HomeMy WebLinkAbout99-027 - Approving Tentative Tract Map No. 15805'105 GAS: 5/27/99 RESOLUTION NO. 99-027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE TP~ACT MAP NO. 15805, TO SUBDIVIDE 5 ACRES INTO 20 PARCELS TO ACCOMMODATE 40 PAIRED SINGLE FAMILY ATTACHED ~OMES LOCATED AT 2700 WEST ALTON AVENUE (TTM NO. 15805) WHEREAS, Tentative Tract Map No. 15805 has been filed to subdivide an existing 5 acre parcel into 20 parcels, for the development of a 40 paired single family attached homes located at 2700 West Alton Avenue (the ~Project"); and WHEREAS, the design and improvement proposed for Tentative Tract Map No. 15805 is consistent with the objectives, policies, general land uses, and programs specified in the City of Santa Ana General Plan; and WHEREAS, the Environmental Evaluator of prepared a mitigated negative declaration program for the Project; and the City Of Santa Aha has and mitigation monitoring WHEREAS, the Planning Commission of the City of Santa Aha held a duly noticed public hearing on May 10, 1999, on Tentative Tract Map No. 15805, and based thereon, recommended that this Council approve the map for the Project; and WHEREAS, this Council held a duly noticed public hearing on Tentative Tract Map No. 15805 for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the a~ovesaid hearing, this Council finds and determines as follows: The proposed project, as conditioned, and its design and improvements are consistent with the Low Medium Density Residential land use designation of the General Plan and are otherwise consistent with all other elements of the General Plan and any applicable specific plans. The proposed 40 unit attached single family style project at 7.56 dwelling units per acre is consistent with the Low Medium Density Residential land use designation of the General Plan. The project as designed and conditioned is consistent with all other elements of the General Plan and any applicable specific plans. Bo The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes, as well as other applicable City ordinances. 106 The proposed subdivision, as conditioned, conforms to the minimum lot size and street frontage requirements proposed in SD No. 68 as well as meeting the intent of the R-2 zone, the City's subdivision ordinance and the State of California Subdivision Map Act provisions. The project .site is physically suitable for the type and density of the proposed project. Each proposed parcel exceeds the minimum required lot size and street frontage for SD No. 68. There are no physical constraints on the site to preclude development. A storm drain was provided in the commercial development to the south to accommodate the future development of this site. The site is otherwise relatively flat and regularly shaped. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. No fish or wildlife will be affected by the approval of the map or by the design and improvements of the project. Environmental Review No. 99-01 has been prepared for the project and has identified mitigation measures aimed at substantially reducing any environmental impacts associated with the project to insignificant levels. Pursuant to Title XIV, California Code of Regulations § 735.5(c) (1), after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a) (3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. The design or improvements of the proposed project will not cause serious public health problems. The project design and improvements is not anticipated to cause public health concerns. It is anticipated that the project will be built and sold as a single phased development. This is an in-fill development in compliance with the proposed development standards for this site. The design or improvements of the proposed project will not conflict with easements necessary for public access through or use of the property within the proposed project. The proposed tentative map adjusts or creates all easements necessary for public access and utilities for the proposed project. 2. The mitigated negative declaration for Project No. ER 99-01 is hereby approved. 2 107 3. The Mitigation Monitoring Program attached hereto as Attachment B and incorporated herein by reference is hereby approved and adopted for Project No. ER 99-01. 4. Tentative Tract Map No. 15805 is hereby approved, as conditioned in Attachment A, attached hereto and incorporated herein. ADOPTED this 7th day of June , 1999. The applicant must comply in full with each and every condition listed below prior, to exercising the rights conferred by this tentative t~act map. ' ''' Conditions of Approval A. Planning Division Project landscaping is reql/ired to be maintained to the minimum size and quantities of the approved plans. Two copies of the recorded final parcel or final tract map, lot line adjustment and/or City approved CC&R's shall be submitted each to the Planning Division Building Division, and Public Works Agency within l0 days or recordation. The tentative map, final map and all improvements required to be made or .installed by the subdivider shall be in accordance with the design standards and specifications of the City of Santa Ana and the requirements of the State Subdivision Map Act. Ail development within the area of the map is subject to development and other applicable fees including permit fees in effect at the time of permit issuance. o Ail development within the area of the map is subject to all design and development standards in effect at the time of building permit plan check submittal unless said plan check expires according to applicable codes and then subsequent standards in effect at resubmittal apply. The final tract map must be approved and recorded prior to issuance of building permits. The project design shall comply with Site Plan Review DP No. 98- 113. The CC&R's and condominium plan for this project must be approved prior to approval of the final tract map· The CC&R's and condominium plan shall be recorded with the final map and prior to the issuance of the first building permit. 110 10. Ail utilities within the project shall be underground excluding the main overhead lines on Alton Avenue. Ail streets are to be posted as "private streets".
