For such items for which a regular established price is unavailable, the Department Head, in collaboration with the Director of Finance & Management Services, may establish a price consistent with the cost of printing and preparation thereof. The Director of Finance & Management Services shall report such exceptions to the City Manager. It shall be the responsibility of the City Manager to review costs annually and make such recommendations to the City Council a~ required to keep the charges consistent with the costs. All governmental agencies and their official representative shall be exempt from paying these charges for single copies for official use. Use the highest quantity of chemicals (or materials) listed to determine the number range (1,2,3..) Count the number of chemicals (or materials) listed to determine the proper letter range (A,B,C..) Using the combined Range figures (Nmnber and Letter, l-A, 2-C, etc.) determine the proper fee from the schedule. 81.00 5546 Late Filing Penalty The Fire Chief shall impose a late filing penalty based on additional administrative costs incurred due to the late filing of any business plan, certification, or inventory. The amount of such penalty shall be 25 percent of the fee for such filing. Non-payment of the fee and penalty shall incur lO percent interest on the amount of the billing starting 30 days after the date issued. Page 12 RESOLUTION 96-035 REVENUE ACCOUNT DEPARTMENT/MISCELLANEOUS FEE OR SERVICE UNIT PROPOSED FEES FY 96-97 SECTION IV FIRE DEPARTMENT - CONTINUED 5546 ADMINISTRATIVE PENALTY FEE SCHEDULE This fee schedule utilizes a base penalty for each of the listed offenses and assesses a surcharge to that penalty expressed as a percentage of the base penalty for those factors as outlined in H&S Code Section 25514.5(0 which include, but are not limited to, the following considerations, but shall not exceed $5,000 for each day the violation occurs: a. Extent of harm caused by the violation - surcharge to 500 percent. b. The nature and persistence of the violation - surcharge to 500 percent. c. The length of time over which the violation occurs-surcharge to 100 percent. d. The frequency of past violations - surcharge to 100 percent. e. Action taken to mitigate the violation - surcharge to 100 percent. f. Financial burden on the violator - will be considered. The following base penalties shall be assessed for the below-listed violations: 1. H&S Code Section 25503.5 Failure to establish and implement a business plan for emergency response. 266.00 2. No permit shall be issued to any person, firm or corporation unless all fees therefor have been paid in full. Exception: Waiver of Fee No permit or plan check fees required by this resolution will be charged for public improvement projects performed by construction contractors and subcontractors pursuant to contract with the City of Santa Ana or the Community Redevelopment Agency of the City of Santa Ana nor for any work performed by employees of the City in the course of their employment. However, this fee waiver does not exempt any party from obtaining a permit for such work nor exempt such party from conforming to the procedures established by the City nor from compliance with all applicable City and State ordinances regulating such work. Upon written request from the permittee, refunds of permit fees may be made to the permittee in an amount equal to eighty percent (80%) of the permit fee, exclusive of the plan check and issuance fee; except that no permit fees shall be refunded under any of the following circumstances: (1) 180 days has elapsed from the date of the issuance of the permit. (2) inspections have been performed by the Building Safety Division. If a permit has been issued for a project located in an area outside of the jurisdiction of the City, one hundred percent (100%) of the permit and plan check fee may be refunded. If a permit has been erroneously issued, one hundred percent (100%) of the duplicated permit and plan check fee may be refunded. If a plan check fee has been paid and the plan is withdrawn by the applicant prior to the plan check, refunds of plan check fees may be made to the permittee in an amount equal to 100 percent (100%) of the plan check fee in excess of twenty dollars ($20.00) paid. In no other case may any plan check fees be refunded. Page 44 577 RESOLUTION 96-035 SPECIAL INVESTIGATION FEE A special investigation fee shall be charged by the Building Official for any investigation of a building structural work, reports, certification, or any other related work requested by an owner or his authorized agent. Said fee shall be assessed in an amount sufficient to reimburse the City for the costs actually incurred by the City based upon a rate of fifty-one dollars ($51.00) per hour but in no case shall be less than fifty-one dollars ($51.00). C. VIOLATION/INVESTIGATION & PENALTY FEES When any work for which a permit is required has been commenced without the authorization of such permit, an investigation may be required before a permit will be issued for such work. An investigation fee shall be assessed in an amount sufficient to reimburse the City for costs actually incurred by the City based on a rate of fifty-one dollars ($51.00) per hour but in no case less than fifty-one dollars ($51.00) shall be collected. EXPEDITED COPY REQUEST Whenever a request is received for expedited documentation of a written report, or for records or plans, a fee shall be assessed in an amount sufficient to reimburse the City for actual costs incurred, but in no case shall the fee be less than thirty-five dollars ($35.00). SOLAR ENERGY CODE Any person desiring a permit required by the Solar Energy Code shall, at the time of filing an application therefore, pay a fee equal to $17.00plus the sum of the fees for the work to be done under the permit as set forth in the following schedule.
