HomeMy WebLinkAbout99-061 - Denying Variance No. 99-07377 GAS: 9/16/99 RESOLUTION NO. 1999-061 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DENYING VARIANCE NO. 99-07, SEEKING RELIEF FROM CERTAIN PROVISIONS OF THE SIGN CODE RELATED TO OVERALL HEIGHT, LINEAL FOOTAGE AND SIGN AREA OF A MONUMENT SIGN LOCATED AT 4505 WEST FIRST STREET WHEREAS, Santa Aha Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Aha Municipal Code, upon making certain findings; and WHEREAS, this Council held a hearing on September 7, 1999, on Variance Application No. 99-07, seeking relief from the sign code for height, lineal footage and sign area. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: ao That because of special circumstances applicable td the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the Municipal Code. There are no special circumstances applicable to the property located at 4505 West First Street which, due to the size, shape, topography, location or surroundings, would deprive the property owner of privileges not otherwise at variance with the intent and purpose of the provisions of the Santa Ana Municipal Code. B o That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights. The sign variance is not necessary for the preservation and enjoyment of one or more substantial property rights. The property currently has adequate signage and the applicant is seeking a variance to consolidate the signs into a bigger sign at variance with the code. Granting a variance will not be detrimental to the public and surrounding properties by allowing the proposed signage to exceed the size limits for monument signs. D. That the granting of a variance will not adversely affect the General Plan of the City.
