City Council met in adjourned regular session, ordered by ~he Council at its regular meeting of September h, 1962. The Assistant Clerk of the Council reported that the Order of Adjournment was properly posted~ evidence thereof being on file in the office of the Clerk. Meeting called to order by the M~yor. Present: Councilmen: Royal E. Hubbard~ Henry H. Schlueter, James Gilmore, Bob Brewer, A. A. Hall Absent: Councilmen: None The Pledge of Allegiance was given~ followed by the Invocation which was led by Rev. Delwin Thigpen, Spurgeon Methodist Church. Hearing Newport & D~,er S. E. Annex Resolutions 62-1['2 & 62-145 hearings continued Mayor Hall opened concurrent /from September 4, 1962 onResolution No. 62-122 and Resolution No. 62-145, and announced that this was the time for the Council to hear protests against the annexation by persons owning real property within the territory proposed to be annexed to the City of Santa Ana under the designated name of "New- port and Dyer S. E. Annex." Upon the Clerk's presentation of affidavits of publica- tion of Resolution No. 62-145 and affidavit of mailing written notice of this protest hearing to each person to whom land within the territory proposed to be annexed was assessed in the last Equalized Orange County Assessment Roll~ it was moved by Council. man Hubbard, seconded by Brewer and carried, that the affidavits be received and ordered filed. The Mayor then asked the Clerk if any written protests against the annexation started by Resolution No. 62-145 had been received. The Clerk presented protest letters from the following: The Irvine Ranch Water District, signed by W. F. Graves, President; The Irvine Company~ signed by Charles S. Thomas, President; Walter il J. Pollard, property owner in the territory; and Department of Public Works, signed by Robert Bradford, Director. On motion of Councilman Hubbard, seconded by Brewer and carried, the written protests were received and referred to the Director of Public Works and the Assistant to the City Manager for report. On motion of CounciLman Hubbard, seconded by Brewer and carried~ an Order was adopted that the hearings provided for by Resolutions 62-122 and 62-145 be held con- currently for the sole purpose of receiving evidence concerning the proposed annexation, but that at the conclusion of such concurrent hearings~ the Council will consider each proceeding separately and will determine separately whether a majority protest has been made in either or both of said proceedings, and will determine separately whether an Ordinance of Annexation should be adopted with respect to either or both proceedings. The Clerk presented the following in favor of the annexation: letter frc~ Rose- glen Construction, Incorporated, signed by Richard Cavanaugh; letter from Schlegel & Friedmann signed by Carl G. Schlegel; telegram from Paul V. Banks of Banks Liquor Store; telegram from Tilghman A. Taylor; and telegrams from Howard Ryan and Malcolm R. Smith. It was moved by Councilman Hubbard~ seconded by Schlueter and carried, that the communications be received and filed. Louis Letson, Administrator of the Foundation that will operate the Leisure World Project, ~4~1 Rossmore Way, Los Alamitos, spoke on behalf of the annexation and out- lined part of the program planned at Leisure World, includLng ten recreation centers and a 500-bed hospital. Ken Outwater~ fr~n the Planning and Engineering Firm of Voorheis~ Trindle and Nelson~ 1~794 Beach Boulevard, Westminster, explained the land planning by use of a map. John Toups, Consulting Civil Engineer, 1629 West 17th Street~ reported on the planned water supply and sewage disposal. Russell Fowler, 1~5~2 Sandhurst Place, employed by Ross Cortese, explained the serial map of the district. Douglas Clark, 1510 N. Mar-Les Drive~ representing about two hundred citizens who have formed a committee saying "Yes" to the annexation, spoke regarding the benefits to be derived from the annexation. On motion of Councilman Hubbard, seconded by Brewer and carried, two additional telegrams received during the meeting, fr~m Carl Theep, Lancer's Restaurant, and Bill Barry~ favoring annexation, were received and filed. Glenn Mathis, 2~241 Highway lOl~ E1 Toro, owner of a portion of the Moulton Ranch adjacent to the proposed annexation, stated that he was in favor of the annexation. Karl Rodi, Attorney, 714 W. Olympic~ Los Angeles~ Attorney for owners of a portion of the Rancho Canada de Los Alisos comprising apprcx~stely ~500 acres~ stated that al- though no immediate plans for development of their land was planned, it Fas hoped that the annexation would proceed expeditiously and quickly, and that at some future date they would undoubtedly seek annexation to Santa Ana. George Wiegand, Temple City, spoke in a similar fashion regarding the 400 acres which he represented, and stated that when ready to develop the acres, annexation to Santa Ana would be sought. The Mayor asked if anyone wished to speak in opposition to the annexation~ and William French Smith came forward, presenting on behalf of The Irvine Company a volume of exhibits as follows: Statements in Opposition to Proposed Newport and Dyer, S. E. Annex to the City of Santa Ana, California, by William French Smith, et al; letter dated July 26, 1962 from William French Smith, with attachments; Affidavit by Charles S. Thomas; Affidavit by Raymond L. Curran; Statement in Opposition to the Newport- Dyer, S. E. Annexation by the City of Santa Ana, California by Raymond L. Watson, APPROVED: MAYOR OF THE CITY OF SANTA ANA Statement of William L. Pereira and Associates in Opposition to Newport-Dyer S. E. Annexation, with exhibit; Affidavit frcmWilliam H. Spurgeon, with attachments. On motion of Councilman Hubbard~ seconded by Brewer and carried, the documents were i received and filed. On request of Mr. Smith, a motion was made by Councilman Hubbard, seconded by Brewer and carried, that the remarks made by Mr. Smith at the hearing on September 4 be received and filed. Mrs. Janice Boer, 912 N. Lowell~ objected to the annexation as being harmful to property owners. On motion of Councilman Brewer, seconded by Hubbard and carried, the hearing was continued until September 17, at which time Mr. Charles Thomas, Mr. Long and Mr. W. F. Graves shall be at the meeting, bringing the minutes and any documents pertaining to the transfer of the water company and the minutes, documents and neces- sary information pertaining to the transfer on July 24. Councilman Hubbard asked if the subpenas had been served. Mr. Hurwitz, Attorney representing the City, replied that Mr. Thomas, Mr. Long and Mr. Graves had been served. It was moved by Council- man Hubbard, seconded by Schlueter and carried~ that the returns of service of the subpenas be received and filed and made a part of the record. Whereupon the hearing was continued until September 17, 1962. On motion of Councilman Hubbard, seconded by Schlueter and carried, John Lutz was appointed to fill the vacancy on the Board of Parking Place Commissioners. On motion of Councilman Hubbard, seconded by Schlueter and carried, permission was granted for a parade on September 15 between 1:00 P.M. and 4:00 P.M. by Hanna for Congress Committee.
