The meeting was called to order at 7:30 p.m. in the Council Chambers, 217 North
Main Street. Roll call was answered by Councilmen Hubbard, Harvey, Gilmore,
Schlueter, and Mayor Hall. Following the Pledge of Allegiance to the Flag, the
Invocation was delivered by the Reverend Billy Weeda, Camile Christian Church.
MINUTES APPROVAL
Om motion of Councilman Hubbard, seconded
by CouncilmanSchlueter and carried, the
City Council approved the Mi~es of the
Regular Meeting of ~uly l, 1963, as mailed.
STREET RECONSTRUCTION Council received the City Manager's
j~_ report of bids received for the
reconstruction of Anahurst Place,
Broadway to Main (Project C-86); Sixth
Street, Eastside Avenue to Lyon Street
(Project C-87); and Huntzinger Avenue at Harbor (Project C-89). It was moved by
Councilman Hubbard, seconded by Council Harvey and carried, that the report be
received and ordered filed, that the contract be awarded to R. J. Noble Co. at
unit prices bid~ and all other bids be re,acted.

Commission Resolution 5630 recommended approval of Exhibit ~7-B which would

The Clerk reported that proper notice of the hearing had Been given, that evidence

being no response to the Mayor's call for testimony, the hearing was closed.
On motion of Councilmen Hubbard, seccadedby Councilman Gilmore and carried, the
City Council approved the reclassification and instructed the City Attorney to

Boulevard between Main Street and the Newport Freeway. pla-u~E Commission
Resolution 56~ rec~nded denial of the proposal. The Clerk reported that
proper notice of the hearing had been given and that evidence thereto was on file.
The Clerk also reported that c~ications favoring the reclassification had
been received from Leo Herin, 209~ Federal, Costa Mesa, owner of contiguous property
north of subject property; James C. Dodson, Jr., Ina L. Stephens, Robert B. Holland,
and james A. Stephens, owners of adjacent property. Communications ~pposing the
reclassification were received frmathe Piasmad~ae Corporation and frcea LeRoy D.
Owen. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried,
c~unications were received end ordered filed.
Dale Heinly, 611 West Sth Street, attorney for the applicant, stressed the over-
abundance of M 1 zoning which resulted when industries had not located locally as
rapidly as anticipated; the benefit that would result to other property owners
from the sewerage installation; and the increased sales and property taxes paid
to the city. Mr. Heinly also noted that the use would not be incc~apetible with
the Borg-Warner pl~-t, and that the applicant would not object to a CD zone
over]~y.~
Mr. Heinly presented proposed development plans, street layout~ and an aerial
photograph of the area shewi~the proposed sewer installation.
Leo Rovin, 209~ Federal, Costa Mesa, spoke in favor of the rezonim6, saying it
would decrease cc~petition for re~aining industrial property owners.
James A. Stevens of Jasco Materials Co., 2540 So. Main Street, spoke lnfavor of
the C 1 zoning proposed for Main Street as being beneficial to other c~rcial
users. Mr. Stevens also spoke on behalf of Mrs. Lou Stevens, property owner, stating
she favored the proposal.
Ven Stevens, representing the Planning Ccamaission, stated that this was one of a
series of applications represent in g a vast acreage; that the planning C-w--~ssion
did not have all of the exhibits presented to the City Council, nor did they
know of the suggestion for CD zoning; that the P~-~n2 C~-~ssion wished to
consider all the applications for N 1 to residential use at one time because of
the vast acreage involved. An exhibit of such applications prepared by the
PlanuingDepartment was presented.

Mr. Heinly stated it was not reasonable to ask developers to wait for study,
which the planning Cow~ission indicated would be till October, especially since
it would be necessary to default on escrow; that the Planning Commission had all
exhibits except the proposed layout of property; that the Planning staff should
admit the best place to start changing the overabnndance of M 1 property is on
the edges and there is only one industrial plant south of subject property.
Mr. Stevens stated the Planning C~ission preferred a delay until the adoptinn
of the Plan, or a delay until data had been compiled hy the Econc~ic Consultant,
or at least a 90 to 120 day delay for a study of the several applications. Mr.
Heinly objected to the delay, stating it was a policy determination by Council;
that two written objections had been filed, but neither protestant was at the
hearing. There being no further testimony, the hearin~ was closed.
It was moved by Councilm~n Hubbard, seconded by Councilma~ Schlueter, that the
reclassification be denied. Councilman Gilmore stated he would vote against the
motion on the premise that a man has the right to develop his property when he
is ready; that he was in favor of approving the application with a clear under-
standing that he was not committed to any further encroachment of M 1 properties.
Councilman Harvey agreed, stating in addition that the request f~ c~rcial
zoning was on South Main Street which is already co~aercially developed and that
the subject property is et the tail end of the industrial area; that property
owners should not have to wait for the General Plan to complete their developments.
Mayor Hall noted that since the beginning of discussion on the General Plan
there has been a tendency on the part of the Planning Co~mission to postpone
actions; that this is an isolated parcel, not necessarily related to the area
north of Warner or Dyer; that with the restriction of CD zoning he would be in
favor of approving the application, not setting a precedent for other areas.
The motion lost on the following roll call vote:

the adjacent property owners as its width precludes its use as a separate parcel
of land and it could have only nuisance value to others, and authorized the City
Manager to sell the property by direct negotiation.

surplus personal property consisting of houses and apartment buildings acquired

declared the property surplus; and authorized demolition of substandard structures
and sale by public auction on August 13, 1963, of structures that can be moved.
