A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
ANA APPROVING TENTATIVE TRACT MAP NO. 15648, A
MITIGATED NEGATIVE DECLARATION AND MITIGATION
MONITORING PROGRAM FOR A 77 LOT SUBDIVISION LOCATED
AT 2828 NORTH BRISTOL STREET (TTM NO. 15648)
WHEREAS, Tentative Tract Map No. 15648 has been filed to subdivide
an existing 15.83 acre parcel into 77 lots, for the development of a
gated residential community located at 2828 North Bristol Street (the
~Project"); and
WHEREAS, the design and improvement proposed for Tentative Tract Map
No. 15648 is consistent with the objectives, policies, general land uses,
and programs specified in the City of Santa Aha General Plan; and
WHEREAS, the Environmental Evaluator of
prepared a mitigated negative declaration
program for the Project; and

WHEREAS, the Planning Commission of the City of Santa Aha held a
duly noticed public hearing on June 8, 1998, on Tentative Tract Map No.
15648, and based thereon, recommended that this Council approve the map
for the Project; and
WHEREAS, this Council held a duly noticed public hearing, on July 6,
1998, on Tentative Tract Map No. 15648 for the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing,
this Council finds and determines as follows:
The Project, as conditioned, and its design and improvements are
consistent with the Low Density Residential designation on the
General Plan and are otherwise consistent with all other elements of
the General Plan.
Tentative Tract Map No. 15648 is consistent with the land use
designation and density prescribed in the General Plan and will
have no adverse affect on the surrounding land uses in the
area.
B. The proposed project, as conditioned, conforms to all applicable
requirements of the zoning and subdivision codes as well as other
applicable City ordinances.

Tentative Tract Map No. 15648 is in keeping with the provisions
of site plan review (DP No. 98-24), and Chapters 34 and 41 of
the Santa Aha Municipal Code, all of which pertain to the
subdivision of land and development standards for the site.
The project site is physically suitable for the type and density of
the proposed project.
Tentative Tract Map No. 15648 is proposed for a 15.83 acre
parcel of land within the Single Family Residential (Ri) zoning
district. Since the minimum lot size for a Ri parcel is 6,000
square feet, the site has been determined to be capable of
supporting the type and density of the proposed project.
The design and improvements of the proposed project will not cause
substantial environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
No fish or wildlife will be affected by the approval of the map
or by the design and improvements of the project.
Environmental Review No. 98-47 has been prepared for the
project and has identified mitigation measures aimed at
substantially reducing any environmental impacts associated
with the project to insignificant levels. Pursuant to Title
XIV, California Code of Regulations § 735.5(c) (1), after
considering the record as a whole, there is no evidence that
the proposed project will have the potential for any adverse
effect on wildlife resources or the habitat upon which the
wildlife depends. Therefore, pursuant to Fish and Game Code
§ 711.2 and Title XIV, CCR § 735.5(a) (3), the payment of Fish
and Game Department filing fees is not required in conjunction
with this project.
The design or improvements of the proposed project will not cause
serious public health problems.
The design and improvements associated with the project have
been prepared to comply with minimum City standards. The
street system, although to be private and maintained by the
homeowners association, have been designed to public street
standards and will accommodate emergency vehicles. All other
improvements have been designed to mitigate any serious
problems resulting from the project.
The design or improvements of the proposed project will not conflict
with the easements acquired by the public for access through or use
of the property within the project.
Approval of Tentative Tract Map No. 15648 will not create
conflicts with any easements necessary for public access
through the subject property as no such easements currently
exist. All lots located near the existing Metropolitan Water
District easement have been designed to be in compliance with
City standards while having no impact on the existing easement.

2. The mitigated negative declaration for Project No. ER 98-047 is
hereby approved.
3. The Mitigation Monitoring Program attached hereto as Attachment
B and incorporated herein by reference is hereby approved and adopted for
Project No. ER 98-047.
4. Tentative Tract Map No. 15648 is hereby approved,
conditioned in Attachment A, attached hereto and incorporated herein.

Tentative Tract Map No. 15648 is approved subject to compliance, to the
reasonable satisfaction of the Planning Manager, with all applicable
sections of the Santa Aha Municipal Code, the California Administrative
Code, the uniform Fire Code, the Uniform Building Code and all other
applicable regulations.
The applicant must comply in full with each and every condition listed
below prior to exercising the rights conferred by this tentative tract map.
The applicant must remain in compliance with all conditions listed below
throughout the life of the tentative tract map. Failure to comply with
each and every condition may result in the revocation of the conditional
use permit.
Planning Division
The Covenants, Conditions, and Restrictions (CC&R's) for this
project must be reviewed and approved prior to approval of the
final tract map.
The CC&R's must include language that requires all required
landscaping must be installed within a specified time period.
Landscape plans for each residence must be submitted to the
Landscape Associate for approval.

Plans for the main entrance must be submitted to the Case
Planner and Landscape Associate. This element must incorporate
an upscale, high quality design through the use of enhanced

A fencing plan showing the location of all project fencing and

Amenities must be provided within the open space area known as
Lot "B". A list of the amenities must be submitted prior to
receiving building permits.
Ail real estate signage must be removed from the site within one
year from the date of installation. An extension of time may be
granted as determined by the Planning Manager.
7. The final map must be approved and recorded prior to issuance of
building permits.

The final map and all improvements required to be made or
installed by the subdivider must be in accordance with the
design standards and specifications of the Santa Ana Municipal
Code and the requirements of the State Subdivision Map Act.
9. Development within the area of the map is subject to development
and permit fees in effect at the time of permit issuance.

The topography of the project site is relatively flat.
As proposed, the project will not result in any changes
to subsurface geological features. The site had
previously been graded as part of the construction of a
large multi-family apartment project. The nature of the
project will not create unstable earth conditions.

As proposed, the project will involve excavation and
compaction of soils for the construction of the
residences. Impacts related to the displacement of soil
will occur on-site. Implementation of the following
mitigation measures will mitigate impacts to a level of
insignificance.

grading shall be conducted in accordance with plans
prepared by a civil Engineer and based on
recommendations of a soil engineer. Permanent

additional studies shall be done to determine
native elevations and evaluate the extent of

surrounding areas is relatively flat. Changes will occur
with excavation and fill activities for the construction
of building pads. Potential impacts will be mitigated to
a level of insignificance through implementation of

short-term impact occurring only during the construction
phase of the project. Construction related erosion can
be mitigated to a level of insignificance through the

and landscaped areas shall be implemented.
Possible water erosion during construction shall be
mitigated by the installation of temporary erosion

Prior to the issuance of grading permits, the
grading plan shall include a description of access
points to the site and a watering and sweeping
program designed to minimize impacts of haul
operations.
Construction-related erosion is not expected to modify
river or stream channels or the bed of any bays, inlets,
or lakes. The Santa Ana River has been extensively
modified through the installation of concrete banks and
river bed to serve as a flood control system. As a
result, the proposed project will not alter the current
configuration of the stream bed. Construction-related
and long-term erosion can be mitigated to a level of
insignificance.

The potential for earthquakes affects all of Southern
California. There are no active faults on the project
site. This potential impact is not considered a
significant constraint to the development of the project;
however implementation of seismic design provisions for
structural safety will help minimize threats to human
safety in the event of an earthquake.

Ail structures shall be designed in accordance with
the seismic design provisions of the Uniform
Building Codes to promote maximum safety in the
event of an earthquake.

AIR RESOURCES
During construction of the proposed development, air
quality in the local area will be impacted. Short-term
construction-related activities will cause combustion
emissions and fugitive dust to be released from on-site
construction equipment and from off-site vehicles hauling
building materials. Short term impacts will be mitigated
to a level of insignificance. Long term impacts to air
quality may occur but are considered to be cumulatively
insignificant as this site was previously occupied by a
large multi-family apartment project. The cumulative
trips generated by the proposed 72 unit development will
be less than the previous project.

Ail unpaved construction areas shall be watered at
least twice a day during excavation and
construction.
Wheel washers shall be installed where vehicles
exit unpaved roads onto paved roads or wash off
trucks and any equipment leaving the site before
every trip.

WATER RESOURCES
The proposed project will not produce a change in
currents or the course of direction of water movements,
in either marine or fresh waters. The project site is
adjacent to the Santa Ana River; however, no new drainage
is proposed. The site had previously been developed with
