RESOLUTION NO. 2000-059
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA CLOSING TO VEHICULAR TRAFFIC THAT
PORTION OF TENTH STREET BETWEEN MAIN STREET
AND SYCAMORE STREET
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
1. The City Council of the City of Santa ^na hereby, finds, determines and
declares as follows:
The Orange County High School for the Arts (OCHSA), a non-profit
charter school which will open its doors in the next few days, has
requested the City to close 10th Street between Main Street and
Sycamore Street in order to protect its students who have to cross this
street during the school day. The OCHSA campus, which consists of four
separate buildings, extends on both sides of 10th Street between Main
and Sycamore.
Section 21102 of the California Vehicle Code allows a city council to close
a street which divides a school to vehicular traffic when in the opinion of
the city council the closure is necessary to protect the students attending
the school.
Having considered all evidence submitted, including public comment if any,
this Council finds that said street is may be closed for vehicular traffic,
based upon the following findings of fact:
Said street is not necessary to provide access to abutting property
owners; and
2. Said street divides a school; and
Closing said street is necessary to protect the students attending the
school.
Pursuant to the Vehicle Code, the portion of said street may be closed
only to vehicular traffic. It remains a public street accessible to all
members of the public as pedestrians. In addition, if there are any in-place
public utility facilities that are in use in the portion of said street, the City
retains all rights to right to maintain, operate, replace, remove or install new
public utility facilities.

2. The City Council has reviewed and considered the information contained
in the addendum together with the initial study and the negative declaration prepared
with respect to this resolution. The City Council has, as a result of its consideration,
and the evidence presented at this meeting, determined that, as required pursuant to
the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a
negative declaration and addendum adequately addresses the expected environmental
impacts of this resolution. On the basis of this review, the City Council finds that there
is no evidence from which it can be fairly argued that the project will have a significant
adverse effect on the environment. The City Council hereby certifies and approves the
negative declaration and addendum and directs that the Notice of Determination be
prepared and filed with the County Clerk of the County of Orange in the manner
required by law. Pursuant to Title XIV, California Code of Regulations ("CCR")
§ 735.5(c)(1), the City Council has determined that, after considering the record as a
whole, there is no evidence that the proposed project will have the potential for any
adverse effect on wildlife resources or the habitat upon which the wildlife depends.
Therefore, pursuant to Fish and Game Code § 711.2 and Title XiV, CCR § 735.5(a)(3),
the payment of Fish and Game Department filing fees is not required in conjunction with
this project.
3. This Council does hereby order that the portion of Tenth Street between
Main Street and Sycamore Street, more specifically shown in "Exhibit 1" attached hereto
and made a part hereof by this reference, be, and the same are, closed for vehicular
traffic until further action of this Council.
4. Staff is directed to post appropriate traffic control signs giving notice of the
partial closure of Tenth Street. Pursuant to section 21102 of the Vehicle Code, this
resolution shall be effective upon the posting of said signs.
5. This resolution, effecting the closure of a portion of Tenth Street to vehicular
traffic, may be repealed at any time by a further resolution of the City Council.
