Walnut).' The Planning Director reported that the Planni~ C_~.?mission had reconsidered its action and now recommended the attachment of conditions outlined in report dated March 2, 196~. On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council overruled the action of the Planning Cc*-w~esion and instructed the City Attorney to prepare a resolution granting Variance Application 1872 subject to the conditions described in the Plan~ing Director's report dated March 2, 196~. CITY COUNCIL - 333 - March 2, 1964 HEARING - A~D. APP. ~85 Mayor Hall opened the hearing on YORBA INVESTMenT CO. Amendment Application ~85 filed by Yorba Investment Company propoS~E to amend Sectional District Maps 25-5-10 and B6-5-10 by reclassifying from the A 1 to the R 1 and Prezoned R 1 districts, property on the west side of Flower between Sunflower and the Pacific Electric Railway. Planning Commission Resolution 5668 recommended approval of Exhibit A.A. The Clerk reported that notice of the hearing was published in The Register ou February 15, 1964 and that no written communications had been received. There being no response to the Mayor's call for testimony, the hearing was closed. On motion of Councilma~ H~bbard, seconded by Councilmau Gilmore and carried, Council approved the reclassification and instructed the City Attorney to prepare an amending ordinance according to E~hibit A.A. ~85-A. HEARING - AMEND. APP. ~86 Mayor Hall opened the hearing on F~.:.:nOM NEWSPAPERS Amendment Application ~86 filed by Freedom Newspapers, Incorporated, proposing to amend Sectional District MaP 7-5-9 by reclassifying from the R B and R 1 to the C 5 and R 1 B districts, property on the east side of Grand between Sixth and Fruit. Planning Resolution 5667 recommended approval of E~hibit A.A. ~6-A. The Clerk reported that notice of the hearing was published in The Register on February 15, 196~ and that no written communications had been received. There being no response to the Mayor's call for testimony, the hearing was closed. On motion of Counc~lm-~ Hubbard, seconded by Conncilman Harvey ~ carried, Council approved the reclassification and instructed the City Attorney to prepare an amending ordinance according to Exhibit A.A. ~86-A. HEARING - APPEAL 120 Mayor Hall opened the hearing on Appeal EARRIS0~ - V.A. 1888 120, filed by ~'s. Shirley E. Harrison from the Zoning Administrator's denial of Variance Application 1~ to construct a carport in the front yard setback area and to reduce the required distance between buildings at 1142-11~4 S. Golden West. The Clerk reported that notice of the hear- ing had been mailed to adjacent property owners on February 25, 1964 and that no written c~,munications had been received. Warren Finley, 1010 N. Main Street, attorney, represented the appellant, outlining the need for constructing a carport in the setback area, and stating the addition of two bedrocks to the front house would increase its rental value and would rectify the error of having a smaller house at the front. He noted it seemed better to have a six foot space between the two houses than to change the structures into a duplex, which was permissible under R 2. Larry &~w~ers, 1138~ Golden West, property owner directly north, spoke in opposition to the application. There being no further testimony, the hearing was closed. On motion of Councilman Harvey, seconded by Councilman Schlueter and carried, Council upheld the action of the Zoning Administrator and instructed the City Attorney to prepare a resolution denying without prejudice Variance 1888. BI~S C.:x~'ER James R. Mitchell, 2640 N. 0akmont, requested consideration of an application for a billiards center at 1212 S. . Bristol. The City Manager explained that the application was being investigated and reports would be filed on March 16th for action by the City Council CITY COUNCIL - 334 - March 2, 1964 It was moved by Councilman Gilmore, secanded by Councilw~ Schlueter, that the permit be approved subsequent to the filing of a police report determined to be favorable by the City Manager. O~ request of Councilman Hubbard, the City Attorney ruled this would probably be a delegation of legislative authority to the City Manager. ORD. 118-720 OI~DINANCE NS-720 AMENDING SECTION 9271, PRECISE ALIGNMenT SUB-SECTION (r) OF THE SANTA ANA MUNICIPAL CODE was introduced by title. It was moved by Councilman Hubbard, seconded by Councilman Harvey and unanimously carried, that further reading be waived and Ordinance NS-720 be passed to second reading. CITY COUNCIL - 337 - March 2, 1964 PRE. REC. OF SURVEY 350 Council considered Preliminary Record of Survey 350 filed by Charles Scrofani and others to create four C 2 lots on the east side of Fairview, south of 17th. Charles Scrofani, 1605 N. Fairview, objected to Condition 3 d in the Pl~n~tug Director's report, stating that the three foot street dedication would make planned development impossible unless he could build in the ten foot rear yard setback area. The Planning Director stated that this could only be accomplished by variance procedure.
