A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
ANA APPROVING USE OF THE PROGRAM ENVIRONMENTAL
IMPACT REPORT FOR THE CIRCULATION ELEMENT OF THE CITY
OF SANTA ANA GENERAL PLAN FOR THE CONSTRUCTION OF
SEVENTEENTH STREET AND LANDSCAPED MEDIANS FROM
BRISTOL STREET TO BROADWAY
WHEREAS, Goal 6 of the Circulation Element of the City of Santa Ana General Plan is to
create attractive circulation corridors to enhance the City' s image; and
WHEREAS, Policy 6.3 of the Circulation Element is to provide landscaped medians on
major arterials; and
WHEREAS, Seventeenth Street is designated in the Circulation Element as a major arterial
with a median.
WHEREAS, Program Environmental Impact Report (EIR) No. 97-02 was prepared in
conjunction with the Circulation Element and certified by the City Council of the City of Santa
Ana; and
WHEREAS, the Program EIR provides that, as new activities implementing the goal,
policies and objectives of the Circulation Element are approved, if the City of Santa Ana finds that
no new impacts would be generated by such activities and that no additional mitigation measures
are required beyond those contained in the Program EIR, the City may approve a project through
the Program EIR; and
WHEREAS, section 15168(c)(2) of the State CEQA Guidelines allow the City to approve
an activity as being within the scope of a project covered by the Program EIR if no new effects
could occur or no new mitigation measures are required; and
WHEREAS, the City Council has reviewed and considered the all information, testimony
and evidence presented, including the findings prepared by the City's Planning and Building
Agency, which conclude that the construction and new landscaped medians are activities that are
contemplated as part of the implementation of the Circulation Element and that all impacts and
mitigation measures, if any, required in conjunction with such activity were addressed in the
Program EIR; and
WHEREAS, the findings and determinations made herein reflect the independent judgment
of the City Council.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTA ANA AS FOLLOWS:
1. Based upon substantial evidence in the record, the City Council finds and concludes
that no new impacts would be generated by the construction of Seventeenth Street and landscaped
medians from Bristol Street to Broadway, and no additional mitigation measures are required,
beyond those contained in the Program EIR for the Circulation Element of the City of Santa Ana
General Plan; and
2. The City Council finds and concludes that all feasible mitigation measures and
alternatives previously identified in the Program EIR have been incorporated into this activity; and
3. The use of the Program EIR for the Circulation Element of the City of Santa Ana
General Plan is approved for the construction of Seventeenth Street and landscaped medians
from Bristol Street to Broadway.
