HomeMy WebLinkAbout98-079 - Article XIX Transit Capital Improvement Funds427 RESOLUTION NO. 95-079 A RESOLUTION OF THE' CITY COUNCL OF THE CITY OF SANTA ANA AUTHORIZING THE EXECUTIVE DIRECTOR OF THE PUBLIC WORKS AGENCY TO APPLY FOR ARTICLE XIX TRANSIT CAPITAL IMPROVEMENT FUNDS, AND TO EXECUTE AN AGREEMENT FOR THE USE OF SUCH FUNDS, ON BEHALF OF THE CITY OF SANTA.ANA WHEREAS, the Council has considered certain assurances to the California Transportation Commission (CTC) related to the Santa Arm Regional Transportation Parking Structure project, which are required to be submitted to the CTC as part of its funding application process; and, WHEREAS, the Council hereby makes the assurance that public fixed-route transit will be available to the facility; and, WHEREAS, the Council hereby makes the assurance that the City will provide for security at the facility; and, WHEREAS, the City agrees to own the parking structure and maintain the parking structure at City expense; and, WHEREAS, the City agrees not to charge Amtrak for parking; and, WHEREAS the City intends to use existing local transportation funding for regular operation and maintenance costs; and, WHEREAS, the City will apply for any available funding from the State for major maintenance expenses as they arise; and, WHEREAS, the City has the financial and institutional ability to implement the project and is empowered to: let a contract; to sue or be sued by another entity or person; and to carry out its other responsibilities and duties; and, WHEREAS, this project will be available to the general public, or its primary purpose will be to benefit the public and does not benefit a private entity or individual; and, WHEREAS, the matching funds required for said project are available and committed to this project; and, WHEREAS, if the project exceeds available State funds, the City will provide the additional local funds needed to complete the project, or the project will be reduced in scope; and, WHEREAS, the City will comply with the CTC's Hazardous Waste Identifications and Clean-up Policy for Rail Right-of-Way; and, 429 WHEREAS, this project will be fully investigated by the City to determine the absence/presence of hazardous wastes; and, WHEREAS, the City will take reasonable steps to assure full due diligence, clean- up of the site, as appropriate, as well as not seek State funds for clean-up, damage or liability costs associated with hazardous wastes; and, WHEREAS, the City will comply with the CTC's Timely Use of Funds Policies; and, WHEREAS, no other capital funds previously programmed, planned or approved for rail purposes will be used for other than rail purposes; and, WHEREAS, the proposed project has no unnecessary enhancements and is not an unnecessarily elaborate alternative; and, WHEREAS, the agency shall comply with the State and federal accessibility requirements for the disabled and for providing access to bicyclists. NOW, THEREFORE, BE IT RESOLVED that the Executive Director of the Public Works Agency of the City of Santa Aha is hereby authorized to apply on behalf of the City of Santa Aha, for all funds available to the City of Santa Ana for transit capital improvements and to take all actions and sign all documents pertaining to such application on behalf of the City of Santa Aha, and to execute, on behalf of the City of Santa Aha, an agreement for the use of such funds as may be granted to the City of Santa Am.
