redevelopment Plan and Strategy Plan and Santa Anita Neighborhood Plan. However, the Specific Plan would require an amendment to the City's General Plan and Zoning Ordinance. Finding ~ndinG 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. 13 RESOLUTION 94-021 Facts in SuDport of the Findina The following mitigation measure has been incorporated in the proposed Plan to reduce the land use impact generated by the General Plan Amendment and zone change to a level of insignificance. The Planning and Building Agency shall amend the City's General Plan and Zoning Ordinance to SP-2 (Specific Plan No. 2), prior to implementing any portion of the North Harbor Boulevard Specific Plan. LIGHT AND GLARE Sianificant Effect The levels of light and glare emitted in the plan and study areas would be similar between existing conditions and after ultimate plan implementation. PUBLIC SERVICES AND UTILITIES Police Services Sianificant Effect With an increase in commercial and residential density, demand for police services will increase. Facts in supDort of the Findina The following mitigation measure has been incorporated in the proposed Plan to reduce the police service~impacts generated by the Plan to a level of insignificance. Since increased development may result in an increase in emergency and non-emergency police calls, the following mitigation measures shall be implemented for new development: a) Ail commercial and industrial structures shall be designed with adequate police patrol and emergency vehicle access from all sides. b) Lighting design in and around individual commercial, residential and industrial developments shall facilitate visibility into the site by patrol vehicles and emergency response vehicles. ¢) Ail new structures and parking lots shall comply with the provisions of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Code (Building Security Ordinance). Schools significant Effect Public schools will have approximately 246 new students. Ail development under State law and Garden Grove Unified School District policy, shall be required to pay school impact fees prior to the issuance of building permits% These fees shall be used to provide classroom facilities for the additional students. Water Sianificant Effect Water mains will have to be upgraded or replaced. Facts in SUPPort of the Findin~ The following mitigation measures have been incorporated in the proposed Plan to reduce water impacts generated by the Plan to a level of insignificance. Water conservation devices shall be installed in all new or rehabilitated commercial, industrial or residential structures. Efficient irrigation systems which minimize runoff and evaporation shall be required to the greatest extent feasible. Future applicants shall provide for the use of reclaimed water on all irrigated areas where supply is available, subject to review and approval by the City Engineer. Sewer Sianificant Effect It is anticipated that substantial upsizing of certain sewer mains in this area will be needed to accommodate additional development 16 RESOLUT O 94-02 381 in this area and from adjacent cities. Finding Finding 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in SUPPort of the Finding The following mitigation measures have been incorporated in the proposed Plan to reduce sewer service impacts generated by the Plan to a level of insignificance. Ail appropriate requirements of the County Sanitation District and the City of Santa Ana shall be adhered to in the design and construction of individual developments and provisions of sewer facilities. Prior to issuance of building permits, all future applicants shall pay a connection charge to the 0CSD for the construction of necessary capital facilities. Solid Waste SiGnificant Effect Solid waste will increase 14.8 tons per day and decrease landfill capacity. Finding Findina 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in Support of the Finding The following mitigation measures have been incorporated in the proposed Plan to reduce solid waste impacts generated by the Plan to a level of insignificance. Ail new or redeveloped residential, commercial and industrial structures shall be designed to provide adequate space for recycling receptacles. Appropriate provisions contained in the Source Reduction and Recycling Element shall be implemented upon its adoption. 17 382 RESOLUTION 94-021 VI. SIGNIFICANT ENVIRONMENTAL EFFECTS WHICH CANNOT BE AVOIDED IF THE PLAN IS IMPLEMENTED AIR QUALITY Sianificant Effect Implementation of the proposed Plan would increase mobile and stationary source emissions by 21 percent compared to existing conditions; increase emissions as a result of increasing vehicle miles traveled by 16.3 percent compared to existing conditions; contribute to regionally significant Carbon Monoxide and Nitrogen Oxide emissions; and contribute to the degradation of cumulative local and regional air quality in conjunction with other development pursuant to the Santa Aha General Plan. Findina Findin~ 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in Support of the Findinq The following mitigation measures have been incorporated in the proposed Plan to reduce the long term mobile and stationary air quality emissions generated by traffic and electrical and natural gas utilities associated with the Plan: Stationary source emissions shall be reduced through energy efficient design practices as required by Title 24 of the State Administrative Code. The City shall review future proposals on a project-by-project basis to ensure compliance. Employers of more than 100 persons, or individual developments that could be expected to have more than 100 persons employed upon completion, are required to devise and implement transportation demand reduction measures in accordance with the South Coast Air Quality Management District' Regulation XV and the City of Santa Ana's Transportation Demand Management Ordinance. Bus turnouts and shelters that conform to the standards of the Orange County Transit District shall be provided in accordance with Section 8.4.3 of the North Harbor Specific Plan. At a minimum, shelters shall be located at the intersections of Harbor Boulevard and Westminster Avenue, First Street, McFadden Avenue, and Edinger Avenue. Even with these mitigation measures, the contribution of the Plan to long term regional air quality emissions cannot be mitigated to 18 sonu oN 4-o 1 383 a level of insignificance. TRAFFIC AND CIRCULATION Sianificant Effect Implementation of the Specific Plan would increase traffic impacts at the intersection of Fairview at Seventeenth Street. Mitigation measures will only improve levels of service from F to E which is still unacceptable. Findina Findina 1: Changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effect identified in the Final EIR. Facts in Support of the Findina The following mitigation measures have been incorporated in the proposed Plan to reduce the traffic impacts generated by the Plan. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to provide those City-wide circulation improvements that are proposed in the Specific Plan, General Plan, and any other City circulation improvement plans. Throughout implementation of the Specific Plan, the City's Public Works Agency shall continue to monitor those circulation improvements that are proposed in other neighboring jurisdictions which may benefit the Specific Plan and shall provide input at appropriate times to ensure implementation of those improvements. The City shall review all future proposals within the Specific Plan area on a project-by-project basis and shall impose appropriate conditions and mitigation to ensure that any circulation impact would be alleviated to the extent feasible. Even after implementation of these mitigation measures, the peak hour level of service at Fairview at Seventeenth Street cannot be mitigated to a level of insignificance. Areas where this measure would be most beneficial include residential units located behind lots that are inadequate for building development and may be developed as linear parks. Where structures providing a sound barrier are removed and new barriers cannot be constructed because of site design considerations, sound insulation for future residential structures shall be provided to meet the interior noise levels of the California State Sound Insulation Standards. Ensure that not less than 30 percent of all dwellings constructed or rehabilitated with the assistance of Agency funds shall be set aside for low and moderate income households pursuant to State law. Provide assistance to households displaced as a direct result of Agency actions, including financial participation in development projects. Assistance shall be consistent with State law and shall, at a minimum, include the payment of fair market prices for all units, the payment of relocation costs, and the payment of any cost differences between the displaced unit and comparable replacementhousing. Replace all low and moderate income units that are displaced as a result of Agency actions as required by State law. Ensure that businesses displaced asa result of Agency action shall be provided with relocation benefits in accordance with State law. This may include fair market value for the land and the business, relocation assistance, and loss of business due to any move. Property owners also shall be offered the opportunity of participating in the redevelopment project area. VII. MITIOATION MEASURES FOR IMPACTS CONSIDERED TO BE LESS TH~N SIGNIFICANT This section describes mitigation measures for those effects of the proposed Plan which are considered to be less than significant and that, therefore, are not required under CEQA. However, these measures improve the Plan and are acceptable under CEQA. Findings are not required for effects determined to be less than significant. The impact categories determined to be less than significant and the mitigation measures incorporated in the Plan are described below. 23 RESOLUTION 94-021 AESTHETICS The Plan would improve the overall aesthetic and visual quality of the Plan area. Cumulatively, the Plan would visually improve major City corridors, thus improving the overall image of the City of Santa Ana. The following mitigation measure will ensure high quality development design. The Planning and Building Agency shall review all future proposals on a project-by-project basis and ensure that said proposal is in conformance with the performance, development, design and use, landscape design and architectural treatment guidelines and standards contained in the Specific Plan and the Zoning Ordinance, which relates to submission of development plans and architectural review, to ensure high- quality development design. CULTURAL RESOURCES Though no known historic structures are presently located in the Plan area, there is the possibility that some could be listed in the future. Plan implementation would not result in adverse plan- specific or cumulative impacts to cultural resources. However, the mitigation measure is recommended to ensure that structures and buildings of potential historic significance would be preserved in the future. Throughout implementation of the Specific Plan, the cityshall continue to evaluate the prehistoric and historic significance of structures and buildings to be affected by proposed redevelopment. If any structure or building is determined to have potential prehistoric or historic significance, the City shall consider placing the structure or building on a historical list or register. VIII. ALTERNATIVES TO THEPROPOSED PLaN CEQA Guidelines Section 15126(d) requires a discussion of reasonable alternatives to the proposed Plan. The EIR evaluated three alternatives to the proposed North Harbor Boulevard Specific Plan. It should be noted that other more or less intensive alternatives were not considered or evaluated because of their inconsistency with the intent of the General Plan and/or because of their inconsistency with other City policies. For example, alternatives that would include the extensive construction of new housing units along Harbor Boulevard were not considered because such a proposal would be inconsistent with the intent and purpose of the General Plan and other policies affecting the area. 24 RESOLUTION 94-021 389 NO PROJECT ALTERNATIVE Findina Findina 3: Specific economic, social or other considerations make infeasible the mitigation measures or project alternatives identified in the EIR. Facts in SUPPort of the Findin~ Given that the Plan area is presently urbanized and developed, this alternative would not eliminate many of the environmental impacts to be experienced with the Specific Plan. In actuality, the area is presently blighted and in need of those improvements being proposed by the Specific Plan. This alternative would result in similar impacts to air quality, traffic generated noise, light and glare, public services and utilities, population, housing and employment, and cultural resources. This alternative would avoid construction noise and air quality impacts. No displacement impacts would result from this alternative. However, blighting conditions such as incompatible land uses, inadequately sized lots, and poor lotting patterns would continue in the Plan area, thereby, reducing the area's economic productivity. In addition, the expected improvements resulting from the Specific Plan would not occur under this alternative. These benefits include increasing structural safety, upgrading storm drains, street widening, median installation and intersection improvements, and landscaping and other visual quality-related improvements. Residential land uses that are not in conformance with existing zoning or General Plan standards would continue. This alternative would not comply with or implement the recommendations found in the North Harbor Boulevard Redvelopment Plan and Strategy Plan and the Santa Anita Neighborhood Plan, which the Specific Plan would comply with. IMPLEMENT GENERAL PLAN WITH UPGRADES TO PUBLIC FACILITIES AND AESTHETIC IMPROVEMENTS ALTERNATIVE Findinq Findinq 3: Specific economic, social or other considerations make infeasible the mitigation measures or project alternatives identified in the EIR. Facts in SUPPort of the Findin~ This alternative was considered throughout the process and was reviewed at one public meeting and by the Redevelopment Commission and the Planning Commission. At that time, it was referred to as 25 390 RESOLUTZON 94-021 option 1 - Beautification. Under this alternative, existing General Plan land use and circulation policies would be implemented; Harbor Boulevard would be devoted primarily to general strip commercial development. Improvements to the internal circulation system as identified in the General Plan would be implemented including various street widenings and intersection improvements. Circulation improvements identified in the General Plan are incorporated by reference. Additionally, this alternative would propose the following visual improvements: Introduction of strong avenue tree planting; landscaping of central medians with trees shrubs and grass; improvements to all major intersections by the introduction of special paving, feature tree planting and additional landscaping along property frontages; landscaping and boundary improvements to vacant lot frontages; landscaping of wide property setbacks; and entry monuments and other features to identify the area. Impacts to the following would be similar to the proposed Specific Plan: Air quality, soils and geology, hydrology and drainage, traffic and circulation, noise, land use, aesthetics, light and glare, public services and utilities, population, housing and employment, and cultural resources. Traffic demand control measures, however, would be more easily implemented under the proposed Specific Plan than under this alternative because the proposed Plan encourages larger scale developments than would be anticipated under the General Plan. It should be noted that the General Plan does not allow residential development along Harbor Boulevard, while the proposed Specific Plan does. Therefore, the potential for adverse noise impacts is decreased with this alternative decreases with this alternative due to the location of these sensitive receptors. While this alternative would significantly improve conditions over those presently existing on the site, fragmented parcelization patterns and cluttering of unrelated and incompatible land uses would continue. The beneficial impacts resulting from this alternative would be less than the proposed Plan. LONG RANGE CONCEPT - MORE INTENSE COMMERCIAL AND OFFICE DEVELOPMENT ALTERNATIVE As with the previous alternative, this alternative was a concept prepared and reviewed during the preparation of the Specific Plan. Unlike the previous alternative, however, this was included in the Specific Plan as the Long Range Concept (Section 4.5 of the Specific Plan). Note that this concept is not the project itself, 26 RESOLUTION 94-021 391 but is presented in the Specific~[~n as a possible response to future regional circulation improvements and the intensification pressures that could result in the Plan area. Discussions of the Long Range Concept contained in the Specific Plan is incorporated by reference. Finding Finding 3: Specific economic, social or other considerations make infeasible the mitigation measures or project alternatives identified in the EIR. Facts in SupDort of the Findinq It should be noted that this alternative may be infeasible since it assumes the extension of the SR-57 freeway south along the Santa Ana River from its current terminus and the construction of a rail mass transit along the existing Pacific Electric right-of-way. Without these two transportation corridors, it is unlikely that the alternative could be implemented. Impacts resulting from this alternative would be greater than the proposed Plan in the following areas due.to increased intensities in commercial and office development: Air quality, soils and geology, hydrology and drainage, traffic and circulation, noise, public services and utilities. Similar impacts resulting from this alternative include aesthetics, light and glare, population, housing and employment, and cultural resources. This alternative would have less impacts onsite and on surrounding land uses, since less area would be affected. Resultant displacement of businesses would also be less, though a large number of existing residential units would be displaced north of Fifth Street between Harbor Boulevard and the Santa Ana River. This alternative would not comply with and implement all recommendations found in the North Harbor Boulevard Redevelopment Plan and Strategy Plan and Santa Anita Neighborhood Plan. 27 392 RESOLUTION 94-021 EXHIBIT B STATEMENT OF OVERRIDING CONSIDERATIONS NORTH HARBOR BOULEVARD SPECIFIC PLAN CITY OF SANTA ANA The California Environmental Quality Act (CEQA) requires a public agency to balance the benefits of a proposed project against its unavoidable environmental risks in determining whether to approve the project. The proposed North Harbor Boulevard Specific Plan provides standards for land use, circulation, public services, general design, architecture, and landscaping· A land use plan of permitted redevelopment is also included in the Specific Plan. The Specific Plan may have significant or certain substantial adverse impacts on the environment which have not been fully mitigated. Such impacts are identified in the Final EIR and are addressed in Findings and Statements of Fact which accompany this Statement of Overriding Considerations. Impacts in all cases have been mitigated to the extent considered, feasible and have been reduced by the incorporation of all mitigation measures as Conditions of Plan Approval. The City of Santa Ana has determined that the unavoidable environmental impacts of the proposed plan are acceptable when balanced against the benefits of the plan. The following benefits are found to outweigh and make acceptable the unavoidable adverse impacts identified in the Final EIR: Plan implementation fulfills the adopted land use goals and policies of the city of Santa Aha, allowing for residential, commercial, industrial, and open space uses of a character and intensity consistent with the intent of the General Plan. 2 o Plan implementation achieves visual and design control of future development and redevelopment and achieves visual consistency throughout the plan area by the use of design guidelines and development standards. Plan implementation improves the quality of life in residential neighborhoods. Plan implementation eliminates blighting conditions and enhances the economic viability of the area, by expanding its role as a significant regional commercial district. o Plan implementation represents a continuance of existing development patterns where adequate facilities and services are available or will be provided with plan implementation. 1 RESOLUTION 94-021 393 6o Plan implementation directly ~provides temporary employment opportunities in construction and permanent opportunities in a variety of fields. It will also indirectly generate "spin- off" economic benefits to existing local businesses and services from new employees. Plan implementation generates additional property tax and other revenues to the City of Santa Ana and will contribute various fees for services and improvements required to provide for development and redevelopment. Specific economic, social, or other considerations make infeasible those mitigation measures not identified in the Final EIR and/or project alternatives identified in the Final EIR. 394 RESOLUTION 94-021 EXHIBIT C MITIGATION MONITORING PROGRAM NORTH H~RBOR BOULEVARD SPECIFIC PLAN CITY OF SANTA ANA Effective January 1, 1989, the California Environmental Quality Act was amended to add Section 21081.6, implementing Assembly Bill (AB) 3180. As part of CEQA environmental review procedures, AB 3180 requires a public agency to adopt a monitoring and reporting program for assessing and ensuring efficiency of any required mitigation measures applied to proposed developments. As stated in Section 21081.6 of the Public Resources Code: "...the public agency shall adopt a reporting or monitoring program for the changes to the project which it has adopted, or made a condition or project approval, in order to mitigate or avoid significant affects on the environment." Section 21081.6 provides general guidelines for implementing monitoring and reporting programs. Specific reporting and/or monitoring requirements, to be enforced during project implementation, shall be defined prior to final approval of the project proposal by the responsible decision maker(s). In response to established CEQA requirements and those of Public Resources Code Section 21000 et seq., the proposed mitigation monitoring program shall be submitted for consideration prior to completion of the environmental review process to enable the decision maker's appropriate response to proposals. The mitigation monitoring program must be provided as part of the Final EIR. The mitigation monitoring program is presented in this section. Each recommended mitigation measure is listed and categorized by impact topic, with an accompanying discussion of: The party responsible for implementation of mitigation measure. The phase of the project during which the measure should be monitored. The method of verifying compliance with mitigation measure. The agency responsible for monitoring compliance with mitigation measure. The monitoring agencies shall oversee elements of the mitigation monitoring program (MMP) and review compliance through the use of compliance verification forms to be developed by the City and supported by a mitigation monitoring consultant. A sample of a "Compliance Verification" form is provided in .Attachment A. Designated monitors shall ensure compliance verification forms are filled out correctly and proper action is being taken on each RESOLUT O 94-02 295 measure. Designated monitors will also be responsible for filing and updating the verification forms during all phases of the project. During design and construction phases, the designated monitors from the Planning and Building Agency will determine the need for a measure to be modified and ensure the use of a mitigation specialist if technical expertise beyond the monitor's ability is required. If it is found that an adopted mitigation measure is not being properly implemented, the designated monitors shall require corrective actions to ensure adequate implementation.
