RESOLUTION NO. 96-007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA TO AMEND
RESOLUTION NOS. 82-110 AND 91-066 TO DESIGNATE THE EXISTING CLASS
OF FIRE BATTALION CHIEF AS UNREPRESENTED MIDDLE MANAGEMENT AND TO
ENABLE NON-SWORN UNREPRESENTED MIDDLE AND EXECUTIVE MANAGEMENT TO
PAY PART OF THE COST OF THE 2% AT 55 PERS RETIREMENT BENEFIT AND TO
ADJUST THE PAY LEVEL FOR PUBLIC WORKS MAINTENANCE MANAGER (MM).
WHEREAS, Section 1004, Article X of the City Charter of the
City of Santa Ana requires the City to prepare, install and
maintain a position classification and pay plan subject to civil
service rules and regulations and the approval of the City Council;
and
WHEREAS, on August 2, 1982, the City Council passed and
adopted Resolution No. 82-110 revising and re-establishing the
Basic Classification and Compensation Plan for Officers and
Employees of the City of Santa Aha; and on July 1, 1991, passed and
adopted Resolution No. 91-066, re-establishing the Basic
Classification and Compensation Plan for classes of employment
designated as unrepresented executive and middle-management; and
WHEREAS, employees in the classification of Fire Battalion
Chief have unanimously decided to no longer be represented as a
bargaining unit and wish to be part of unrepresented middle-
management; and
WHEREAS, the Council approved the 2% at 55 PERS Retirement
Benefit for SACEA/SEIU which impacts all PERS non-sworn
"miscellaneous" employees, including unrepresented managers, who
will be required to pay 1% of their salaries towards the cost of
this new retirement benefit; and
WHEREAS, classification/compensation studies are conducted
regularly to ensure that pay levels are set commensurate with
duties performed and at market competitive rates; such a recently
conducted study revealed that the pay level for the middle-
management class Public Works Maintenance Manager (MM) is above
market and should be adjusted to reflect current market rates; and
WHEREAS, it is now desired to:
1. add the existing classification of Fire Battalion Chief to
Resolution No. 91-066 and designate this class as unrepresented
middle-management; and
2. maintain the same 5-step salary structure and pay plan for
the classification of Fire Battalion Chief as provided prior to its
designation as unrepresented middle-management; and

3. provide for a one percent (1%) salary reduction for all
PERS non-sworn "miscellaneous" management employees, effective July
1, 1997; and
4. provide for a ten percent salary reduction for the middle-
management classification of Public Works Maintenance Manager (MM),
upon the separation of the current incumbent; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA:
1. That Section 3 of Resolution No. 82-110, as amended, be further
amended by deleting the classification of Fire Battalion Chief (RM)
from this Resolution, to transfer it to Resolution No. 91-066.
2. That Resolution No. 91-066, as amended, is hereby further
amended, as follows:
a. That Subsection 3B, as amended, is hereby further amended
to:
1. add the existing classification title of Fire Battalion
Chief at the monthly 5-st~p salary rate range M690 ($6050-$7355)
effective November 1, 1995; and to designate said title as
unrepresented middle-management by adding the parenthetical
identifier "MM" following the class title.
2. adjust the pay level assigned to the classification Public
Works Maintenance Manager (MM) from MM-28 to MM-24 ($5844-$8256),
effective on the next day after the separation date of the current
incumbent.
b. That Subsection 2A, as amended, is hereby further
amended to read as follows:
"Section 2. Schedule of Salaries.
A. Three separate schedules of salary rate ranges for classes
of employment designated as Executive Management (EM), general
Middle-Management (MM), and Fire Battalion Chief (MM) are attached
hereto and made a part hereof as though set forth in full herein.
The schedules for Executive Management classes, general Middle-
Management classes, and for the class of Fire Battalion Chief (MM),
and their respective effective dates, are as follows:

c. That Subsection 2B is hereby amended to read as follows:
"Section 2. Schedule of Salaries.
B. Except for the Fire Battalion Chief Salary Schedule BC-1,
described below, each Executive and Middle-Management salary
schedule contains numerous salary rate ranges, each range comprised
of fifteen (15) separate rates of pay shown in monthly amounts.
The respective rate ranges are identified by a two digit number
preceded by the capital letters "EM" for Executive Management and
"MM" for Middle Management. The separate rates of pay or steps
within each salary rate range are identified by the numbers "1"
through "15" inclusive, with Step "1" being the lowest or minimum
rate of the range, Step "8" the middle or midpoint rate of the
range, and Step "15" being the highest or maximum rate."
d. That Section 2 is hereby amended to add a new Subsection
C to read as follows:
"Section 2. Schedule of Salaries.
C. The basic salary and wage schedule BC-1 for Fire Battalion
Chief (MM) contains numerous salary rate ranges, designated by the
letter "M" and a 3-digit rate range number. These rate ranges
contain five (5) steps or rates of pay, identified by the letters
"A" through "E" inclusive, with step "A" being the lowest step in
the range. The purpose of each step and criteria for advancement
to the next higher step within a particular salary rate range are
set forth in Schedule BC-1 and its Attachment A 'Fire Battalion
Chief Salary'."
e. That Subsection 5.2 is hereby amended to read as follows:
"5.2 Hirinq Pay Policy
A. Except for incumbents in the class of Fire Battalion Chief
(MM), newly hired management employees shall be compensated at any
rate within the lower third of the salary range (Steps 1 through 5)

for their job classification as authorized by the appointing
authority. When economic conditions, unusual employment
conditions, or exceptional qualifications of a candidate for
employment indicates a higher rate would be in the City's best
interest, the City Manager may authorize hiring at a higher rate in
the salary range but this higher rate generally shall not be above
the midpoint.
B. Incumbents in the class of Fire Battalion Chief (MM) will
be hired at the rate described in Schedule BC-1 and its Attachment
A 'Fire Battalion Chief Salary.'"
f. That Section 5 is hereby amended to add a new Subsection
5.12:
"5.12 "Workday" for Fire Battalion Chief (MM). Incumbents in
the class of Fire Battalion Chief (MM) who are assigned to a
twenty-four (24) hour work shift will have their "workday" for all
time off purposes defined as equal to twelve (12) hours."
g. That Subsection 6.1 is hereby amended to add a new
paragraph C, to read as follows:
"C. 2 % at 55 PERS Retirement Benefit: Effective July 1,
1997, the City shall pay 2.266% of the cost of providing the 2% at
55 PERS Retirement Benefit for unrepresented non-sworn PERS
"miscellaneous" middle and executive PERS "miscellaneous"
management employees. Employees in classes designated non-sworn
PERS "miscellaneous" middle-management (MM) and non-sworn executive
PERS "miscellaneous" management (EM) shall pay one percent of their
salary towards the total cost of 3.266% for the 2% at 55 PERS
Retirement Benefit by taking a decrease of one percent in their
salaries effective July 1, 1997."
h. That Subsection 6.3, as amended, is hereby further amended
to read as follows:
"6.3 Health Insurance.
The City shall contribute towards the health insurance
coverage of all affected employees covered by this Resolution in
the Same manner and amount as provided for represented, non-
management general service PERS "miscellaneous" employees.
Any contribution necessary to maintain benefits under any
health insurance program provided by the City for its employees and
their eligible dependents in excess of the amounts of the City
contribution be entirely borne by the employee."

i. That Subsection 6.7 is hereby amended to add the following
new second paragraph:
"6.7 Paid Holiday Time Off.
Personnel in the classification of Fire Battalion Chief (MM)
assigned to the 24 hour work shift schedule shall be entitled to
receive twelve (12) working days off during the calendar year in
lieu of holiday benefits. Employees in this classification will be
given an option once per calendar year to receive cash compensation
computed on a straight time basis in lieu of all or part of their
holiday leave benefit."
jo That Subsection 6.11 is hereby amended by adding the
following new second paragraph:
"6.11 Payment for Unused Sick Leave.
A lump sum payment shall be made to the beneficiaries of the
current (as of November 1, 1995) employee in the classification of
Fire Battalion Chief (MM), whose death occurs while such employee
is an active employee of the City. Such payments are to be equal
to what would be credited to the employee's account at the time of
his or her death and at the rate of pay effective on the date of
death."
k. That Section 6 Employee Benefits, as amended, is hereby
further amended to add a new Subsection 14 to read as follows:
"6.14 Industrial Leave. Employees hired after July 1, 1987 in
the classification of Fire Battalion Chief (MM) will not have an
option to defer his or her disability retirement date until after
all accrued sick leave has been exhausted. Such employees,
however, shall be able to receive a lump sum cash payment for any
unused sick leave as provided to other represented units and as
specified in Subsection 6.11 of this resolution."
1. That Section 6. Employee Benefits, as amended, is hereby
further amended to add a new Subsection 20 to read as follows:
"6.20 Catastrophic Leave Donation. Affected employees shall
be eligible to donate and receive catastrophic leave donations as
provided to other represented "miscellaneous" general service
employees."
m. That the first paragraph of Section 7. Manaqement
Performance Based Evaluation System is hereby amended to read as
follows:

"Except for employees employed in the classification of Fire
Battalion Chief (MM), there is hereby established a performance
based evaluation system for officers and employees employed in
classes herein designated as unrepresented Executive Management
(EM) or Middle-Management (MM), the provisions of which are set
forth herein below."
3. That except as amended by this Resolution, all other
provisions of Resolution Nos. 82-110 and 91-066, as amended, shall
remain in full force and effect.
4. That this Resolution shall be operative from and
November 1, 1995.

BASIC SALARY /lAiD WAGE SCHEDULE FIRE BATTALION CHIEF (MM)
This basic salary and wage schedule provides for number of ranges of pay rates (salary rate
ranges) each comprised of five pay steps or rat~s. The salary rate ranges are identified by
the letter M, and a three-digit number. Steps are identified by the letters A to E
inclusive. The purpose of each step and the length of service and other criteria required
for advancement within the rate range is defined below.
A - Lowest step in range.
B - Shall be granted on the first day of the month following completion of one year
of continued satisfactory and efficient service.
C - Same as B.
D - Same as B.
E - Same as B.
A performance appraisal shall be required for movement through the steps.
NOTE:
SALARy SCHEDULE MATRIX
In the following salary schedule matrix, each salary range is identified by a three-digit
number. The first two digits are listed in the first vertical column on the left and the
third digit is listed horizontally across the top and identifies the appropriate column.
This three-digit range number locates "A" step of the range and steps B, C, D and E are found
in the column directly below "A" step. For example, "A" step off Range NO. 601 is found to
be $3915 by moving down the left column (Range No.) to the number 60 (the first two digits
of the Range No.), then horizontally to column 1 (the third digit of the Range No.). The "A"
step of $3915 has the remaining steps shown directly below, thus the full, five-step range
is 3915-4111-4317-4533-4764.

SALARY FOR THE CLASSIFICATION FIRE RATTALION CHIEF (MM)
Section 1. Basic Compensation Plan.

Schedule BC-1 and made a part hereof as though set forth in full
herein, provides numerous salary rate ranges, each comprised of
five (5) steps or rates of pay.
The respective rate ranges are identified by a three-digit
number. The steps within each range are identified by the letters
"A" through "E" inclusive, with Step "A" being the lowest step in
the range. The purpose of each step and criteria required for
advancement to the next higher step within a particular salary rate
range are set forth in Section 6 below.
Section 3. Salaries. Effective November 1, 1995, the salary
level for the class of Fire Battalion Chief (MM) will be Salary
Rate Range M690, Step "A" ($6050) through Step "E" ($7355).
Section ~. Application of Basic Compensation Plan. Ail
employees working in the classification Fire Battalion Chief (MM)
shall be compensated at a monthly rate.
Section ~. Beqinninq Rates. An employee appointed to the
class of Fire Battalion Chief (MM) may be placed by the appropriate
appointing authority at any step within the applicable five (5)
step salary rate range (A through E) in the schedule to which the
class has been allocated by Resolution of the City Council,
provided that such employee shall be assigned such salary step upon
the commencement of his or her service in said classification and
such assignment having once been made shall remain in effect until
the said employee shall be entitled to advance to the next salary
step in accordance with the further provisions as set forth below.
Section 6. Advancement Within Ranqes. The following
regulations shall govern salary advancement within rate ranges for
employees in the classification of Fire Battalion Chief (MM):
A. For any employee in the classification Fire Battalion
Chief (MM) who has been initially appointed to a step lower than
Step "E," advancement to the next higher step (Step "B" from Step
"A" or Step "C" from Step "B," etc.) may be granted only for
continued satisfactory and efficient service by said officer or
employee in the effective performance of the duties of his or her
position. The effective date of such step increase, if granted,

shall be the first day of the month following the completion of one
year of service at the step from which said employee is being
advanced.
Such merit advancement shall require the following:
1. There shall be on file in the Office of the Executive
Director of Personnel Services a copy of each periodic efficiency
or performance report required to be made on the employee by the
Civil Service Rules and Regulations and/or the City Manager during
the period of service time of such employee subsequent to his or
her last salary advancement.
2. The Fire Chief, at least twenty (20) calendar days prior
to the anticipated completion of such employee's required length of
service, shall file with the City Manager a statement recommending
the granting or denial of the merit increase and supporting such a
recommendation with specific reasons therefore. The employee shall
be notified by the Fire Chief as to such recommendations and shall
be informed of the reasons thereof.
3. No advancement in salary above Step "A" shall become
effective until approved by the City Manager, except when placement
on a salary step above Step "A" results from promotion under the
provisions of Section 8 of this Article.
B. When any such employee in the classification Fire
Battalion Chief (MM) has not been approved for advancement to the
next higher salary step, he or she may be reconsidered for such
advancement after the completion of three (3) months of additional
service and shall be reconsidered for advancement to the next
higher step above his or her then current step after the completion
of six (6) months of additional service.
Section 7. Promotional Salary Advancement. When an employee
in the classification Fire Battalion Chief (MM) is promoted to a
position in a higher classification from a position in a lower
classification in the same occupational career ladder, he or she
shall be reassigned to the beginning step in the appropriate salary
rate range for the higher classification; provided, however, that
if the base salary currently being paid such employee is already
equal to or higher than such beginning step, he or she shall be
placed in the lowest step in the appropriate salary rate range as
will grant that employee an increase of five percent (5%) over his
or her current base salary step exclusive of any pay additive or
additives such as shift differential, assignment pay, special skill
pay or the like.
Section ~. Demotion. When an employee in the classification
Fire Battalion Chief (MM) is demoted to a position in a lower
classification, his or her salary rate shall be fixed in the low
appropriate salary rate range for the lower classification in

accordance with the following provisions:
A. The salary rate shall be reduced by at least one (1)
step.
B. The new salary rate must be within the appropriate
salary rate range.
C. The new salary rate shall not be higher than the
salary step to which the employee would have been entitled had his
or her service time in the higher classification been spent in the
lower classification.
Section ~. Reallocation of Salary Rate Ranqes. Any employee
who is employed in a classification which is reallocated to a
different salary rate range from that previously assigned shall be
retained in the same salary step in the new salary rate range as he
or she had previously held in the prior rate range and shall retain
credit for length of service in such step towards advancement to
the next higher step.
