RESOLUTION NO. 97-059
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA ESTABLISHING A
CONDITIONAL USE PERMIT FEE FOR COFFEE
HOUSES
WHEREAS, section 41-634 of the Santa Aha Municipal Code
("SAMC") authorizes the City Council to establish fees by
resolution for processing applications for conditional use
permits; and
WHEREAS, the City Council recognizes that there are coffee
houses and other non-alcoholic venues which desire to provide
entertainment which may require a conditional use permit pursuant
to SAMC 41-142; and
WHEREAS, the City Council recognizes that the current fees to
process a conditional use permit for an establishment without
alcohol sales desiring to provide entertainment may be cost
prohibitive; and
WHEREAS, the City Council does now desire to stimulate these
business activities by decreasing the fee for conditional use
permit applications for establishments without alcohol sales that
provide entertainment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. The reduced fee to process a conditional use permit
application for entertainment for establishments without alcohol
sales is $150.00.
2. The purpose of the abovesaid fee reduction is to
stimulate these business activities in certain districts.
3. The reduced fee would apply only to a bona fide
coffeehouse that:
A. Obtains health department approval for food
service, a business license, and a certificate of
occupancy.
B. Is no greater than 3,000 square feet in size.
C. Maintains a kitchen containing a sink, counter,
coffee makers and machines, refrigerator, storage area
and, a water heater.

D. Has no alcohol sales on-site and
consumption of alcohol on the premises.
