September 3, 1963
The meeting was called to order at 7:30 p.m. in the Council Chambers, 217 North
Main Street. Roll call was answered by Councilmen Royal E. Hubbard~ Harry Ho
Harvey, James Gilmore, Henry H. Schluater, and Mayor A. Allen Hall. Following
the Pledge of Allegiance to the Flag, the Invocation was delivered by the
Reverend Fred Niedringhaus, Congregational Church.

On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, the
City Council approved the Minutes of the Regular Meeting of August 19, 1963 with
the addition Just read, and the Adjourned Regular Meeting of August 19, 1963,
held August 26, 1963o
SURPLUS PROPERTY Mayor Hall announced the sale by oral
bidding of two parcels of surplus
property at the northeast corner of
First and Santa Fe Streets, described
in Surplus Property Reports 41-63 and 42-63. Following the call for bids on
Parcel No. i with a minimambid of $7,500, only one bidwas made. After three
calls for additional bids, Mayor Hall declared Parcel No. i sold to H. D.
Howell, llO1 East First Street, for $7,500. Mr. Howell deposited with the Clerk
of the Council $750 cash and signed a Statement of Bid required by the terms
of the saleo
Mayor Hall called for bids on Parcel No. 2 with a mini~umbid of $17,500~ Hearing
no bids, aTter three calls, the Mayor declared, that no sale had been c~nsummated
and referred the matter back to the Staff~

filed a report of bids received for
the construction of a storm drain in Huntzinger Avenue between the Pacific
Electric Railroad and the D-3 Channel - Project D-45; approved award of contract
to James A. Moran Construction Co. in the amount of $~5,413.12 at unit prices;
and rejected all other bids.

Mayor Hall opened the hearing on Amendment
Application 463 filed by Arthur Pliant to
reclassify from the R i to the C 5 District,
property on the south side of 17th Street,
Planning Commission Resolution 5645
recommended denial of applicant's proposal. The Clerk reported that notice
of the heariug was p,~blished ~n The Register on August 24, 1963, and that no
written communications or d0Jections had been received.
Mr. Ralph A. Dilemmas, 18022 0akridge Drive, co~-owner of the property, requested
that Council grant the reclassification, noting the difficulties in keeping
renters due to traffic noise; the change of more and more surrounding property
to commercial; and their plan to remove a garage to provide ten parking spaces.
Dean Evans of the Planning Department, informed Council of the Commission's
policy to recommend two lots to orient property to the Eo~ 17th Street commercial
area. Mayor Hall cited the parking problems created on West 17th Street prior
to the adoption of such a policy. There being no further testimony, the hearing
was closed.
It was moved by Cotmcilman Hubbard tha~ the C$uncil deny the reclassification
as recommended by the Planning C~mnissiono Motion lost for lack of a second.
It was moved by Councilman Harvey, seconded by Councilman Gilmore, that the
Council approve the reclassification and instruct the Attorney to prepare an
amending ordinance according to Exhibit AA 463. Councilman Schlueter stated
he thought original motion was to approve° The motion failed on roll call

Mr. Delbert Michael, 917 S. To:~d Avenue, President of the Homeowner's Protective
Association of Southwest Santa Ama spoke in opposition to the rezoning. Mrs.
Made].yne Cenkar, 806 S. Ridge Drive, Secretary for the Homeowner's Association
presented petitions opposing; stated that Prudential Insurance Company, holders

of the first mortgage o~ the homes in area and Mr. Sidney Calof, Beverly Hills,
second loan holder would help in any way to prevent the rezoningo Mr. Arturo
M~reno, 690 S. Corta, and Mr. Ralph W. Hook, ~922 W. Light, spoke against the
rezoning. The petitions were received and ordered filed on motion of Couneilm-u
Hmbbard, secoaded by C~cilma~ Schlueter and carried. There being no further
testimony, the hearing was closed.

Amendment Application 466 was denied as recommended by the Plamuing Commissi~ao
AMEND. APP. ~8 Mayor Hall opened the hearing on
KLA~ Amendment Application ~68 filed by
Johnny Klassen to reclassify property
on the north side of McFadden between
Harbor and Newhope from the A 1 to the R 2 District. Planning Commission
Resolution 5646 recmmmended approval of Exhibit AA ~68 A. The Clerk reported
that notice of the hearing was published in The Register on August 24, ~196~,
and no written c~ama~nications or objections had been received.
Mr. La~-y Golden, 110 W. First Street, spoke on behalf of the applicant stating
that $26,500 duplex buildings were planned for that area.
Mr. Delbert Michael, 917 S. Toland speaking for the Homeowner's Association amd
families in area stated they wanted assurance that the buildings would not in
any way depreciate the value of their homes. Mr. Frank E. Rorpel, Jr., 1620
Kent Lane, Newport Beach, assured him that he, himself, wanted a good return
for his investment in the ~uilding of the duplexes, therefore, they would not
depreciate the area.
Mr. ArturoMoreno, 6BO S. Corta asked if any possibility of a variance could be
put in under R 2. Mayor Hall replied not under thi~ application° Mr. Golden
noted a portion of property is already R 2. Mrs. M. Cenkar~ 806 S. Ridge Drive,
said if the duplexes were built as stated, and not two-story buildings they
were in favor of them.
On motion of Councilman Hubbard, seconded by Councilman Gilmore and carried,
Council approved the reclassification and instructed the City Attorney to
prepare an amending ordinance according to E~hibit AA ~68A.

24, 196B, and no written communications or objections had been received.
Mr. John J. Elliott, 9~86 Garden Grove Boulevard, Garden Grove, representing
the applicant, requested Council concur in findings of Planning Commission
and rezone property as recummended.
On motion of Co~ncilmau Hubbard, seconded by Councilman Harvey and carried,
Council approved the reclassification and instructed the City Attorney to prepare
an amending ordinance according to Exhibit AA 469 ~.

Mrs. L~mie Beer spoke in regard to her letter asking whether OD zmain6 is legal
or not; asked that the m~utes of tonight's meeting show that her letter of
July 26 be filed under Sakioka application; if it was legal to allow C 5 uses
under the guise of CD; wanted the Ashton-Priess, Tustin Pr(~erties and
~ applications looked up to see if they were passed before the 0D amend-
merit became effective.
The Mayor directed the Clerk to place Mrs. Boer's letter of ~uly 26, 1963 in
the Sakioka file, commented that the City Attorney and Planning Director were
reviewing the recent CD District amendment, and instructed the City Attorney to
check the Ashton-Priess, ~-,stin Properties, and Carson amendment application
files for legality of Council action.
