HomeMy WebLinkAbout95-054 - Denying Variance Increase the Maximum Permitted Height and Area175 RESOLUTION NO. 95- 054 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DENYING VARIANCE APPLICATION NO. 95-4, WHICH SOUGHT TO INCREASE THE MAXIMUM PERMITTED HEIGHT AND AREA OF A FREEWAY POLE SIGN FOR A GAS STATION AT THE SOUTHWEST CORNER OF SEVENTEENTH STREET AND PENN WAY WHEREAS, this Council held a public hearing on August 21, 1995, on Variance Application No. 95-004, which sought to increase the maximum permitted height and area of a freeway pole sign for a gas station located at the southwest corner of Seventeenth Street and Penn Way; NOW, THEREFORE, BE IT RESOLVED BY THE CITY coUNcIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council approves and adopts the findings and determinations set forth in Exhibit A, attached hereto and incorporated herein. 2. Variance Application No. 95-004 is hereby denied. ADOPTED this 5th day of September , 1995. The 1-5 (Santa Ana) Freeway is an overcrossing at Seventeenth Street, which places the traffic above the surface streets and this service station. To adjust for this s~tuation, Caltrans is in the process of investigating the potential to place a freeway sign for both northbound and southbound traffic alerting motorists that Chevron is located at this exit. This would accomplish the same intent as a pole sign, thereby not depraving the property of exposure and advertising. Will the proposed use, under the detrimental to the health, safety, working in the vicinity? circumstances of the particular case, be or general welfare of persons residing or Seventeenth Street is a ma]or arterial in the City with a high traffic volume. Prior to the widening of the I-5 Freeway, this station did not have frontage directly along the freeway right-of-way; it was west of the interchange (the old Penn Way), west of a business located on Penn Way and west of 5he railroad tracks. This property only became adjacent to the free~ay due to the w~en~n9. Therefore, no previous property rights have been affected. Will the proposed use adversely affect the present economic stability or future economic development ~f property in the surrounding area? Approving this request would be a precedent setting action which could encourage other frse~ay fronting uses to request higher signs for their businesses~ This would be contrary to the code requirements established bi~ the Planning Commission and City Council, and be de%rlmental tc the public welfare or surrounding property. Will the proposed use comply with the regulations and conditions specified in this chapter for such a use? The General Plan designates the 1-5 (Santa Ana) Freeway as a "high- speed scenic corridor" which is a major influence on the City's image, The scenic corridors designation discourages the intrusion of unsightly signage or other structures which impact the visual and aesthetic qualities of this corridor.
