HomeMy WebLinkAbout96-028 - Approving Conditional Use Permit No. 95-31AMENDED BY: ORDIRESO RESOLUTION NO. 96- 028 ~'A-~R~SOLUTION OF THE CITY COUNCIL OF THE ~ OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 95-31 TO ALLOW THREE RESTAURANTS IN A SHOPPING CENTER LOCATED AT THE SOUTHEAST CORNER OF HARBOR BOULE- VARD AND McFADDEN AVENUE REL: 3/19/96 WHEREAS, this Council held a public hearing on March 18, 1996, on Conditional Use Permit Application No. 95-31, to allow three restaurants in a shopping center located at the southeast corner of Harbor Boulevard and McFadden Avenue, in the SD (North Harbor Specific Plan) district, including one 10,000 square foot restau- rant, one 5,000 square foot restaurant, and one fast food drive- through restaurant; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. 2. Conditional Use Permit No. 95-31 is subject to the conditions set forth in Exhibit B, and incorporated herein. hereby approved attached hereto ADOPTED this 1st ATTEST: day of April , 1996. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or community? The restaurants provide a service to the surrounding properties, the community and commuters in the area. It contributes to the well being of the of the neighborhood by maintaining a clean and safe environment. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The proposed restaurants operation will not be detrimental to persons residing and working in the area as the use, as conditioned, will not create any negative or adverse impacts such as noise or loitering. Will the proposed use adversely affect the present economic development of property in the surrounding area? The restaurants assist in the economic viability of the area by providing a service to residents, business owners and commuter. This use is a revenue source for the city and contributes to the economic health of the entire area by complementing current businesses and their customers, as well as attracting new customers to this area. Will the proposed use comply with the regulations and conditions specified in this chapter for such use? The restaurants will comply with all regulations and conditions specified in the Santa Aha Municipal Code. EXHIBIT A RESOLUTION 96-028 Conditional Use Permit No. Conditions of Approval March 18, 1996 Page 1 of 1 95-31 Conditions of Approval Should Conditional Use Permit No. 95-31 be approved, the project must comply with all applicable sections of the Santa Aha Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following: A. Plannina Division The drive aisle between the fast food building and Building G is to be a minimum of 28 feet. 2. The project must meet the following development standards: 12 foot wide drive aisle at radii 10 feet wide at straight aways 80 feet minimum from pickup window 59 feet minimum from order window safe and efficient circulation 3. Menu order microphone shall face away from residential uses. 4. Pedestrian access shall not be through the drive-through lane. A hedge and border to screen headlight glare shall be provided around the drive though lane. 6. Trash recepticals shall be provided around the facility. 7. There shall be no exterior playland without Planning Commission approval. EXHIBIT B
