HomeMy WebLinkAbout96-016 - Approving Conditional Use Permit No. 95-30411 REL:2~3/g6 RESOLUTION NO. 96- 016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 95-30 TO ALLOW A RESTAU- RANT LOCATED AT 202 SOUTH BRISTOL STREET TO REMAIN OPEN AFTER 12:00 A.M. WHEREAS, this Council held a public hearing on February 20, 1996, on Conditional Use Permit Application No. 95-30, to allow a restaurant located at 202 South Bristol Street to remain open after 12:00 a.m.; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. 2. Conditional Use Permit No. 95-30 is hereby approved subject to the conditions set forth in Exhibit B, attached hereto and incorporated herein, and subject to the additional condition that a security guard be maintained on the premises on Friday, Saturday and Sunday nights. The restaurant provides a service to the surrounding properties, the community and commuters in the area. It contributes to the well being of the of the neighborhood by maintaining a clean and safe environment. will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The proposed late night operation will not be detrimental to persons residing and working in the area as the use, as conditioned, will not create any negative or adverse impacts such as noise or loitering. Will the proposed use adversely affect the present economic development of property in the surrounding area? The restaurant assists in the economic viability of the area by providing a service to residents, business owners and commuter. This use is a revenue source for the City and contributes to the economic health of the entire area by complementing current businesses and their customers, as well as attracting new customers to this area. Will the proposed use comply with the regulations and conditions specified in this chapter for such use? The restaurant complies with all regulations and conditions specified in the Santa Aha Municipal Code. Will the proposed use not adversely affect the general plan of the city or any specific plan applicable to the area of the proposed use? The restaurant zoning, use and other applicable items are in compliance with the General Plan. EXHIBIT A - ' Conditional Use Permit No. February 20, 1996 Page 1 of 2 95-30 Conditions for Approval Should Conditional Use Permit No. 95-30 be approved, the project shall comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following conditions: A. planninq Division 1. Ail proposed site improvements shall conform with Site Plan Review DP 95-70, unless amended by staff. 2. The hours of operation for the eating establishment shall be limited to the following hours: Monday through Thursday: 8:00 a.m. Friday and Saturday: 8:00 a.m. Sunday 8:00 a.m. to 2:00 a.m. to 4:00 a.m. to 3:00 a.m. 3. Any changes to the hours of operation for the restaurant must be reviewed by the Planning Manager. Conditional Use Permit No. 95-30 will be reviewed in six months after approval by City Council of the after hour operations. B. Police Department The existing parking lot must conform with the provisions of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Code (Building Security Ordinance). These code conditions will require that the existing project's lighting, and addressing be upgraded to current code standards. Lighting standards cannot be located in required landscape planters. The applicant shall be responsible for maintaining the premises free of graffiti. All graffiti shall be removed within 24 hours of occurrence. 3. Ail pay telephones shall be located inside the premises. The Conditional Use Permit shall be reviewed at six months, at one year and then annually thereafter by the Police Department for any modification to the conditions of approval. Window displays must be kept to a minimum for maximum visibility and shall not exceed 25 percent of window coverage. EXHIBIT B 4 t5 Conditional Use Permit No. February 20, 1996 Page 2 of 2 95-30 6. Window displays and racks must be kept to a maximum height of three feet including merchandise. 7. There shall be no coin operated games maintained on the premises at any time. Cash register must be visible form the street at all times and shall not be obstructed at any time by temporary or permanent signage. No loitering signs in both English and Spanish shall be posted in the parking lot. Install a silent armed robbery alarm system.
