HomeMy WebLinkAbout98-081 - Approving Conditional Use Permit No. 98-07439 RESOLUTION NO. 98- 081 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 98-07 TO PERMIT CONSTRUCTION OF A RECYCLING FACILITYAT 1011 E. PINE STREET WHEREAS, Santa Ana Municipal Code Section 41-472.5 permits construction of a recycling facilities in a M- 1 zone district, subject to a conditional use permit; and WHEREAS, The Planning Commission held a public heating on September 28, 1998, on Conditional Use Permit Application No. 98-07, to allow construction of a recycling facility, located in a M-1 zone at 1011 East Pine Street; and WHEREAS, following approval of the CUP by the Commission, this matter was appealed to the City Council, which on November 16, 1998 held a noticed public hearing to consider said appeals; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the above said heating, the Council finds and determines as follows: That the proposed use will provide the service or facility which will contribute to the general well being of the neighborhood or the community. The recycling facility, as conditioned, will contribute to the general well being of the community by providing a service to handle the recycling needs of the community. Will the proposed use, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The recycling facility proposed will meet the City's requirements for such facilities. Additionally, the conditions of approval help to ensure that the operation of the business is in keeping with the surrounding neighborhood. The abandonment of streets and alleys to facilitate the project will allow the development of occur as the contiguous project and therefore, no negative effects are anticipated to the surrounding area. C. Will the proposed use adversely affect the present economic stability or furore economic 1 44O development of property in the surrounding area? The project as proposed, meets the City's development standards for a recycling facility. The site is currently vacant and the proposed use of the property is consistent with the surrounding area. The deyelopment of this site is in cOnformance with the City's requirements and will help the economic stability of the area. Will the proposed use comply with the regulations and conditions specified in this chapter for such a use? The project meets the City's development standards for the type of use proposed. Specifically, parking, landscaping, fencing and circulation are proposed in compliance with Code. Will the proposed use adversely affect the General Plan of the City or any specific plan applicable to the area of the proposed use? The proposed recycling facility is consistent with and therefore, will not adversely affect the General Plan Land Use designation of Industrial (IND) for the area. 2. Conditional Use Permit No. 98-07 is hereby approved as conditioned in Attachment A, attached hereto and incorporated herein. ADOPTED this 4th dayof January ATTEST: J~ni~ C. Th~ applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division Comply with all conditions and requirements from the Development Review Committee (DRC) for the development project (DP 96-72). Conditional use Permit No. 98-07 shall be reviewed at'siX months, one year, and annually thereafter by the Planning Commission. (Modified by the Planning Colmuission September 28, 1998) Trucks cannot operate in the immediate area between 7:30 a.m. and 3:30 a.m. (ModifJed by the City Cout:cil January 4, 1999) e Truck route to and from the facility will be via Pine Street to Walnut Street to Standard Avenue to First Street. If it becomes necessary to use Chestnut between 7:30 a.m. - 8:30 a.m. or between 2:30 p.m. - 4:00 p.m., due to an emergency, road closure, etc., the recycling facility operator will notify the principals of Walker Elementary School and Roosevelt Elementary School. (Modified by the City Council January 4, 1999) The recycling facility operator will have an employee outmide between 7:30 a.m. - 8:30 a.m. also between 2:30 - 3:30 p.m. to ensure the children's safe passage to school without interference from customers. (Modified by the City Council January 4, 1999) A company representative will meet with each principal of Walker and Roosevelt Elementary Schools twice a year to d~scuss the effectiveness of these policies. Revise the plans to indicate the following: a) Construction of a 10 foot high decorative block wall along all street frontages. b) No exterior telephones. c) No automobile driveway on Pine Street. d) No commercial vehicle parking on Pine Street east of Minnie Street. Prior to issuance of Building permits, complete the following: 8. The lot line adjustment shall be recorded. 9. Abandonment No. 98-2, 3, 4 and 5 shall be approved and recorded prior to the applicant exercising the rights conferred by this conditional use permit. Police Department 1.
