Roll call was answered by Councilmen Hubbard, Schlueter, Gilmore, and Mayor Hall. Counei]mmn Brewer was absent. CLERK'S RESORT The Clerk reported that a copy of the Order of Adjournment of the regular meeting of January 21, lg63 to 4:00 p.m., January 28, 1963 was posted as required by law and that evidence thereof was on file in the Clerk's office. COUNCIL RECESS The Chair recognized Nr. Robert Rosenwald, Special Counsel in the Newport-Dyer Annexation litigation, who asked to meet with the Council in executive session. On motion of Councilman Hubbard, seconded by Counci]m-n Schlueter and unanimously carried, the Council declared a fifteen minute re- cess at 4:05 p.m. The meeting was reconvened at 4:35 p.m. with all Council- men present. Counc~lw,~u Brewer also was present and remained throughout the remainder of the meeting. CHARTER AMENDMENTS Council received a report from the Charter Review Committee, recom- mending changes in twenty-six sections of the City Charter, and the report was received and ordered filed on motion of Councilman Hubbard, seconded by Councilman Schlueter and unanimously carried. Mr. Thornton, City Manager, s,mw,-~ized the recommendations and introduced two members of the Charter Study Committee, Mr. Ellis Diehl and Mr. Milford Dahl. It was pointed out by the City Manager that changes in twelve of the sections were merely changes in the voting procedures of the City Council to provide for a majority or two-thirds vote that would apply for a legislative group of five, seven, or nine members. It was moved by Cotu~eilmmu Hubbard, seconded by Councilman Gilmore, and unanimously carried, that the Council approve the changes recommended by the committee for Sections lO1.2, 409, 413, 415, 421, 410, 500, 606, 609, 701, 900, and ~O1 of the Charter and instruct the City Attorney to prepare an appropriate proposition for the April 2, 1963 Municipal Election. On motion of Councilman Hubbard, seconded by Counc~]m-= Schlueter and unanimous- ly carried, Council approved the change recommended by the Committee for Section lOl.1 relative to the number of wards in the City, and instructed the City Attorney to prepare a ballot proposition. On motion of Councilman Hubbard, seconded by Councilman Gilmore, and carried, Council approved the changes recommended by the Committee for Section lO1.3 relative to the determination of population for ward increases, and instructed the City Attorney to prepare a ballot proposition. On motion of Councilman Hubbard, seconded by Councilman Brewer, and carried, Council approved the changes recommended by the Committee for Sections 400 and 401.1 relative to the terms of office and order of filling offices of Councf]men, and instructed the City Attorney to prepare a ballot proposition. City Council - 22 - January 28, 1~63 ~ayor Hall disqualified himself from discussion and action in the matter of a recommended increase in compensation to the Councilman who is filling the office of ~ayor, and Vice-Mayor Hubbard assumed chairmanship of the meeting. It was moved by Couaci~m~u Schlueter, seconded by Councilm-u Gilmore, and carried, that the City Council accept the recommendation of the Committee for changing Section 402 of the Charter to a~ ~ ow an additional compensation of $75.00 to the Coun¢ilm~u who is serving as Nayor, and in- struct the City Attorney to prepare a ballot proposition. Mayor Hall returned and assumed chairmanship of the meeting. On motion of Councilman Hubbard, seconded by Councilman Schlueter, and carried, Council approved changes recommended by the Committee for Section 411 relative to special committees of the City Council~ and instructed the City Attorney to prepare a ballot proposition. On motion of Councilman Hubbard, seconded by Councilman Brewer, and carried, the Council approved changes in Sections 605 and 607 recommended by the Committee relative to dates for the submission and adoption of the Budget, and instructed the City Attorney to prepare a ballot proposi- tion, combining the two changes if possible. On motion of Counc~lm~ Hubbard, seconded by Counc~lm~n Brewer, and carried, Council approved changes recommended by the Committee for Section 615 rela- tive to the establishment of an allotment system for budget appropriations~ and instructed the City Attorney to prepare a ballot proposition. On motion of Counc~lm-n Hubbard, seconded by Counc~lm~n Schlueter, and carried, Council approved changes recommended by the Com~t tree for Section 800 of the Charter to correct the name of the Santa Ana Unified School District, and instructed the City Attorney to prepare a ballot proposition. On motion of Councilm~n Hubbard, Schlueter, and carried, Council approved changes recommended by the Committee for Section ~07 relative to the members of the Board of Recreation and Parks and instructed the City Attorney to pre- pare a ballot proposition. On motion of Councilman Hubbard, seconded by Councilman Schlueter, and carried, Council approved changes rec~mended by the Committee for Section 1002 relative to excepted service for assistants in the Nanager's office, and instructed the City Attorney to prepare a ballot proposition. On motion of Councilman Hubbard, seconded by Councilman Schlueter, and carried, Council approved changes recommended by the Committee for Section 100? relative to temporary appointments of employees, and instructed the City Attorney to prepare a ballot proposition. On motion of Councilman Hubbard, seconded by Counc~lm~n Schlueter~ and carried, Council approved changes recommended by the Committee for Section 1400 relative to the Employees' Retirement System, and instructed the City Attorney to prepare a ballot proposition. It was moved by Counc~lmau Hubbard, seconded by Councilman Schlueter, and unanimously carried, that individual resolutions be prepared for each member of the Charter Review Committee expressing the Council's appreciation for the service rendered to the City, and that a unanimous roll call vote be cast. STR~I' BANNER Jack Randall requested permission from the Council to hang a banner for the Heart Association campaign across the intersection of Main and Fourth Streets or at a similar intersection. Mr. Randall ~as advised that the Council would take the matter under consideration and make a decision on February 4, 1~63. City Council - 23 - January 28, 1963 ORAL CO~UNICATIONS A question from Mrs. Janice Boer relative to the dates on which offices would be filled created by a proposed increase in wards was answered by the City Manager, who explained that the Charter amendment, if adopted by the voters, would provide for the filling of offices at the next general Municipal Election subsequent to the formation of the ward. ADJOURNMENT There being no further business to come before the Council, the meeting was adjourned at 5:30 p.m. on motion of Councilman Hubbard, seconded by Councilman Schlueter, and carried. DORIS M.
