Main Street. Roi1 call was answered by Councilmen Royal E. Hubbard, Narry E. Harvey, James Gilmore, Henry H. Schlueter, and Nayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Delwin Thig~en, Spurgeon Methodist Church. APPROVAL OF MINUTES On motiGu of Councilman Hubbard, seconded by Councilman Schlueter and carried, the Minutes of the Regular Meeting of December 16, 1963 and the Adjourned Regular Meeting of December 23, 1963, were approved. HEARING - APPEAL 105 Mayor Hall opened the hearing GONZALES (V.A. 1842) continued from December 16, 1963 on Appeal 105 filed by Louis E. Go~zales from the Planning C~ls- sion's denial of Variance Application 18~2 to operate a drive-in food service at 2328 W. McFadden in the R 2 District. John Gilbert, 607 First Western Bank Bu/lding, attorney, appeared on behalf of the appellant, offering to give any information desired by Coumcil. No one appeared in protest to the appeal, and the hearing was closed. It was moved by Couuci]~An Hubbard, seceded by Councilman Gilmore and carried that the City Council overrule the deeiai~ of the Planning C~m,~ssion and instruct the City Attorney to prepare a i~Bolution approving Variance 18~2. HEARING - AMEND. APP. Mayor Hall opened the hearing on 478 - HASSON Appeal Application 478 filed by Albert Hasson, proposin~ to amend Sectional District Map 24-5-10 to reclassify from the R 2 to the P District property on the east side of Sycamore betweea Co~-mercial Street and St. Andrews Place. The Clerk reported that notice of the hearing was published in The Santa Ana Register on December 21, 1963 and that no written c.-..-~mications had been received. W. H. Seeley, 822 S. Van Ness~ stated that the application was the result of three months of stu~ between the applicants and the Planning Department, and the Planning C~m"~ssion and it was the opinion of the applicant that the best use of the property would be professional. Sarver proposin~ to amend Bectional District Map 2-5-10 to reclassify from the C 1 to the C District property o~ the north side of 17th Street Between English Street and the Santa Ana River. Plannin~ Cnmmission Resolution 5662 recommended denial. The Clerk reported that notice of the hearing was published in The Santa Aha Register on December 1~, 1963 an~ that no written cc~munications had Been received. Gary D. Sarver~ ~16 S. California, Orange, applicant, explained the purpose of the requested change was to enlarge his present business no~ operating under variance, since additional land has been acquired and he did not wish to appl~ for a variance each time a change was made on the property. Dean Evans, Assistant Planner for the City~ stated that the variance procedure Is not as lengthy aa a zone change, and it was the Plannin6 C.----~ssin~l's opinion that approval of C 2 zonim~ would establish a precedent~ thereby permitti~ heavier commercial activities on 17th Street, inclu~iz~ Billboards. There being no further testimeny, the hearing was closed. The Clerk reported that notice of the hearing was mailed to adjacent property owners on December ~0, 1~3, and that no ~itten c~a~a~ni- catinns or objections had been received. Robert S. Barnes, 1016 N. Broadway, attorney for the appellant, stated that dedication of a street seemed to.be the only basis for denial of the application. Mr. Barnes pointed out that dedication of the street would in no way benefit the applicant's property. Claude Santafel, F~llerton architect for the appellant, stated that dedication for the street would hurt the plan which was desisaed as a residence for ambulatory patients. The City Manager recalled innumerable instances where property owners have been required to develop stub streets so that other properties could be developed with access, and noted that provisions of access to this area was imperative for emergency vehicles. Mr. Barnes suggested a 20 foot dedicatinn from the applicant's property and then the owner of the westerly property could acquire at the time of development of his property, the other 40 feet from property to the south by condemnation. There being no further testimony, the hearing was closed. It was moved by Councilman Hubbard, seconded by Council.~n Harvey and carried, that Appeal 116 be referred back to the Planning Coaw~ssion for reconsideration with the possibility of working out something regarding dedication and appropriate condit ions. HEARING - APPEAL 117 Mayor Hall opened the hearing on Appeal GUARANTY CHEVROLET Application 117 filed by Guaranty Chevrolet from the Planning C~ission's denial of Variance 1862 to construct an auto parts sales and storage building in the Professional znne with no rear or interior side yard at 205 S. Broadway. The Clerk reported that notice of the hearing wes mailed to adjacent property owners en December 30, 1963, and that no written ¢~xications had been filed. The City Council wes advised by the applicant that plans had been revised since the action of the Planning C~alssion. TRAFFIC CONTROL On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, Council received and referred for further investigation the staff report regarding request from Orange County Employees Association for traffic control device at 8th and Ross. TRAFFIC CONTROL On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council received and ordered filed the staff report of investigation of oetition for traffic signal or other control at intersection of 4th and Lacy; denied the request for signal, crossing guard, or portable signal, but directed the Manager to proceed with installation of pavement markings as rec~ended. TRAFFIC CONTROL Council received a report of the staff's investigation of a petition for traffic controls on McFadden. Madelyn Cenkar, Secretary of the Homeowners Association of Southwest Santa Ana, and Mr. KuJowski, 842 S. Porter, spoke in support of the petition. The City Manager explained that signals for Harbor and McFadden were recom~ended in the budget for the coming year and that zebra-type painting of crosswalks near schools will be installed. The Mayor suggested that Mrs. Ce~k-r arrange an appointment with the City Manager so that she and any other interested persons could review the report. On motion of Councilman Hubbard, seconded by Councilman Gilmore and carried, Council received and ordered filed the report. 17TH STREET On motion of Councilm-n Hubbard, seconded by CHANNELIZATION Councilman Schlueter and carried, Council received and ordered filed a report from the Director of Public Works regarding the meeting with property owners relative to left turn movements at 17th and College. Councilman Harvey and carried, Council post- poned to January 20, 1964 action of Preliminary Record of Survey 346 filed by Weber Plywood Company creating two M 1 lots on the east side of Grand Avenue, south of Warren Street. MUNICIPAL BOWL On motion of Counc~lm-n Hubbard, seconded by Co~Alc~lm-n Schlueter and carried, Council granted permission to Santa Aha Lodge B.P.O. Elks 794 to use the Municipal Bowl on the afternoon and evening of Friday, May 29: and Saturday, May 30, 1964 for the Sixth Elks Charity Circus~ at the rate of $100 for each matinee and $125 for eve~t~g performances.
