Roll call was answered by Councilmen Royal E. Hubbard, Harry H. Harvey, James Gilmore, Henz,y H. Schlueter, and Mayor A. Allen Hall. CONCRETE PIPE On motion of Councilman Hubbard, seconded by Councilman Harvey and carried~ Council received and ordered filed a report of bids received for 13~000 feet of Steel Plpe~ Spec. ~81-22; approved award of contract to Smith-Scott Co.~ Inc. in the amotmt of $71~912.90 at unit prices bid; and rejected all other bids. WIDENING FAIRVIEM On motion of Councilman Hubbard, seconded STR~m'I' by Councilman Schlueter axMl carried, Council received and ordered filed a report of bids received for widening Fairview Street between Highland Street and First Street, Project C-9~; approved award of contract to Warren Southwest, Inc. in the amount of $13,737.75 at unit prices bid; and rejected all other bids. ~/J APPEAL 112 V.A. postponed from December 2, 1963. Council again considered Appeal 112, filed by the applicant in Variance Application 183~ to construct apartments in an R 1 District at 1901 N. Santiago, decision having been Mayor Hall was advised by the City Attorney that he should refrain from voting on the matter since he was not present at the public hearing. HEARING - APPEAL 105 Vice Mayor Hubbard opened the hearing V.A. 1842 - GONZ~T.~ continued from December 2, 196~ on Appeal Application 105 filed by Louis E. Gonzales from the Planning Cc~mnission's denial of Variance Application 1842 to operate a drive-in food service at 2328 W. McFadden. On motion of Councilman Harvey, seconded by Councilman Gilmore and carried, the hearing was continued to January 6, 196~, 7:30 p.m., in the Council Chambers, at the request of the applicant. c~ HEARING - APPEAL ll3 Vice Mayor Hubbard opened the hearing ROBINSON on Appeal Application 113 filed by B. (V.A. 18~9 - SCANLON) W. and Patricia G. Robinson from the Zoning Administrator' s approval of Variance 1839 (Scanlon) to construct a 20 unit, two story apartment complex on C i and R 1 property at 1609 N. King Street. The Clerk reported that notice of the hearing was mailed to adjacent property owners on December 9, 196~ and that no letters of protest had been received. Bill Robinson, 1515 N. King Street~ appellant, using visual aid charts, maintained that the legal requirements for a variance had not been met and that the purpose of zoning had been overlooked; that no special circtu~stances had been proved; that property rights had not been denied the variance applicant; and approval of this application would set a precedent in the neighborhood. Mr. Robinson stated that he would not object if luxury apartments were built and if the number was limited to ten. The Planning Director stated it was the opinion of the Znning Administrator~ staff, and Planning C~amission that this location presented itself for some type of development because of its size, shape and approximate location to c~ercial area on 17th Street; that a precedent had been set on the west side of King Street; that the portion of land already zoned c ...... erciaLly could be developed to a greater density than proposed. There being no further testimony~ the hearing was closed. It was moved by Counci~n Harvey, seconded by Councilman Schlueter and carried, that the Council uphold the action of the Zoning Administrator and instruct the City Attorney to prepare a resolution granting Variance Application 1839. ¢~1~ HEARING - APPEAL 11~ Vice Mayor Hubbard opened the hearing C.U.P. 154 - KANE on Appeal Application 114 filed by Mathilda N. Kane from the Planning C~lssion's denial of C.U.P. 154 to convert a portion of a single residence for care of six retarded children at 709 N. Mouutaim View Street. The Clerk reported that notice of the hearing was mailed to adjacent property owners on December 9, 1963, and that no written coammmications had been received. Mathilda N. Xane, applicant, explained that parking had been a major reason for rejection by the Planning ¢~"mlesion~ l~At that in reality parents of these children seldom visited them; and stated there were other businesses in the neighborhood being conducted frem garages. The Planning Director stated that the Planning C~ission felt this type of use should be confined to transition areas; that they result in lack of off street parking, and if allowed necessary parking should be provided. There being no further testimony, the hearing was closed. CIT~ COUNCIL - 276 - December 16, 1963 On motion of Councilm~ Harvey, seconded by Councilman Gilmore and carried, the City Council overruled the action of the Planning C~m~ssion and instructed the City Attorney to prepare a resolution granting Conditional Use Permit 1~ subject to applicable conditions. HEARING - AMEND. APP. Vice Mayor Hubbard opened the hearing on ~B5 - LAMBERT Amendment Application ~S~ filed by ?~bara Lambert to reclassify from the M 1 to the R ~ District property south of McFadden, west of Lyon. planning C~mw.~ssion Resolution ~661 rec ...... ended denial without prejudice. The Clerk reported that notice of the hearing was published in The Register on November 30, 1963 and that no written c ...... unications had been received. The Pismires= Director reported that the applicant's attorney had agreed to postpon~m*nt of the hearing until after the City Council hears a progress report on the General P!~ by the Plann~nE Consultants. George Maxwell, ~ N. Enstside Avenue, stated he represented several parsons in the audience~, opposed to the application, but they would concur with a continuance. On motion of Counci~w~ Harvey, seconded by Couuc~m~n Gilmore and carried~ the hear~-~= was continued to January 20, 196~ at 7:30 p.m. in the City Council Chamber. HEARING - ASSESSM~IT Vice Mayor Hubbard announced the hearing on DISTRICT 221 Resolution 63-171, declaring the Council's intention to order certain sewer construction in Assessment District 221 (Watkins Way). The Clerk presented Affidavit of Publication of Resolution of Intentien, Certificate of Mailing Notice of Hearing, and Certificate of Postt~_= "Notice of Improvement". It was moved by Councilman Harvey~ seconded by Councilman Schlueter and carried, that the documents be received and ordered filed with the Clerk. Franklin T. Hamilton, 611 Wilshire Boulevard, Los Angeles, special counsel for the City, briefl~ explained the hearing. Ronald E. Wolford, Assistant Director of Public Works, described the boundaries of the district and the proposed improvements, and stated that in his opinion all lots and parcels within the proposed assessment district will be benefited by the construction of the improve- ments. Mr. Wolford stated the sewers on Seventh Street will be constructed as dry sewers, with outlet dependent upon Assessment District 218~ but that it is in best interest of the property owners to have the sewer with laterals con- structed now to avoid removing the paving in the future. The Clerk reported that no written protests had been filed. Joe Huuman, 1145 S. Sullivan; asked how much the assessment W~Alxl be on S,,11~van and was ~n~ormed by Mr. Wolford that the estimated cost w~uld be about $9.~0 a foot, including curb, gutter, sidewalk, paving and driveway approaches. Mr. Ba,,-~ stated that he was opposed to having curbs, sidewalks, and paving on Sullivan. Mr. Wolford stated that 55% of the owners on Sullivan Street had signed the assessment district petition. Sam Duran, 3~10 W. 7th, stated he had no protest but asked the cost per foot on 7th Street, and was informed by Mr. Wolford that it was estimate~ at $~3.00 a foot.
