HomeMy WebLinkAbout99-057 Not Adopted RESOLUTION NO. 199 A RESOLUTION OF THE CITY O CITY OF SANTA ANA APPRO''ING VARIANCE NO. 99-06, FOR RELIEF FROM CERTAIN PROVISIONS OF THE SIGN CODE RELATED TO OVERALL HEIGHT, LINEAL FOOTAGE AND SIGN AREA OF A MONUMENT SIGN LOCATED AT 3301 SOUTH BRISTOL STREET WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Ana Municipal Code, upon making certain findings; WHEREAS, the Planning Commission held a public hearing on July 12, 1999, on Variance Application No. 99-06, for relief from the sign code for height, lineal footage and sign area; and WHEREAS, the City has determined that, as required pursuant to the Califomia Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Categorical Exemption adequately addresses the expected environmental impacts of the Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence, both oral and written, submitted at the public heating held this date this Council finds and determines as follows: Ao That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the Municipal Code; The granting of a variance, as conditioned, will allow the monument sign to exceed sign limits, while limiting any additional signs on-site. The approval to allow the monument sign to exceed the maximum height, lineal footage and sign face area, as conditioned, would not jeopardize the intent of the code to reduce sign clutter. B. That the granting of a variance is necessary for the preservation and enjoyment of 362 Resolution 1999-057 Page 2 of 3 one or more substantial property rights; As conditioned, the subject site will reduce the number of signs displaying advertisements for the gas station. Approval of the monument sign variation, as conditioned, would not prohibit the identification of the business in an aesthetically appealing manner. The conditions of approval help to offset the size of the monument sign by limiting the number of signs. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property; Granting a variance, as conditioned, will not be detrimental to the public and surrounding properties by allowing the proposed signage to exceed the size limits for monument signs. The approval requires the applicant to remove a number of secondary signs, including building identification and advertising signs, on the subject site. The reduction of signs will visually enhance the service station property and the surrounding visual environment. That the granting of a variance will not adversely affect the General Plan of the City; The granting of the variance as conditioned will not adversely affect the City's General Plan land use designation for the area because the approval requires the applicant to remove a number of secondary signs, including building identification and advertising signs, on the subject site. 2. Variance No. 99-06 is hereby approved, as conditioned in Exhibit A, attached hereto and incorporated herein by reference, and based upon the aforementioned findings. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this site plan review approval. The applicant must remain in compliance with all conditions listed below throughout the life of the development project. Failure to comply with each and every condition may result in the revocation of the site plan review approval. A. Planninq Division No other signs or displays of any kind, including but not limited to additional price signs, Chevron logos and identification, banners, flags, pennants, streamers, window signs, sale signs, advertisements, spandrel (spanner) signs, advertising boxes on light standards, car wash or other vehicular directional signs, etc. will be permitted. Only those identified in a through e below are allowed: a) One monument sign (freestanding) sign which includes the "Chevron" logo, the words "Fast Pay", gasoline and diesel fuel pricing, and the address. The monument sign must not exceed 13 feet 2 h inch in overall height, 18 feet 10 h inches in lineal feet and 49 square feet of advertising area. b) One "Chevron" sign located on the west elevation of the canopy. c) One small Chevron logo located on the north elevation of the canopy. d) One "Food Mart" sign over the entrance to the building. e) Four "Self" signs located on the edge of the spandrels. ATTACHMENT A 366 RESOLUTION NO. 99- 0 5 7 SEPTEMBER 7, 1999 PAGE 2 OF 2 Place the freestanding monument sign in a diagonal direction to allow price visibility from Bristol Avenue and Alton Avenue. Also, provide 4 feet of landscaping around the entire monument sign. Also, extend the existing planter along Bristol Avenue 3 feet to the east while maintaining 20 feet for the drive isle. Remove the unpermitted exterior telephones from the site or apply for an Exterior Telephone Land Use Certificate. Remove the unpermitted air/water unit from the site or provide a parking space designated for the air/water location. Submit a landscape plan for approval by the Install and maintain the landscaping per the plan.
