RESOLUTION NO. 97-021
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL
USE PERMIT APPLICATION NO. 97-01, WHICH
SOUGHT TO ALLOW THE SALE OF BEER AND
WINE FOR OFF-PREMISE CONSUMPTION AT A
CHEVRON GAS STATION LOCATED AT 2650
NORTH GRAND AVENUE
WHEREAS, Santa Ana Municipal Code Section 41-638 provides for
the granting of a conditional use permit from the provisions of the
Santa Ana Municipal Code;
WHEREAS, this Council held a public hearing on April 21, 1997,
on Conditional Use Permit Application No. 97-01, which sought to
allow the sale of beer and wine for off-premise consumption at a
Chevron gas station, located at 2650 North Grand Avenue, Santa Ana;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing
this Council finds and determines as follows:
A. That due to the overconcentration of other establishments
licensed to sell alcohol in the area and the proximity of the
proposed site to Fairhaven Elementary School, the proposed use will
not provide a service or contribute to the general well-being of
the local neighborhood and community.
B. That due to the overconcentration of other establishments
licensed to sell alcohol in the area and the proximity of the
proposed site to Fairhaven Elementary School, the proposed use will
be detrimental to the health, safety, and general welfare of the
persons residing, working, and going to school in the vicinity.
C. That the proposed use will adversely affect the economic
stability and future economic development of the property in the
surrounding area.
D. That due to the overconcentration of other establishments
licensed to sell alcohol in the area, the proposed use will be
contrary to City policy prohibiting establishments from selling
alcohol within a 1,000 foot radius of one another. Currently,
there are several establishments within 1,000 feet of the proposed
site which sell beer and wine for off-site consumption.
E. That the proposed use will not have an adverse affect on
the General Plan.
