September 17, 1962
The meeting was called to order at 7:30 P.M. in the Council Chamber, Santa Ana City Hall, with the following
Councilmen present: Royal E. Hubbard, Henry H. Schlueter, James Gilmore, Bob Brewer, A. A. Hall. Following
the Invocation by the Reverend Robert Mays, Church of the Brethren, Mayor Hall led the Pledge of Allegiance to the
Mayor Hall announced the decision of the Council to appoint Doris M. Brown as Clerk of
the Council and thereupon administered the Oath of Office. Mayor Hall then offered the
Council's appreciation and commendation to Helen Boyd, Assistant Clerk of the Council,
and to members of the Clerk's staff for the excellent performance of duty in the ab-
sence of the Clerk.

received and ordered filed a tabulation of bids received for the furnishing of magazinesl
to the Public Library for 1963, approved award of the contract to National Publications
Company in the amount of $2,195.84, and rejected all other bids.

On motion of Councilman Brewer, seconded by Councilman Hubbard and carried, Council
received and ordered filed a tabulation of bids received for the furnishing of asphal-
tic concrete requirements for fiscal year 1962-63, approved award of the contract to
Sully-Miller Contracting Company at a unit price of $4.93 per ton for Item i and $4.43
per ton for Item 2, and rejected all other bids.
This being the date set for concurrent hearings on Resolutions No. 62-122 and 62-145
for the sole purpose of receiving evidence concerning the proposed annexation, the
Mayor opened the hearing and asked if anyone desired to be heard regarding the annexa-
tion. Samuel Hurwitz, Special Counsel for the City, 100 West Chapman Avenue, Orange,
reported that depositions were being taken from Mr. Long and Mr. Thomas, but were not
yet completed. He therefore recom~ended that the hearing be continued for two weeks,
and that all of the directors of the Irvine Ranch Water District be subpenaed. It was~
moved by Councilman Hubbard, seconded by Councilman Brewer, that the following Order be.
adopted:
"That in connection with the proceedings for the annexation of certain terri-
tory to the City of Santa Ana under and pursuant to Resolutions 62-122 and 62-145,
the Clerk of the Council is hereby authorized and directed to issue a subpena
in the name of the City of Santa Ana impelling the attendance of the following
witnesses before this City Council at its regular meeting to be held on October
l, 1962 at 7:30 p.m. in the Council Chambers in the City Hall, located at 217
North Main Street, Santa Ana, California:
W. F. Graves, A. J. McFadden, Walter J. Pollard, Max C. Hoeptner,
and Willis F. Mitchell
That in connection with said annexation proceedings, the Clerk of the Council is
hereby authorized and directed to issue subpenas in the name of the City of Santa
Ana compelling the production at the aforementioned time and place of all reso-
lutions, minutes: documents, and other papers of The Irvine Ranch Water District,
a California Water District, connected with or pertaining to the aforesaid annex-
ation proceedings, which contain evidence relevant and material to said annexa-
tion proceedings, such subpenas to be directed to the proper officers of said
company and said district having custody of the same."

Councilman Brewer made the following statement:
"I amconsiderably disturbed over the protest of the Board of Regents to this
annexation. To my knowledge, never in the entire history of this state has
such a protest because of Freeway inclusion in an annexation been made by the
Department of Public Works, an agency of the State, and this is interference
in a local annexation matter.
"However, the disturbing factor is the realization that an agency of the State,
the Board of Regents of the University of California, took this action without
ever seeking any information from the City of Santa Ana. How a public body
can hastily take such an action without considering all the evidence is of
deep concern to me.
"I believe we, as a Council, are amiss ii' we do not request an audience with
the Board of Regents to present the City's information and evidence and ex-
plain why we believe that this annexation in no way jeopardizes present or
probable future state property in or near this annexed area.
"Since it is obviously evident ~hat this annexation is onlff protested by The
Irvine Company and people they have attempted to influence, I must deduce that
the Board of Regents acted solely on evidence presented by The Irvine Company.
I regret the Board has not requested information from the City to enable us
to present the side of the story they have not heard. I move this Council
request an audience with the Board of Regents, this Thursday and Friday,
September 20 and 21, 1962, in Santa Barbara, and that the Mayor and Manager
be authorized to attend the meeting."
The motion was seconded by CounciLman Hubbard and carried. On motion of Councilman Hubbard, seconde~
by Councilman Brewer and carried, hearings on Resolutions No. 62-122 and No. 62-145 were continued
to October l, 1962 at 7:30 p.m. in the Council Chambers.
Douglas Clark, 1510 N. Mar-Les Drive, advised the Council that a citizen's committee had sent to
all Regents of the University of California a letter describing the reasons for the annexation and
how the City is cooperating with the proposed University City.

Mayor Hall opened the hearing on Amendment Application No. 406 filed by John Rohrs, requesting an
amendment of Sectional District Map 6-5-9 reclassifying property situated on the northwest corner
of 17th Street and Lincoln Avenue from the R-2 and R-1 Districts to the C-4 District. Bruce
Sumner, 1016 N. Broad~ay, spoke in behalf of the applicant. There being no further testimony, the
hearing was closed. On motion of CounciLman Hubbard, seconded by CounciLman Brewer and carried, an
Ordinance approving Amendment Application No. 406-B was passed to second reading without further
reading.
Mayor Hall opened the hearing on Amendment Application No. 407 filed by Solomon Development Corpora-
tion requesting an amendment to Sectional District Map 17-5-10 reclassifying property generally
bounded by Melric Avenue, Copper Street, Kadge Avenue, and Yawl Street from the A-1 District to
the R-1 District. Mulley Nichol, 13794 Beach Boulevard, Westminster, spoke on behalf of the appli-
cant. There being no further testimony, the hearing was closed. On motion of Councilman Hubbard,
seconded by Brewer and carried, an Ordinance approving Amendment Application No. 407-A was passed
to second reading without further reading.

The hearing was opened on Amendment Application No. 408 filed by Rinker Development Corporation
requesting an amendment of Sectional District Map 22-5-10 reclassifying part of the northeast
corner of Warner and Fairview from the C-1 District to the R-4 District. ~lley Nichol, 13794
Beach Boulevard, Westminster, spoke on behalf of the applicant. On motion of CounciLman Hubbard,
seconded by Brewer and carried, an Ordinance approving Amendment Application No. 408-A was passed
to second reading without further reading.

The hearing was opened on Amendment Application No. 409 filed by Wilfred H. Chartton
requesting an amendment of Sectional District Map 18-5-9 reclassifying property gener-
ally bounded by the Southern Pacific Railroad right of way, Grant Street, the present
street stub of Bishop, and Camile Street frc~ the M-1 District to the R-4 District.
Council heard testimony from Wilfred H. Charlton, 8811 Coast Highway, Laguna Beach~
applicant. A letter and petition signed by 14 adjacent industrial users~ expressing
approval of the rezoning~ were received and ordered filed, on motion of Councilman Hub-
bard, seconded by Councilman Schlueter and carried. There being no further testimony,
the hearing was closed. On motion of Councilman Hubbard, seconded by CounciLman
Schlueter and carried, an Ordinance approving Amendment Application No. 409-A was passel
to second reading without further reading.

Councilman Hubbard pointed out that the last adoption of a resolution determining
the prevailing wages to be paid in connection with public works and improvements
was in 1960 and that a review of such rates should be made. The Council having
before it the prevailing wage rates in the six basic trades and the subtrades and
having considered the prevailing wages paid in the City of Santa Ana, and such rates
as have been predetermined for Federal public works within the locality and having
considered their application to public works and improvements constructed in the

Mayor Hall noted that in view of the hearing duly held on Assessment District No.
218, duly reported in the minutes of the Council meeting on September 4, 1962, and
the City Council having before it a report and plat of the Assessment District, the
plans and specifications and being familiar with both. and no protests having been
filed and knowing the character and nature of the proposed work and the necessity
for the same, and having determined the public interest, convenience and necessity
require the improvement as set forth in the plans and specifications, and having
considered the matter as to the area of the property to be assessed for the said
improvement, that the City now had Jurisdiction to proceed with this matter. Mayor

Councilman Brewer nominated, seconded by Councilman Schlueter, Malcolm Smith to
serve the unexpired term of Lee Smith on the Planning Ccmmission. It was moved by
Councilman Hubbard, seconded by Councilman Schlueter and carried, that nominations
be closed and Malcolm Smith be unanimously appointed to the Planning Commission.
Royal E. Hubbard was nominated by CounciLman Brewer, seconded by Councilman Schlueter
to serve as alternate director on the Orange County Sanitation Board. It was moved
by Schlueter, seconded by Gilmore und carried, that the nominations be closed and
CounciLman Hubbard be unanimously appointed as alternate director on the Sanitation
Board.
Council received and considered a report from the City Manager relative to traffic
at the intersection of Santa Clara and Bristol, requested by Council at its September
4, 1962 meeting. On motion of CounciLman Hubbard, seconded by Councilman Brewer and
carried, petitions containing over 700 names of persons interested in the placing
of a traffic guard at Santa Clara and Bristol, were received and ordered filed.
Councilman Schlueter reported attendance at a meeting with school officials wherein
agreement was reached to initiate a school safety patrol program. It was moved by
Councilman Hubbard, seconded by Councilman Schlueter and carried, that the adult
crossing guard be retained at the intersection until Christmas recess and that
meanwhile a school boy patrol be trained to take over after Christmas recess without the
adult guard.
Roger Harvey, 2R14 N. Forest~ spoke against having a school boy patrol, stating it was
preferable to no protection whatever, but that a permanent adult crossing guard should
be maintained.

The Council received and considered a staff r~port on a request by Glenn D. Tabor,
Superintendent of Schools, for sidewalk area clearance on the south side of 17th
Street betwee~ Lincoln and Grand Avenues and establishment of a school crossing
guard at the intersection of 17th Street and Grand Avenue. Mrs. Jean Jones, 1533
E. Washington, spoke in favor of a crossing guard. The City Manager noted that
this intersection does not meet the standards established by the Public Works
Department, and City Council's past policy has been to not provide a guard at
signalized intersections. The Manager therefore recommended denial of the crossing
guard. Kirwood Jacobs, 915 E. Avalon, spoke in opposition to school boy patrols.
On motion of Councilman Hubbard, seconded by Schlueter and carried, the Council
received the report and requested the City Nanager to investigate further the
request and warrants for crossing guard.
