HomeMy WebLinkAbout99-075 - Approving Tentative Parcel Map No.99-110Resolution No. 19994)75 Page 1 of 3 GAS: 11/17/99 RESOLUTION NO. 1999-075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE PARCEL MAP NO. 99-110, TO SUBDIVIDE AN 11.77 ACRE LOT INTO 12 PARCELS LOCATED AT 618 EAST WELLINGTON AVENUE AND 616 NORTH SANTIAGO STREET (TPM NO. 99-110) WHEREAS, Tentative Parcel Map No. 99-110 has been filed to subdivide an existing 11.77 acre parcel into 12 lots, located at 618 E. Wellington Avenue and 616 North Santiago Street (the "Project"); and WHEREAS, the design and improvement proposed for Tentative Parcel Map No. 99-110 is consistent with the objectives, policies, general land uses, and programs specified in the City of Santa Ana General Plan; and WHEREAS, the Environmental Coordinator of the City of Santa Aha has prepared a Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 99-116, pursuant to the California Environmental Quality Act ("CEQA"), for the Project; and WHEREAS, the Planning Commission held a duly noticed public heating, on November 8, 1999, on Tentative Parcel Map No. 99-110 for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Cotmcil finds and determines as follows: The proposed project, as conditioned, and it's design and improvements are consistent with the Industrial land use designation of the General Plan and are otherwise consistent with all other elements of the General Plan and any applicable specific plans. The proposed subdivision will create 12 parcels from 11.77 acres, including abandon railroad right of way and surplus property to facilitate the construction of 9 industrial buildings. The current general plan land use designation of Industrial for the area will not change as a result of the project. The zoning designation of parcel 12 will change from multiple family residence (R3) to Light Industrial (M1) which will bring the zoning into conformance with the general plan designation of Industrial for the area. The project is designed to accommodate Resolution No. 1999-075 Page 2 of 3 two specific plan street alignments which were previously approved by City Council. The proposed subdivision is conditioned in conformance with the City's General Plan. The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes, as well as other applicable City ordinances. The proposed subdivision conforms to the provisions and intent of the State of California Subdivision Map Act, the City of Santa Ana's Industrial Development Standards, and all other applicable City ordinances and zoning requirements. The project site is physically suitable for the type and density of the proposed project. The proposed subdivision is approximately 11.77 acres and is a combination of vacant land and industrial buildings and uses. The proposed lot configuration meets the City's minimum lot size and street fi'ontage requirements and is suitable for the industrial project as proposed. The City's General Plan allows a development intensity of 0.45 floor area ratio (FAR). The intensity of the proposed development ranges from a 0.38 FAR to a 0.45 FAR in accordance with the City's General Plan. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. An Initial Study and Negative Declaration ("ND") was prepared, pursuant to the California Environmental Quality Act. After the implementation of mitigation measures, no significant environmental impacts would result from the project. The subject property is a combination of vacant land and industrial uses and buildings. The site is located in a highly urbanized area. As stated in the ND, "The project site is primarily vacant. It is devoid of vegetation with the exception of scattered non-native trees. There are no plant or wildlife species or biological habitats on the project site that are considered sensitive at either the federal, state, or local level." The proposed project would not cause environmental damage, or any injury to wildlife or it habitat. The design or improvements of the proposed project will not cause serious public health problems. 2 RESOLUTION NO. 99-0_7_5 NOVEMBER 8, 1999 PAGE 1 OF 4 Conditions of ADDroval Vesting Tentative Parcel Map No. 99-110 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Aha Municipal Code, the State of California Subdivision Map Act, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this approval. The applicant must remain in compliance with all conditions listed below throughout the life of the vesting tentative parcel map. A. Buildinq Division Should the applicant elect in the future to have a common four-hour fire-resistive wall, the following conditions (also in letter dated September 27, 1999) shall become a part of the Covenants, Conditions and Restrictions for the subject property: a) There shall be no penetrations, including small pipes, in the four-hour fire-resistive rated common wall. b) The four-hour fire-resistive rated common wall shall extend a minimum of 30 inches above the adjacent roofs. c) The building on each side of the four-hour fire-resistive common wall shall be designed and constructed to be structurally and functionally independent. d) The above conditions shall be recorded as part of the Covenants, Conditions and Restrictions for the subject development and shall run with the land and be approved by the City of Santa Ana's Building Official and City Attorney's office. e) The subject CC&R's shall include a provision which requires any modification of said CC&R's to be approved by the City of Santa Ana's Building Official. ATTACHMENT A ~438 RESOLUTION NO. 99- 0 7 5 NOVEMBER 8, 1999 PAGE 2 OF 4 f) The subject CC&R's shall be recorded with the County of Orange prior to the Building and Safety Division's approval of construction drawings for building permit issuance. Fire Department Prior to construction, any identified underground storage tanks on parcels 1-12 shall comply with Santa Aha Fire Department underground storage tank regulations. Plannina Division The project shall follow all mitigation measures as in the Mitigation Monitoring program required Mitigated Negative Declaration ER 99-116. outlined through 2 o Billboards on parcels 3 and 4 shall be removed as indicated by-~ the applicant on the approved site plan. The abandonment of Vance Street shall be completed prior to approval of the final map. Two copies of the recorded final vesting parcel map, and City approved CC&R's shall be submitted each to the Planning Division, Building Division, and Public WorKs Agency within 10 days of recordation. The vesting tentative parcel map, final map, and all improvements required to be made or installed by the subdivider shall be in accordance with the requirements and design standards and specifications of the City of Santa Ana and the requirements of the State Subdivision Map Act. Ail development within the area of the map is subject to development and other applicable fees including permit fees in effect at the time of permit issuance. Security/limited access gates, if provided at driveways, are to be setback from the street for stacking purposes and require an approved plan by the City. After project occupancy, landscaping is to be maintained in accordance with the landscape plan approved for the project. This shall include the minimum levels of plant materials shown on the landscape plan and installed at the time of occupancy. Concrete drainage swales/V-gutters are not permitted across any landscape areas. Ail undeveloped parcels shall be landscaped per City standards, including landscaping adjacent to all street frontages. 20. The buildings and site shall remain free of promotional banners and flags. Permanent signage must be maintained in compliance with the Santa Ana Municipal Code and sign program established for the project. 21. Each trash enclosure shall have a minimum six inch concrete slab in front of the enclosure that is at least the same dimensions as the trash enclosure. 22. Prior to recording the final Parcel Map, complete abandonment process of a portion of Vance Street. the Police Department The alley adjacent to parcels 9,10,11 and 12 shall be illuminated to a minimum one foot candle of light. Public Works Aaencv The project, vesting tentative parcel map, and Vance Street abandonment shall comply with the conditions and requirements approved through DP 99-007 and Vesting Tentative Parcel Map No. 99-110. Resolution No. 1999-075 Page 3 of 3 The proposed subdivision it not anticipated to have any detrimental effects upon the general public. Each property will include sewer, water and necessary infrastructure improvements as conditioned in Development Review No. 99-07 and is further conditioned so it will not affect the health or safety of persons working or residing in the vicinity. The design or improvements of the proposed project will not conflict with easements necessary for public access through or use of the property within the proposed project. The proposed subdivision will require a partial abandonment of Vance Street as part of the vesting tentative parcel map approval. The abandonment of Vance Street will prevent traffic generated by the project bom cimulating through the adjacent neighborhood. Covenants, Conditions and Restrictions and utility easements are required as conditions of approval for this project. 2. The mitigated negative declaration and mitigation monitoring program for ER No. 99-116 is hereby approved and certified. 3.
