HomeMy WebLinkAbout98-059 - Sale of Certain Real Property in the South Main Street RedevelopmentRESOLUTION NO. 98- 059 A RESOLUTION OF THE CITY COUNCIL OF SANTA ANA AND MAKING CERTAIN FINDINGS WITH RESPECT TO A DISPOSTION AND DEVELOPMENT AGREEMENT BETWEEN THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA, AND SSF, INC., FOR THE SALE OF CERTAIN REAL PROPERTY IN THE SOUTH MAIN STREET REDEVELOPMENT PROJECT AND APPROVING THE SALE OF SAID REAL PROPERTY UPON THE TERMS AND CONDITIONS CONTAINED 1N THAT AGREEMENT ~EREAS, the ,Community :Redevelopment Agency of the City of Santa Arm (hereinafter referred to as the "Agency") is engaged in activities necessary to execute and implement the Redevelopment Plan for the Santa Ana South Main Street Redevelopment Project; and WHEREAS, in order to implement the Redevelopment Plan, the Agency has agreed, subject to the approval of this Council, to sell certain real property in the Project Area, pursuant to the terms and conditions of that certain Disposition and Development Agreement (hereinaiter referred to as the "Agreement") between the Agency and S SF, INC., which is on file in the office of the Executive Director of the Agency, in which said real property (hereinafter referred to as the "Site") is described; and WHEREAS, the Agreement contains all of the provisions, terms, conditions and obligations required by the state and local laws; and WHEREAS, pursuant to the provisions of the California Redevelopment Law, the Agency and the City Council have held a duly noticed joint public heating on the proposed sale of the Site pursuant to the Agreement; and WHEREAS, the Agency has reviewed and approved a negative declaration prepared with respect to the Agreement pursuant to its obligations as a Lead Agency under the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines; and WHEREAS, the City Council as a Responsible Agency under CEQA has considered the information contained in this negative declaration and finds that it adequately addresses the expected environmental impacts of the Agreement, such that the City Council finds that the negative declaration is adequate for the City's needs in approving this Resolution and the sale of the Site; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWS: 1. The City Council has considered the negative declaration as prepared, certified and approved by the Agency, finds it adequate for the City's use as a Responsible Agency and directs that a Notice of Determination be prepared and filed with the County Clerk of the County of Orange in the manner required by law. 359 360 2. The City Council has considered all terms and conditions of the proposed sale and hereby finds and determines that the sale and the redevelopment of the Site pursuant to the Agreement is in the best interests of the City of Santa Ana and the health, safety and welfare of its residents, and is in accord with the public purpose and provisions of the applicable state and local laws. 3. The City Council hereby finds and determines that the consideration for the sale of the Site pursuant to the Agreement is not less than the fair market value of the Site determined in accordance with the covenants and conditions governing the sale. 4. The sale of the Site by the Agency to SSF, Inc., upon the terms and conditions of the Agreement, is hereby approved. ADOPTED this 8 th day of ATTEST: C~lerk of the Council September ,1998.
