RESOLUTION NO. 99-039
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING CONDITIONAL
USE PERMIT NO. 99-08 TO ALLOW PARKING
FOR AN ADJACENT COMMERCIAL USE LOCATED
AT 2040 SOUTH CYPRESS AVENUE
WHEREAS, the Planning Commission held a public hearing on
April 26, 1999, on Conditional Use Permit Application No. 99-08,
to allow parking adjacent to a commercial use located at 2040
South Cypress Avenue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Council finds and determines as follows:
Will the proposed use provide a service or facility which
will contribute to the general well being of the neighborhood
or community?
The proposed parking lot for Kely's Auto Body will
provide additional parking opportunities for a project
that is in an area that currently has a severe parking
shortage. Due to the growth in the bus±ness and the
physical constraints of the existing si~e, the parking
provided no longer meets the needs of the bus~ness
located on the premises.

Will the proposed use under the circumstances of the
particular case be detrimental to the health, safety or
general welfare of persons residing or working in the
vicinity?
The proposed parking lot has been designed to minimize
impacts to the surrounding residential uses. For
instance, a wall of trees and shrubs are proposed along
the north and south property lines, thereby enclosing
the parking lot project. In addition, vehicular access
is not permitted on Cypress Avenue, which will also
minimize adverse impacts.

The development of the site with a parking lot will
enhance the economic viability of the area as this use
will replace a vacant parcel of land that was
previously approved for an apartment project.

Will the proposed use comply with the regulations and
conditions specified in Chapter 41 of the Santa Ana Municipal
Code for such use?
The proposed parking lot will meet and exceed all
applicable provisions of Chapter 41 of the Santa Aha
Municipal Code, including landscaping, setbacks and
circulation.
Will the proposed use adversely affect the General Plan or
any specific plan of the City?
The proposed project will not adversely affect the
General Plan as an ancillary use such as a parking lot
is permitted within the Low Density residential (LR-7)
'designation.
2. Conditional Use Permit No. 99-08 is hereby approved as
conditioned in Attachment A, attached hereto and incorporated
herein.

Conditions for Approval
Should Conditional Use Permit No. 99-08 be approved, the project shall
comply with all applicable sections of the Santa Ana Municipal Code, the
California Administrative Code, the Uniform Fire Code, the Uniform
Building Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed
below prior to exercising the rights conferred by this conditional use
permit.
The applicant must remain in compliance with all conditions listed below
throughout the life of the conditional use permit. Failure to comply with
each and every condition may result in the revocation of the conditional
use permit.
A. Plannina D~vis~on
Ail proposed site improvements, including all landscaping as
shown on the site plan, must conform to the Site Plan Review
approval of DP No. 97-76.

Any amendment to this conditional use permit must be submitted
to the Planning Division and Police Department for review. At
that time, staff will determine if administrative relief is
available or the conditional use permit must be amended.
The storage of vehicles is not to exceed 72 hours. The repair
of voh[cles is prohibitsd. Tho parking of inoperable vehicles
Ss prohibited. The lot is intended for customer and employee

The row of trees along the north and south property line must
be planted at a maximum rate of five feet on center.
The conditional use permit becomes null and void if the city
Council does not approve Zoning Ordinance Amendment No. 99-02.
This conditional use permit will not become effective until 30
days after the second reading of the ordinance approving Zoning
Ordinance Amendment No. 99-02.
A covenant or easement, in a form acceptable to the city
Attorney, allowing access and egress over the Main Street
parcel to the benefit of the Cypress parcel must be recorded
prior to the issuance of any permits or the exercise of any
entitlement under this conditional use permit.

The Cypress Avenue parking lot may only be utilized by a
business occupying 2037 ~,i South Main Street. No other
property along Main Street may use this site for parking of
vehicles. (Modified by the Planning Commission April 26, 1999)

Visibility corridors, using wrought iron, must be maintained in
the fencing along Cypress Avenue.
The existing buildings addressing and lighting must be brought
into compliance with the City of Santa Ana's Building Security
Ordinance.
Install a gate between the two buildings on the Main Street
property to limit access to the Cypress Avenue parking lot
after business hours. Said gate is to be locked with a Knox
locking device during non-business hours.

Replace damaged curb, and a two-foot strip of asphalt concrete
paving on Cypress Avenue per city Standard.
2. Replace the damaged sidewalk on Cypress Avenue per City
Standard.
Close the existing drive approach on Cypress Avenue with a new
sidewalk, landscaping and curb per City Standard and a two foot
strip of asphalt concrete paving.
