HomeMy WebLinkAbout2001-032 - Approving Tentative Tract Map No. 16187RESOLUTION NO. 2001-032 A RESOLUTION OF THE CI~ COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE TRACT MAP NO. 16187, TO SUBDIVIDE A 9.2 ACRE PARCEL INTO 36 RESIDENTIAL LOTS, FOUR OPEN SPACE LOTS AND ONE PRIVATE STREET LOCATED AT 2800 NORTH FARMERS DRIVE (TTM NO. 16187) WHEREAS, Tentative Tract Map No. 16187 has been filed to subdivide an existing 9.2 acre parcel into 41 lots for a gated community with 36 single-family residential lots, four open space lots, and a pdvate street located at 2800 Farmers (the "Project"); WHEREAS, the design and improvement proposed for Tentative Tract Map No. 16187 is consistent with the objectives, policies, general land uses, and programs specified in the City of Santa Ana General Plan; WHEREAS, Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 01-24 has been prepared for the Project; WHEREAS, the Planning Commission of the City of Santa Ana held a duly noticed public hearing on Apdl 9, 2001, on Tentative Tract Map No. 16187, and based thereon, recommended that this Council approve the map for the Project; and WHEREAS, this Council held a duly noticed public hearing on Tentative Tract Map No. 16187 for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the above said hearing, this Council finds and determines as follows: Ao The proposed project, as conditioned, and its design and improvements are consistent with the Single-Family Residential (LR-7) land use designation of the General Plan and are otherwise consistent with all other elements of the General Plan and any applicable specific plans. The proposed project consists of the division of one parcel into 41 lots in order to construct 36 single-family residences. The proposed subdivision is consistent with the General Plan land use designation of Low Density Residential (LR-7) for this area. The residential development also promotes the long-range goals and policies of the General Plan Housing Element and Land Use Element. The project provides inflll housing, increases the housing stock, and preserves the character and integrity of Resolution No. 2001-032 Page 1 of 4 B= the surrounding residential neighborhoods through amhitectural details, similar lot sizes, street frontages and building setbacks that meet the requirements of the Single-Family Residential (R1) zoning district. The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes, as well as other applicable City ordinances. The proposed development conforms to the subdivision codes for private streets, on and off-site improvements, and utilities as well as the Single- Family Residential (R1) zoning requirements for lot size, street frontage, building setbacks, and height. Knox Boxes on the entrance gates and street lighting will be installed to comply with Fire Department and Police Department requirements. Additionally, the project will conform to the California Building Code prior to issuance of the building permits. The project site is physically suitable for the type and density of the proposed project. The topography of the nine-acre parcel is fiat and triangular. The proposed lot subdivision provides 36 residential lots, and five lots for open space and street purposes. The density for Low Density Residential land use is seven dwelling units per acre as proposed, the development has a gross density of four dwelling units per acre and a net density of six dwelling units per acre. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. No fish or wildlife will be affected by the approval of the map or by the design and improvements of the project. Environmental Review No. 01-24 has been prepared for the project and has identified mitigation measures aimed at substantially reducing any environmental impacts associated with the project to insignificant levels. Pursuant to Title XIV, California Code of Regulations § 735.5(c)(1), after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. The design or improvements of the proposed project will not cause serious public health problems. The proposed 36 single-family residential development would not result in Resolution No. 2001-032 Page 2 of 4 health related problems. The construction of the project could potentially result in short term increases in air quality impacts. Implementation of AQMD Rule 403 as required would reduce the particulate matter in the ambient air produced by construction operations. The design or improvements of the proposed project will not conflict with easements necessary for public access through or use of the property within the proposed project. The site is improved with an existing building and parking lot since the early 1960's. As part of the demolition process, existing sewer and water facilities would be removed or capped and inspected by the City for code compliance. The project requires the realignment of existing utility easements and the dedication of new utility easements for the development. Emergency services would have access to the development with the installation of Knox boxes as well as Department of the Defense access to the jet fuel line easement. 2. Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 01-24 is hereby approved and adopted. 3. Tentative Tract Map No. 16187 is hereby approved, as conditioned in Attachment A, attached hereto and incorporated herein. ADOPTED this 16~ day of April, 2001. Clerk of the Council City of Santa Ana Resolution No. 2001-032 Page 4 of 4 Conditions for Approval Should Tentative Tract Map No. 16187 be approved, the project shall comply with all requirements and applicable sections of the Santa Aha Municipal Code, the California Administrative Code, the Uniform Fire Code, the California Building Code and other applicable regulations, In addition the project shall comply with the following conditions: A. pl.nnin~ Division 1. Comply with site plan review approval of DP 01-07. The convenants, conditions, and restrictions (CC&R's) shall be reviewed and approved prior to approval of the Final Tract Map. The Tract Map must be recorded within one year of the date of approval of the tentative map by the City Council. o The final Tract Map and CC&R's must be approved and recorded prior to issuance of building permits. o Two copies of the recorded Final Parcel Map must be submitted to each of the following: the Planning Division, Fire Department, Building Division, and the Public Works Agency within 10 days of the recordation. Ail development within the area of the map is subject to development fees and any other applicable fees in effect at the time of permit issuance. The Tentative Tract Map, Final Map, and all improvements required- of the subdivider shall be in accordance with the design standards and specifications of the Santa Aha Municipal Code and the requirements of the State Subdivision Map Act. o Off-site and common area improvements shall be installed, inspected, and approved prior to the utility release of the 18th unit. ATTACHMENT A
