Roll call was ~nawered by Councilmen Royal E. Hubbard, Harr~ H. Harvey, James Gilmore, Henry H. Schlueter, and Mayor A. Allen Hall. Following the Plebe of Allegiance to the Flag, the Invocation was delivered by the ReveremA George Bm~diecker~ St. Peter's Lutheran Church. On mo~ion of Councilman Hubbard, seconded by Councilman Schlueter and carried, the City C~Ancil approved as mailed the Minutes of the Regular Meeting of September 3, 1963. Bl~ AWARD STREET On motion of Councilman Hubbard, seconded MAInTenanCE UNIT by CounciLman Schlueter and carried, Council received and ordered filed a report of bids received for furnishin~ one ce~l~lete Street Mainte-a-ce Unit consisting of a 22,000 G. V. W. Rated Truck Chassis, 1~ B~, Emulsion Sprayer and other related items; approved award of contract to International Harvester Company in the amount of $8,731.5~; an~ rejected all other bids. BID AWARD - 'r~o~ On motion of Councilman Hubbard, seconded by Councilma- Schlueter and carried, Council received and ordered filed a report of bids received for furnishing one truck - 19,500 G. V. I~. Rating (Cab and Chassis only); approved award of contract to International Harvester C~mpany in the amount of $2,836.34; and rejected all ~ther bids. BID AWARD - R(%~-?-~ On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, Council received and ordered filed a report of bids received for furnishing one Tande~ Maintenance Roller; approved award of contract to M. P. McCaffrey, in the amount of $~,$57.00; and rejected all other bids. JR/J APPEAL APP. 91 Mayor Hall opened the hearing on Appeal Application 91 filed by A. H. Gallardo from the P]~ming Commission's approval of Variance Application 1802 (American Pipe and Construction Cceapa~y) to construct a 72 foot high concrete hatching facility and a storage eleveter at 2501 West Fifth Street. The Clerk reported that notice of the hearing was given by the pi---ins Department and that no objections had been received. The Clerk reported that a letter dated September 13, 1963 had been received fram Peter Van Fmu-am, Division ~anager of the American Pipe and Construction C~mpany, requesting & four-week contin---ce to permit time to analyze econ~aic factors involve~ in ~roving the property. The appellant, Mr. Gallardo, agreed to the cantinuance. CTFf COUNCIL - 203 - September 16, 1963 On motion of CounciLman Hubbard, seconded by Councilman Harvey and carried, the hearing was continued to November 4, 1963, 7:30 p.m. in the Council Chambers. HEARING - Mayor Hall opened th~ nearing on A. A. 460 Amendment Application ~60 filed by ENGLISH Gerald English to reclassify from the R 1 to the R 3 District property on the west side of King Street between 17th and 14th Streets. On August 5, 1963, after public hearing, Council referred the matter back to the Plan~tng C~,w, tssion for reconsideration and rec~w, endation, and on August 12, 1963 applicant verbally amended application to request R ~ instead of R 3. The Clerk reported that notice of the hearing was properly given aud evidence thereof was on file, and that no written communications or objections had been filed. Arthur Nisson, 2014 North Broadway, attorney for the applicant, stated that a satisfactory compromise had been achieved between the developers and adjacent property owners, and that the Planning C~ission now recommended R ~. He urged the speed-up of improvements on King Street by elbowing the street at Washington Street. Walter Brooks, 2002 West 15th Street, spokesman for the original protestants, stated that his group was in favor of the R 4 zoning and would trust to the integrity of the Planning Cvmmission and builders in carrying out the stipulated conditions on file. Bill Robinson, 1515 North King Street, spoke in opposition, and stated that if C~A~cil approved the reclassification, he rec~ended the following conditions: (1) that a six foot solid wall be erected along King Street to the east side of the property and along the area which is presently zoned for duplex on the south; and (2) that no entrance be made to enter opposite an existing residence. There bei~ no further testimony, the hearing was closed. It was m~ved by Councilman Hubbard and seconded by Councilman Harvey and carried, that the City Council approve the reclassification and instruct the City Attorney to prepare an amending ordinance according to Exhibit AA ~60 C. HEARING - ZONING Mayor Hall opened the hearing on the ORD. AM~tD. RE. Planning Commission Resolution 56~, NEWBPAPER~ES recommending an amendment to Section 9230.261 to add the publicati~u and circulation of newspapers as a permitted use in the C 5 District. There being no response to the call for testimony, the hearing was closed. On motion of Coumcllm-~ Hubbard~ seconded by Councilman Schlueter and carried, the Council approved the proposed amendment and instrmcted the City Attorney to prepare an appropriate amending ordinance. w~ARING - BRISTOL & Mayor Hall opened the heari~ on the GARDEN GROVE FRY. proposed annexation of territory S. The Clerk reported that notice of the hearing was published and mailed as required by law, that evidence thereof was on file, and that no written protests had been received. There being no response to the call for testimony, the hearing was closed. On the request of the Blind Service Center, the Attorney reported that the operation as described in the application would not require a license by the City. It was moved by Councilman Hubbard, seconded by Councilman Schlueter and carried, that the map and dedications thereon be accepted and that execution of the subdivision agreement be authorized. WATER METER Mayor Hall appointed Councilmau Schlueter~ INSTALLATION Councilman Gilmore, and htmcelf, to stud~ with the City Manager and Public Works Director the possibility of allowing bonds to be posted in lieu of cash, guaranteeing the installation of water meters.
