HomeMy WebLinkAbout2001-039 - Drive Through Lane Located at 1700-1720 East Dyer RoadRESOLUTION NO. 2001-039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA EXTENDING PREVIOUSLY APPROVED CONDITIONAL USE PERMIT NO. 99-06 BY ONE YEAR FOR A DRIVE THROUGH LANE LOCATED AT 1700-1720 EAST DYER ROAD WHEREAS, the Planning Commission approved Conditional Use Permit No. 99-06 to allow a drive through service lane at 1700-1720 East Dyer Road in conjunction with two other discretionary actions: 1) Conditional Use Permit No. 99-07 to allow a service station; and 2) Tentative Parcel Map to subdivide the westerly parcel into two (service station and parking lot), after public hearing on April 12, 1999; WHEREAS, the Planning Commission granted a modification to Conditional Use Permit 99-07 on October 9, 2000 for modifications to the site plan and elevations. WHEREAS, Santa Ana Municipal Code Section 41-647 provides that Conditional Use Permit No. 99-06 shall automatically become void after two years from the effective date of its approval if the owner fails to institute an action to erect, build, alter move or maintain the use of the property as specified in said conditional use permit; WHEREAS, Santa Ana Municipal Code Section 41-647 allows the City Council to extend the date on which Conditional Use Permit No. 99-06 becomes void by one additional year; and WHEREAS, the applicant requests a one year extension for Conditional Use Permit No. 99-06. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Conditional Use Permit No. 99-06 is hereby extended one additional year from the date on which it would have automatically become void, as conditioned in Attachment "A," attached hereto and incorporated herein. Date: _~,/~/~/4~)//' ~.~~--~ Clerk of the Council ~' ~ City of Santa Ana Resolution No. 2001-039 Page 2 of 2 RESOLUTION NO. 01- JUNE 18, 2001 PAGE 1 OF 1 Conditions for Approval Extension of Conditional Use Permit No. 99-06 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Aha Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below ~rior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Plannin9 Division Comply with all conditions and requirements from the Development Review Committee (DRC) for the development project (DP No. 97-67) Tentative Parcel Map No. 97-221 must be recorded prior to the issuance of any future building permit on Parcel two or at 1720 East Dyer Road. Provide a copy of the recorded map within 10 days of recordation. Ail future development is subject to the fees in effect at the time of permit issuance. Reciprocal access easement agreement shall remain in effect in accordance with tentative Parcel Map No. 97-221 between Parcels one and two and the Carl's Jr. restaurant site located at 1720 East Dyer Road. o Parcel two of Tentative Parcel Map No. 97-221 and its future surface parking improvements shall remain irrevocably tied to the Carl's Jr. Restaurant site (1720 East Dyer Road) for as long as a restaurant building exists.
