HomeMy WebLinkAbout99-068 - Amend Resolution No. 91-066RESOLUTION NO. 1999-068 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA TO AMEND RESOLUTION NO. 91-066 TO ALLOW INCUMBENTS IN THE MIDDLE MANAGEMENT CLASS OF FIRE BATTALION CHIEF (MM) TO RECEIVE SPECIAL SHIFT REPLACEMENT PAY. WHEREAS, Section 1004, Article X of the City Charter of the City of Santa Aha requires the City Manager to prepare, install and maintain a position classification and pay plan subject to civil service roles and regulations and the approval of the City Council; and WHEREAS, on July 1, 1991, the City Council passed and adopted Resolution No. 91- 066, re-establishing the Basic Classification and Compensation Plan for classes of employment designated as unrepresented executive and middle management; and on January 2, 1996, passed and adopted Resolution No. 96-007, which designated the existing class of Fire Battalion Chief as un_represented middle management; and WHEREAS, a major goal of the Fire Department is to provide the City and its residents the highest level of emergency management command and control, on a 24 hour basis; and WHEREAS, to achieve this consistently high level of command and control, three incumbents in the classification of Fire Battalion Chief (MM) are assigned the duties of Watch Commander on three rotating 24 hour shifts, thus ensuring that a qualified fire command officer is on duty at all times; and WHEREAS, to provide continuous qualified coverage when a Fire Battalion Chief (MM) is absent, the Fire Chief proposes that off-duty Fire Battalion Chiefs be given the opportunity to work replacement shifts and receive special shift replacement pay; and WHEREAS, it is now desired to amend Resolution No. 91-066 to add this provision. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. That Section 5 of Resolution No. 91-066, as amended, is hereby further amended by adding a new Subsection 15, to read as follows: "5.15 Special Shift Replacement Pay for Fire Battalion Chief (MM). Off Duty incumbents in the class of Fire Battalion Chief (MM) who are assigned by the Fire Chief to a twenty-four (24) hour work shift to replace another Fire Battalion Chief (MM) who is on sick leave, vacation, bereavement leave, or other approved absence, will receive an amount equivalent to straight time pay for the entire shift, regardless of the actual number of hours worked. This practice shall conform to the following guidelines: a. Special Shift Replacement Pay will be calculated by multiplying 24 hours times the hourly rate of pay for Fire Battalion Chief, E step, regardless of the salary step of the affected incumbents. This Special Shift Replacement Pay may be subdivided to reflect a 12-hour payroll day. Resolution No. 19 9 9 - 0 6 8 Page 2 of 2 b. Shift exchanges between two incumbents of the class of Fire Battalion Chief (MM) will not qualify for Special Shift Replacement Pay under these provisions. c. Under no circumstances will Special Shift Replacement Pay be construed as "overtime pay," as defined under the Fair Labor Standards Act." 2. That except as amended by this Resolution, all other provisions of Resolution No. 91-066, as amended, shall remain in full force and effect. 3.
