HomeMy WebLinkAbout2000-084 - Approving a Revised Housing Element of the City's General Plan385 RESOLUTION NO. 2000-084 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING A REVISED HOUSING ELEMENT OF THE CITY'S GENERAL PLAN BK:I~I~00 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: SECTION 1. The City Council hereby finds, determines and declares as follows: The California Government Code requires every city to adopt a General Plan. The Plan consists of several elements, one of which must be a Housing Element. The Housing Element, in general, must be revised every five (5) years to incorporate programs, polices and objectives designed to allow the City to meet its fair share of the regional anticipated growth in housing demand. This requirement was suspended several times during the 1990's by the California Legislature due to the general recession in the State. Government Code section 65588, as amended, requires the City to adopt a revised Housing Element by December 31,2000. Pursuant to state law, the Housing Element must include the following provisions: A review of previous element's goals, policies, programs and objectives to ascertain their overall effectiveness; An assessment of Housing Needs, as set forth by the Southern California Association of Governments (SCAG) via its RHNA process, and inventory of resources and constraints; An analysis and program to preserve assisted housing developments; A statement of community goals, qualified objectives, and policies relative to the maintenance, preservation, improvement and development of housing; and · A program which sets forth a schedule of actions that the city will undertake to implement the plan's goals and policies Both the Redevelopment and Housing Commission, and Planning Commission have considered the proposed Housing Element at a regularly Resolution No. 2000-084 Page I of 3 386 scheduled meeting, and recommended that the City Council adopt the Housing Element. The proposed Housing Element has also been reviewed twice by the California Housing and Community Development Agency (HCD). The Housing Element was revised after the first comment letter, and resubmitted to HCD. HCD, in its most recent comment letter, signed by Ms. Cathy E. Creswell, Acting Deputy Director, Department of Housing and Community Development and dated November 22, 2000 (Letter "H"), states that the City's Housing Element meets all requirements of state law if revised in four areas. Staff has revised the proposed Housing Element to take into account these four items. The City Council incorporates by this reference the responses to Mr. Creswelrs letter in the revised Housing Element as though fully set forth. A copy of the binder containing information about vacant and underutilized parcels in the City, referenced at page C-6 of the Housing Element, shall be maintained by the Clerk of the Council, and is incorporated into this Resolution as though fully set forth. All statements and findings contained in the Housing Element are incorporated herein by this reference as though fully set forth. SECTION 2. The City Council has reviewed and considered the information contained in the initial study and the negative declaration for ER No. 00-19 prepared with respect to this Housing Element. The City Council has, as a result of its consideration, and the evidence presented at the hearings on this matter, determined that, as required pursuant to the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Negative Declaration adequately addresses the expected environmental impacts of the Housing Element. On the basis of this review, the City Council finds that there is no evidence from which it can be fairly argued that the project will have a significant adverse effect on the environment. The City Council hereby certifies and approves the negative declaration and directs that the Notice of Determination be prepared and filed with the County Clerk of the County of Orange in the manner required by law. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the City Council has further determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, pursuant to Fish and Game Code § 711.2 and T*~le XlV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. SECTION 3. The Housing Element is hereby approved and adopted, and shall be made regularly available by the City's Planning and Building Agency.
