A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
ANA APPROVING TENTATIVE TRACT MAP NO. 15748, CREATING
46 INDIVIDUAL LOTS FOR A LIVE/WORK COMMUNITY LOCATED
AT 201 NORTH MAIN STREET (TTM NO. 15748)
WHEREAS, Tentative Tract Map No. 15748 has been filed to subdivide
an existing 2.4 acre parcel into 46 lots, for the development of a
live/work community located at 201 North Main Street (the "Project"); and
WHEREAS, the design and improvement proposed for Tentative Tract Map
No. 15748 is consistent with the objectives, policies, general land uses,
and programs specified in the City of Santa Ana General Plan; and
WHEREAS, the Environmental Evaluator of the
prepared a mitigated negative declaration and
program for the Project; and

WHEREAS, the Planning Commission of. the City of Santa Aha held a
duly noticed public hearing on December 2, 1998, on Tentative Tract Map
No. 15748, and based thereon, recommended that this Council approve the
map for the Project; and
WHEREAS, this Council held a duly noticed public hearing, on
December 7, 1998, on Tentative Tract Map No. 15748 for the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing,
this Council finds and determines as follows:
The Project, as conditioned, and its design and improvements are
consistent with the District Center designation on the General Plan
and are otherwise consistent with all other elements of the General
Plan.
Tentative Tract Map No. 15748 is consistent with the land use
designation and density prescribed in the General Plan and will
have no adverse affect on the surrounding land uses in the
area.
B. The proposed project, as conditioned, conforms to all applicable
requirements of the zoning and subdivision codes as well as other
applicable City ordinances.
Tentative Tract Map No. 15748 conforms to the minimum street
frontage and lot size requirements, the provisions of Chapters

34 and 41 of the Santa Aha Municipal Code, which pertain to the
subdivision of land, and the provisions of the State of
California Subdivision Map Act.

The project site is physically suitable for the type and density of
the proposed project.
Tentative Tract Map No. 15748 exceeds the minimum lot size for
commercial development within the Central Business District-
Artists Village zoning district. There are no physical
constraints on the site to preclude the proposed live/work
community development.
The design and improvements of the proposed project will not cause
substantial environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
No fish or wildlife will be affected by the approval of the map
or by the design and improvements of the project.
Environmental Review No. 98-060 has been prepared for the
project and has identified mitigation measures aimed at
substantially reducing any environmental impacts associated
with the project to insignificant levels. Pursuant to Title
XIV, California Code of Regulations ~ 735.5(c) (1), after
considering the record as a whole, there is no evidence that
the proposed project will have the potential for any adverse
effect on wildlife resources or the habitat upon which the
wildlife depends. Therefore, pursuant to Fish and Game Code
§ 711.2 and Title XIV, CCR § 735.5(a) (3), the payment of Fish
and Game Department filing fees is not required in conjunction
with this project.

The design or improvements of the proposed project will not cause
serious public health problems.
The design and improvements associated with the project have
been prepared to comply with minimum City standards and have
been designed to mitigate any serious public health problems
resulting from the project.
The design or improvements of the proposed project will not conflict
with the easements acquired by the public for access through or use
of the property within the project.
Approval of Tentative Tract Map No. 15748 will not create
conflicts with any easements necessary for public access
through or within the project.
2. The mitigated negative declaration for Project No. ER 98-060 is
hereby approved.
3. The Mitigation Monitoring Program attached hereto as Attachment
B and incorporated herein by reference is hereby approved and adopted for
Project No. ER 98-060.

Tentative Tract Map No. 15748 is approved subject to
compliance, to the reasonable satisfaction of the Planning
Manager, with all applicable sections of the California
Subdivision Map Act, Santa Ana Municipal Code, the
California Administrative Code, the Uniform Fire Code, the
Uniform Building Code and all other applicable regulations.
The applicant must comply fully with each and every
condition listed below prior to exercising the rights
conferred by this tentative tract map.
The applicant m~st remain in compliance with all conditions
listed below throughout the life of the tentative tract map.
Failure to comply with each and every condition may result
in the revocation of the tentative tract map.

Comply with all conditions and requirements from
the Development Review Committee (DRC) for the
development project (DP 98-33).
Prior to approval of the Tentative Tract Map, complete
the following:
Two copies of the regorded final tract map, and
City approved CC&R's shall be submitted each to the
Planning Division, Building Division, and Public
Works Agency within 10 days of recordation.
The tentative map, final map, and all improvements
required to be made or installed by the subdivider
shall be in accordance; with the design standards and
specifications of the City of Santa Ana and the
requirements of the State Subdivision Map Act.
Ail development within the area of the map is
subject to development and other applicable fees
including permit fees in effect at the time of
permit issuance.
Ail development within the area of the map is
subject to all design and development standards in
effect at the time of building permit plan check
submittal unless said plancheck expires according to
the applicable codes and then subsequent standards
in effect at resubmittal apply.

abandonments, related drainage, utility easements
and recordation of new easements (if any). These
plans must be approved by the city prior to
recordation. Plans should include but are not

III. GEOLOGIC PROBLEMS
The potential for earthquakes affects all of Southern
California. There are no active faults on the project
site. This potential impact is not considered a
significant constraint to the development of the project,
however implementation of seismic design provisions for
structural safety will help minimize threats to human
safety in the event of an earthquake.

AIR RESOURCES
During demolition of the two existing buildings and
construction of the proposed development, air quality in
the local area will be impacted. Short-term
construction-related activities will cause combustion
emissions and fugitive dust to be released from on-site
demolition activities and construction equipment. Short
term impacts will be mitigated to a level of
insignificance. Long term impacts to air quality may
occur but are considered to be cumulatively
insignificant.
Mitigation Measures/Monitoring Required:
In order to prevent dust impacts to the adjacent
areas, following the demolition of the two
buildings, the applicant shall remove the building
debris material from the site within 48 hours.

local, State, and Federal construction noise
regulations.
During construction, buildings and residences adjacent to
the project site may be subjected to noise levels which
exceed State and City Standards as a result of the
proposed project. ImpIementation of the above noise

XI. PUBLIC SERVICES

The proposed project may necessitate an increased demand
for fire and police protection and emergency medical

create significant impacts on schools, parks, and other

Prior to the issuance of a building permit for
Phase I, the applicant shall construct & new 8"
sewer main within the 25' wide "exclusive
underground, non-exclusive public service easement"
in the esplanade arrea and to extend from the
existing main in Main Street to Bush Street with
new manholes to be constructed on both Main and
Bush Streets to accommodate the sewer needs of Lots
I through 14.
10. Prior to the issunace of a building permit for
Phase I, the applicant shall remove the existing 8"
sewer mai~ and construct a new 10" sewer main on
Main Street between First Street and the new
manhole and also construct a new manhole at the
~2~~ of Main and First Streets. The new
10" sewer main to~ be constructed in the same
location and the same slope as the existing 8"
sewer main.
11. Prior to the issuance of a building permit for
Phase II, the applicant shall construct all new 6"
sewer mains within new "exclusive underground, non-
exclusive public service easements", on the
proposed private streets and esplanade easements
throughout the "Phase II" area to accommodate the
sewer needs of Lots 15 through 18, and 29 through
46. Lots 19 through 28 shall be served directly by
~he.~ $treet sewer main and the existing
sewer main between the new manhole to be
constructed on Bush Street and First Street to be
cut, plugged, abandoned or removed.
It is anticipated that the proposed project may result in
alterations to t~heexisting or storm drain systems. The
City's Public Works Agency has reviewed the proposed
project and has not identified a need for new or altered
systems to meet the increased demand for water and sewer
services resulting from this project. No adverse impacts
are anticipated.

to accommodate the water needs of Lots 8 through
14, and also relocating the existing fire hydrant
located on the southwest corner of Bush and 2~
Streets to Bush Street per City Standards and
approved plans.

Prior to the issuance of a building permit for
Phase I, the applicant shall construct a new 6"
water main along the northerly portion of the
proposed "Phase I" area within a new "exclusive
underground, non-exclusive public service
easement", betwee~ Main and Bush Streets to
accommodate the water needs of Lots 1 through 7.

Lots 15 through 18, and relocate the existing fire
hydrant located on the southwest corner of Spurgeon
and 2~ Street to Spurgeon Street per city Standards
and approved plans.

Prior to the issuance of a building permit for
Phase II, the applicant shall construct all new 6"
water mains within the new "exclusive underground,
non-exclusive public service easements", on the
proposed private streets and esplanade easements
throughout the "Phase II" area to accommodate the
water needs of Lots 29 through 46. Lots 19 through
28 shall be served directly by Spurgeon Street
water main.

XIV. CULTURAL RESOURCES
There are no known on-site prehistoric or paleontological
resources. No impacts are anticipated.
Mitigation Measures/Monitoring Required: None Required
The proposed project is located within a historic
district in downtown Santa Aha. The General Plan Land
Use Element, Historic Resources Map identifies the
project area as a historic site. Since currently no
historical buildings exist on the site, there is a
potential for grading operations to uncover historical
remains that could provide information important in
prehistory. Additionally the site is located in an area
of archeological sensitivity. Implementation of the
following mitigation measure from the Land Use Element
will reduce this impact to a level of significance.
Mitigation Measures/Monitoring Required:

The City of Santa Aha shall require the monitoring
of grading operations by a qualified archeologist
when the site is reasonably suspected of containing
such resources. If, as a result, evidence of
resources is found, the property shall be made
available for a reasonable period of time for
salvage or known archeological, resources by
qualified experts, organizations or educational
institutions.
