Roll call was answered by Councilmen Hubbard, Harvey, Gilmore, Schlueter, and ~ayor Hall. Following the Pledge of Allegiance to the Flag, the Iuvocation was delivered by Councils-- Narry Harvey. SPECIAL AWAI~ Lee H. Barger, Santa Ama District Manager of the Automobile Club of $~uthern California, presented to Chief of Police Edward J. Allen a Special Citation for Pedestrian Program Improvement. APPROVAL OF ~u~TES On motion of Councilman Hab~ard, seconded by Councilman Schlueter and carried, the City Council approved as mailed the Minutes of the Regular Meeting of July 15, 1963 and the Special Meeting of July 2~, 1963. REFJSE COT.r.ECTION CouncilmA- Gilmore asked that he be C~£7 disqualified from discussio~ and action ~.~ &~- in the following matter because of a conflict of interest, and left the Council Chamber. Council received the City Manager's evaluation of the three lowest proposals submitted for the collection of garbage and refuse in the City of Santa Ama ia which he stated that all of the companies are adequately financed, have sufficient experience, have adequate performance bonding capacities, present no danger of introducing criminal elements, present no problem of control or willingness to meet standards of operation, and have provided adequate assursace of acceptable equipment. It was the Manager's rec~endation that the contract be awarded to the Great Western Reclamation Company. Dale Heinly, 611 W. 8th Street, attorney representing the Santa Ama Commercial Company, presented the qualifications of the company, and read a letter from Adam Schleining, expressing the belief that the Santa Ama Commercial Company is the lowest responsible bidder. ~r. Heinly showed pictures of E1 Centro garbage truck and alley after pickup was ma~e, and als~ pictures of Santa Ama Commercial plant stressing cleanliness. ~a motion of Councilman Hubbard, seconded by COuncilmAn Schlueter, and carried, the letter was received and ordered filed ~y Council. Robert S. Barnes, 1016 N. Broadway, attorney, spoke on behalf of the Great Western Reclamati~ Ce~pany, c~endin~ the Manager's specifications and investi- gation. Council also heard a statement by Andrew V. Hohn, that he took the South Gate contract at less money than Santa Ama Commercial and was providing satisfactory service. Mayor Hall commended the Santa Ama Commercial Company for the fine Job done for the past eleven years. GASOLINE On motion of Councilman Hubbard, seconded by Councilman Gilmore and carried, Council postponed awarding of bid for furnishing gasoline for fiscal year 1963-64 until August 19, 1963. ELECTRICAL LAMPS On motion of Councilman Hubbard, seconded ~ by Councilman Schlueter ~ud carried, Council received ~ud ordered filed a report of bids received for furnishing electrical lamps for fiscal year 1963-6~; approved award of contract to Electric Supplies Distributing Ce~pauy; and rejected all other bids. APPEAL APPLICATION 9© Mayor Hall opened the hearing on Appeal FACTORY DEVELOI~I' Application 90, filed by Factory Development COP~OP~TION Corporation from the Planning Commission's denial of Conditional Use Pemit 152 to construct a 130,000 sq. ft. discount department store and gas station on M-1 property at the northeast corner of Warner and Harbor Boulevard. The Clerk reported that notice of the hearing was mailed as required by law, and that letters in opposition to the application had been received from the following: Lukens Drive-In Dairies, (James Lukens) 1836 W. Dale Heinly, 611 M. 8th Street, attorney for applicant, referred to the booklet previously furnished to Council, and made the following points: Kilr~y ~wns or controls substantial portion of property in area. Some of proposed uses would be allowed in M-1 District. Proposed development would not create as much a traffic problem as another industrial use because peak hours would differ from industrial uses. Strip zoning would not result since Kilroy controls north side of Warner and Standard Pressed Steel and Segerstrcms control south side. Proposed use would be objectionable in any other zone except agricultural. Advantages of sales, property, and gas tax revenue. Stmflar establishments in industrial areas of other cities have caused no problems. Mr. Heinly noted that proposed plans of frontages and parking layout had been submitted; that two driveway openings would be required on Warner; and that the applicant would object to paying $4,900.00 for the improvement of Harbor Boulevard. Milford W. Dahl, kO1 W. 8th Street, representing C. J. SegerstrCm and Sons, largest single property owner, and industrial occupants in area zoned M-1 on map shown on wall, all of whom objected to the proposal. Ted Adsit, 627 Rock- ford Road, Corona Del Mar, professional planner for Segerstroms, spoke in opposition to the application and presented exhibits as follows: Oranse Count~ Industrial Land Demand - urging the City of Santa Aha to maintain its industrial zoning; noting that the C.M.A. was built in an industrial zone of Anaheim and that recently five of the fifteen industrial plants around it were empty and for lease. Master Plan of Industries in Anaheim - showing plans made to provide for 23 per cent of industrial acreage in Orange County by 1980. Santa Aha Industrial Areas - application is in prime industrial area because of present and proposed freeway locations~ showed areas owned by aPPlicant and Segerstrnm-. Se~erstrom Industrial District - listing ten requirements for developing and promoting an industrial district and submitting that a retail discount department store is undesirable use and detrimental to development of Segerstrem Industrial District. Land Use Aerial Map - showing 12 acres proposed for discount house, remainder of property owned by applicant, and Segerstrem Industrial District. Submitted pictures of Voit Rubber Company, Collins Radio, Micrnm-tic, Western Semiconductors, Standard Pressed Steel Company, and Harbor Boulevard as it is orderly developed in southern industrial area and how it differs from commercially developed northern portion. It was moved by Counc~lm-- Hubbard, seconded by Councilman Schlueter and carried that the pictures be received and ordered filed. Mr. Dahl submitted letters opposing the application from W. J. Voit Company, Standard Pressed Steel, Collins Radio, Colman Electronics, Micromatic, Western Semiconductors, Inc., W. D. Schock Company, R. C. Can C~mpany, and Hallicrafters Company, statiug that they represented all industries in area and that rep- rem~a~e~xma.~. ~.~ ~e f~m~ s~m~z~mg .~-~=rs were present. It was moved by CounciLman Hubbard, seconded by Councilman Schlueter and carried that the letters be received and ordered filed. Mr. Dahl concluded his presentation by asking the Council to follow the conclusion of the Planning Commission, who had studied the matter thoroughly, and deny the application. Mr. Heinly made rebuttal statements regarding the following: The Planning Co~ission report indicated they were not making denial on merits because this was a policy decision for the City Council. If the proposed use of property on the corner of Harbor and Warner is detrimental to industrial area, then the C-1 property owned by Segerstroms is also detrimental; that the breaking down of industrial area is not the issue; that Kilroy desires to maintain the integrity of the industrial area as much as anyone. Regarding the C.M.A. store, that there is only one vacant building ~ecause Mr. Kilroy controls that area. That the proposed operation will not interfere with one of the ten operations listed as requirements for the industrial district. Noted that letters of protests should be within 300 foot radius of application. That the Pl-nning Department and Commission made no recnmmendation as they are in disagreement with respect to location of discount houses. That applicant is entitled to put development someplace. Mrs. Janice Boer, 912 N. Lowell, noted that most housewives do not go to grocery store between 6:30 and 7:30 p.m.~ that the signalized intersection at Warner and Harbor will need a storage area for left turning; and that traffic coming south and coming from the west will be blind. There being no further testimony, the hearing was closed. COUNCIL - 166 - August 5, 1963 It was moved by Cotmcilman Harvey, seconded by Councilman Hubbard that the City Council uphold the action of the Planning Coaaaission and instruct the City Attorney to prepare a resolution denying Conditional Use Permit No. 152. The motion carried with Councilman Gilmore voting "No". Maxwell was going in directly east of property containing 6~ u~its of ~alti-residential development; that regarding schools~ it is the responsibility of school district to provide schools when City provides childrem$ that it will take 20 years to use up presently zoned industrial property; regarding use of OD z~ming, applicant desires architectural control to keep develepmont fr~ becoming detrimental to neighbors; that owner has net been able to sell property for industrial use and is entitled to the reclassifi- cation and urges that C~uncil pass the ordinance to second reading. J. Ogden Narkel spoke in support of Mr. Neinly~s presentation, noting that children would have to be schooled no matter in what part of the City they lived au4 that Irvine C~mpany was going to bring in some 3,500 acres of industrial land within a mile or two santh of the subject property. James A. Stevens, 25~0 S. Main, owner of adjacent property, ccm~auded the Council's decision of July 15th to approve the application. Mayor Nail stated that after taking imto consideration all of the statements and letters involved, he still felt that the integrity of the area had been maintained as applied to Kerr Glass Co.; since this was an isolated piece of property already zoned commercial on Main Street and since the CD District would provide tight architectural controls, he felt this was not an encroachment. C~u~cilman Gilmore stated that while he had heard much regarding the integrity of industrial zone and industry and the contribution of industry, he had heard little about the integrity of the individual and his rights. He felt that it was net Just or consistent for the City to claim it is for the walfare of the whole city amd place the responsibility on one man. Councilman Narvey stated that he concurred with the Mayor and Councilm-= Gilmore, and that the matter had been blown ~p out of proportion giving the c~unity the impression that the Council is not for industry, Jobs, or a solid tax base. Cl~l~ COUNCIL August 5, 1963 He reiterated that the Council is for all of these things and that there has been no policy change. The Council reconvened at ll:40 p.m. with all CounciLmen present. HEARING - AMEND. The hearing was opened on Amendment APP. 260 Application 260 filed by Gerald English ENGLISH to reclassify from the R-1 to the District property on the west side of King Street between 17th and 12th Streets. Planning Commission Resolution 5620 recommended denial of applicant's proposal. The Clerk reported that notice of the hearing was published on July 20, 1963 in The Register, and that letters had been received from Ronald E. Smith, Regional Personnel Manager, State Farm Insurance Companies, stating that the company takes no official position in the matter; from B. W. Robinson and Patricia G. Robinson, 1515 N. King Street, requesting denial of the rezoning; from Irma Dey and Doris Stair, 2015 W. 15th Street, protesting the rezGning. On motion of CounciLman Hubbard, seconded by CounciLman Gilmore and carried, the letters were received and ordered filed, as well as the petition in protest submitted to the Planning Commission. Arthur Nisson, 2012 N. Broadway, representing the applicant, referred to the booklet previously presented to the Council, described the application which was for R-3 but stated the applicant would be agreeable to R-2 as was recommended to the Planning Con~ission in the Planning Staff report. He showed photographs of the area and noted that R-2 development would best benefit the City and neighborhood, providing high type of dwellings to house persons employed in businesses along 17th Street; that traffic on King Street would be reduced from 8,000 to 3,000 cars per day. Speaking to a question from CounciLman Harvey as to the legality of the consideration of R-2, the City Attorney ruled that since it is a higher use and since it was mentioned to the Planning Commission, the City Council can consider R-4 zoning. Walt Brooks, 2002 W. 15th Street, representing the ll6 petitioners in the area shown in red on an exhibit, all of whom opposed the rezoning, noted that King Street is not to become a cul de sac but an elbow, that it carries 8,000 cars a day and will be increased with influx of apartments; the crime rate will increase requiring police and fi~protection and it will not return taxes sufficient to carry this burden; adjacent property owners believe any zoning other than R-1 would be out of order. Regarding the housing of employees of 17th Street businesses, Mr. Brooks stated this is heresay evidence and should not be admitted, and that the paving and improving of King Street will be a burden to property owners, not to developer) suggested that only consideration under a conditional use permit or variance should be given so that adequate control could be exercised. Patricia Robinson, 1515 N. King Street, read a letter opposing the rezoning. M_rs. Janice Boer, 912 N. Lowell, stated that children would have to walk down the middle of the road to go to the Wilson School since King and 15th do not have sidewalks and are narrow. CITY COUNCIL - 17o - August 5, 1963 Mr. Nisson made rebuttal statements regarding the future of King Street, that he referred to comments of the PlsB~ing Staff that King will remain a sixty- foot street with a cul de sac at 8th Street; regarding the traffic that his figures are based on statistics used by the City; regarding street improvements that applicant will dedicate and improve streets adjacent to subject property; that facts on garden apartments do not indicate they become slum areas with transient population. Naomi Pimental, 1509 N. King, asked the Council to retain R-1 zoning or grant a use or variance permit in order to maintain control° Della Troutman, 1338 Fairway, spoke in opposition to the application. There being no iktrther testimony, the hearing was closed. Van Stevens, Senior Planner of the Planning Department, explained that because the homes in this area average $5,000 higher than the average home in Santa Aha, it was felt by the department that the investments of the homeowners should be preserved. Several alternatives were offered to the Planning Commission, the obvious alternative being R-2 zoning. As an alternative to this, R-4 zoning was recommended, which has built-in design and safeguards. However, the Planning Cummission considered it R-1 and recommended that the area remain It was moved by Councilman Harvey, seconded by Councilm~-n Hubbard and carried, that Amendment Application ~60 be returned to the Planning C~ission for further consideration and study with the applicant and neighbors. A~E~D. APP. 457 Mayor Hail opened the hearing on Amendment ER00EB Application 457 filed by Alberta M. Brooks to reclassify from the A-1 to the R-3 District property on the south side of West 5th Street between Harbor and Newhope. Pla~uing Commission Resolution 5636 reccmmended denial of applicant's proposal. The Clerk reported that notice of the hearing was published in The Register on July 13, 1963, and that a petition with 25 signatures protesting reclassification was submitted by Julie Kcmrosky, 4020 W. 5th Street; that a letter was received from the Vutcich family, 4108 W. 5th Street, owners of parcels in this area, stating that they wish to remain in A-1 District pending completion of the General Pla~. It was moved by Councilman Hubbard, seconded by Councilman Schlueter and carried, that the communications be received and ordered filed. Warren Proctor, 115 W. 15th Street, representing the applicant, submitted a petition with 131 signatures in favor of the application. It was moved by Councilman Hubbard, seconded by Counci]m-n Schlueter and carried, that the petition be received and filed. Mr. Proctor stated that the applicant is willing as an alternative to R-3, and because of the time element, to accept controls under CD zoning, if the controls were not so stringent that he could not develop it; also, that the application be amended to delete certain parcels. Mrs. Julie Komrosky, 4024 N. 5th Street and William A. Klos, 4205 W. 5th Street, spoke in opposition to the rezoning. The following spoke in favor of the rezoning: Mrs. Cecilia M. Bailie, 3922 W. 5th Street; Tom Russell, 12342 Adele Street, Garden Grove, owner of 4120 W. 5th; Cruz Barrios, 1418 N. MarLes Drive; and Fred Snell. There being no further response to the Mayor's call for testimony, the hearing was closed. In view of the deletion of parcels from the application and the proposed CD zoning, it was moved by Councilman Hubbard, seconded by Councilman Schlueter, that Amendment Application 457 be referred back to the Planning Commission for re- consideration and rec~endation. Re also read a response by Stanley Bates, Personnel Manager of the Townsend Company. Herbert Burgess, 1706 W. Myrtle, stated in making survey, he noticed no difference in homes of whites and negroes. Council also heard comments in support of the proposals from Mrs. Priscilla McCoy, 11472 Candy Lane, Garden Grove, a member of the Orange County Chapter of the NAACP, and Scotty Williams, 1420 West Third. . Mayor Hall informed the group that as a result of the meetings with the Board of Realtors, Mr. Redman has undertaken the temporary chairmanship tO set up a committee of citizens, representative of the cu~m~uity to study any problems of minority groups. It was the opinion of the City Council that the provisions of the City Charter already prohibited any discr~mfnation because of race, religion or political opinion. Dick Loughlin, speaking for the Santa Ana-Orange-Tustin Board of Realtors, report- ed that the Hl,m,n Relations Committee had met three times with the NAACP, but was no longer effective as a trade association since it is a much broader program than can be covered by two individual organizations; that the Board of Realtors would be opposed to creating a c.~.~-lssion inasmuch as it is a social problem and not legislative. Speaking in favor of the proposals were Richard Pretheridge, 721 S. Goldenwest, Thelma Frame, 621 S. Daisy, Alvin Heiser, 606 S. Townsend, Rev. Vinson, 1205 W. 2nd, and Ray Hawkins, 910 S. Townsend. Charles Schlegel, Santa Aha attorney, objected to an approach from a legislative point, but supported the formation of a volunteer group.
