HomeMy WebLinkAbout95-041 - Inter City Commuter Station Redevelopment Project087 RESOLUTION NO. 95-041 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SA/~TAANACALLING FOR THE FORMA- TION OF A PROJECT AREACOMMITTEE FOR THE INTER CITY COMMUTER STATION REDEVELOP- MENT PROJECT WHEREAS, the City Council of the City of Santa Aha will consider whether to amend the Redevelopment Plan for the Santa Ana Inter City Comm~ter Station Redevelopment Project to extend the time limit for commencement of eminent domain proceedings to acquire property within the project area; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA as follows: 1. The City Council hereby calls upon the residents, businesses and existing community organizations in the Inter City Commuter Station Redevelopment Project Area to form a Project Area Committee. 2. Those "Procedures for the Formation of the Project Area Committee for the Santa Aha Inter city Commuter Station Redevelop- ment Project," attached hereto as Exhibit A, are hereby approved and adopted pursuant to subdivision (b) of Section 33385 of the Health and Safety Code of the State of California. 3. The Executive Director of the Community Development Agency is authorized to establish the time and place of public meetings relative to the formation of the Project Area Committee and to provide notice of the same to all residents, businesses and community organizations in the Project Area in accordance with the procedures adopted by the City Council. GENERAL 1.01 ?urDose The purpose of this Procedure for the Formation of the Project Area Committee for the Central City Redevelopment Project (this "Procedure") is to set forth a procedure, as required by the Co~u~unity Redevelopment Law, California Health & Safety Code Sections 33000, et seq. (the "Law"), relating to the formation of a project area committee for the Santa Aha Inter City Commuter Station Redevelopment Project (the "Project"). The Agency shall comply with this Procedure to form and select the project area committee in connection with the proposed amendment to the redevelopment plan for the Project. 1.02 Definitions Whenever the following terms are used in this Procedure, unless otherwise defined, such terms shall have the meaning ascribed to them in this Article. "Agency" means the Executive Director of the Community Development Agency of the city of Santa Aha and those employees of the City of Santa Ana who are assigned by the Executive Director the responsibilities for implementing this Procedure. "Project Area" means the area within the existing geographical boundaries of the Project. "Project Area Committee" or "PAC" means the committee to be EXHIBIT A 090 RESOLUTION 95-041 formed and selected pursuant to Section 33385 of the Law and in accordance with this Procedure. II. PUBLICIZING THE OPPORTUNITY TO SERVE ON THE PROJECT AREA COMMITTEE 2.01 Requirement to P~blicize The Agency shall publicize the opportunity to serve on the PAC. The Agency may take any or all of the actions described in this Article to publicize the opportunity to serve on the PAC. 2.02 Published and Mailed Notice The Agency shall include notice of the opportunity to serve on the PAC in any published and/or mailed notice which the Agency gives in accordance with the Procedures for Santa Ana Project Area Committee Elections adopted by the City Council (the "Election Procedures"). 2.03 Post,hq Notice The Agency may Post notice of the opportunity to serve on the PAC in conspicuous locations throughout the Project Area. Such notices may also be posted in the following locations: (1) office of the City Clerk; (2) public buildings in the Project Area, including the Agency's site office if any; and (3) other public places likely to be frequented by potential candidates, including public buildings in the vicinity of the project area and major commercial centers serving the project area. 2.04 Public Announcement 2 The Agency may make an announcement to the general public at any of its regular meetings held prior to any public meetings, hearings or Dlebiscites required by this Procedure, announcing the opportunity to serve on the PAC. 2.05 Q~her Mechanisms to Publicize OPPortunitY to Serve o~ PAC The Agency may produce radio Or television advertisements, distribute flyers or undertake such other action as it deems necessary or advisable to further publicize the opportunity to serve on the PAC. 2.06 Foreiqn Languages The Agency may, if it determines it is necessary or advisable to effectively carry out the purpose of this Procedure, translate any of the notices or announcements required by this Procedure into another language. III. MEETINGS 3.01 ~gneral The following meetings, hearings and plebiscites described in this Article Shall be conducted as necessary or appropriate to explain and form the PAC. 3.02 Public Meetinq to ExDlain the PAC The Agency shall conduct a minimum of one (1) public meeting to explain the establishment of, functions of, and opportunity to serve on the PAC. Such meeting shall be the same as the "Election Procedures Meeting" specified in the At euch public meeting, the Agency shall distribute copies of 3 092 RESOLUTION 95-041 the following documents: 1. Sections 33347.5, 33366, and inclusive, of the Law; 2. This Procedure; and 3. The redevelopment plan, or thereof. In addition to the materials listed distribute copies of any other materials would be useful. 33385 through 33388, the pertinent portions above, the Agency may the Agency determines The number of copies to be made available at the meeting shall be sufficient to meet the estimated number of attendees anticipated. Additional copies of the materials shall be available to the public at a place or places designated by the Agency. The Agency may limit the number of documents to be distributed to any one person or entity to one (1) set, in order to'avoid excessive and unnecessary costs. Any person or entity may request additional copies of the documents at a reasonable duplication cost. 3.03 PAC Formation Meetinq After the Agency conducts the public meeting(s) to explain the PAC required in Section 3.02 of this Procedure, the Agency shall conduct an "Election Meeting" in accordance with the Election Procedures. 3.04 Presentation of PAC to City council After the formation and selection of the PAC, the results shall be presented to the city Council at a public meeting. Notice 4 RESOLUTION 95-041 of the date of presentation of the results to the City Council shall be announced at the PAC formation meeting or meetings and at annual election meetings, if such date of presentation has theretofore been determined, and notice shall be provided to residents and businesses in accordance with Article II of this Procedure. At such meeting the city Council shall consider adoption of a finding that all adopted procedures of the City Council were followed in the election to the PAC. IV. NOTICE OF MEETINGS 4.01 General The Agency shall provide notice of all meetings, hearings, or plebiscites conducted by, or on behalf of, the Agency or city Council, relative to the formation and selection of the PAC. 4.02 Publication The Agency shall provide published notice of all meetings, hearings or plebiscites conducted by, or on behalf of, the Agency or City Council relative to the formation and selection of the PAC. Each notice shall be published at least one (1) time in a newspaper of general circulation within the City at least ten (10) days prior to the date established for the applicable meeting, hearing or plebiscite, and in the manner required by the Law. In lieu of publishing separate notice for each such meeting, hearing, or plebiscite, the Agency may publish combined notices setting forth all or some of the dates, times, and locations of such meetings, hearings and plebiscites, and the "Election Procedures Meeting" and "Election Meeting" specified in the 5 RESOLUTION 95-041 Elections Procedures. 4.03 Notice by Mail The Agency shall provide written notice to all residents and businesses (including property owners) in the Project Area of all meetings, hearings, or plebiscites conducted by, or on behalf of, the Agency or City Council relative to the formation and selection of the PAC. The mailed notice requirement shall only apply when mailing addresses to all the individuals and businesses, or to all occupants, a~e obtainable by the Agency at a reasonable cost. The notice shall be mailed by first-class mail, but may be addressed to "occupant." In lieu of providing separate notice for each meeting, hearing, or plebiscite, the Agency may provide combined notices pursuant to this Section stating all or some of the dates, times and locations of such meetings, hearings and plebiscites, and the "Election Procedures Meeting" and "Election Meeting" specified in the Elections Procedures. If the Agency has acted in good faith to comply with the notice requirements of this Section, the failure of the Agency to provide the required notice to residents or businesses unknown to the Agency or whose addresses could not be obtained at a reasonable cost, shall not, in and of itself, invalidate the formation or actions of the PAC. V. COMPOSITION OF THE PAC 5.01 Membership The PAC shal have eleven (11) membership positions in the following categories and numbers: 6 RESOLUTION 9 -041 095 Residential owner-occupants: 3 Residential tenants: 2 Business owners: 3 Existing community organizations: 3 5.02 Desiqnation of Certain Existinq Community Orqanizatiom~ Entitled to Select Members of the PhC The following existing community organizations are each entitled to select one member and alternates to the PAC in accordance with the Election Procedures: The .Santa Ana Chamber of Commerce The Santa Ana Unified School District Rancho Santiago Community College District VI. INITIAL MEETING OF THE PAC 6.01 Date of Initial Meetinq The Agency shall set a time, date and place for the first meeting of the PAC, which shall not be more than three (3) weeks after the date'on which the City Council certifies the election of the PAC. 6.02 ~@Dduct of Initial Meetinq The Agency shall prepare the agenda for the first meeting of the PAC and shall chair such meeting until a Chairman is elected' by the PAC from among its members. The Chairman and one or more Vice- Chairmen shall be elected at the first meeting of the PAC. At its first meeting, the PAC shall set the time and place of its regular 7 RESOLUTION 95-041 meetings and initiate the preparation and adoption of other laws. VII. ON-GOING AGENCY RESPONSIBILITIES 7.01 provsion of Meetinq Place The Agency shall provide a meeting place for the meetings of the PAC. by- 7.02 Minutes The Agency shall provide a qualified staff person to keep the minutes of the meetings of the PAC, together with a record of all information presented to the PAC by the Agency. VIII. MISCELLANEOUS 8.01 Interpretation of This Procedure The city Council shall have the authority to interpret this Procedure and to resolve any disputes arising hereunder. 8.02 Incorporation of This Procedure into PAC Bylaws This Procedure shall automatically be deemed to be incorporated by reference into any bylaws, procedural rules and/or any other documents establishing a framework for the PAC's opera- tions; in the event of a conflict between the provisions of this Procedure and the provisions of any such bylaws, procedural rules or other documents, the provisions of this Procedure shall prevail. 8 RESOLUTION 95-041 097 Adopted by Resolu%n No. 95- of the City Council of the City of Santa Aha on , 1995, pursuant to Section 33385 of the Community Redevelopment Law. 9
