Roll call was answered by Councilmen Royal E. Hubbard, Harry H. Harvey, James Gilmore, Henry H. Schlueter, and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend George ~J. Busdiecker, St. Peter Evangelical Lutheran Church. II~TRODU~TIONS Ms,or Hall welcomed a De Molay gromp observing Civic Day, and each Council~-~ introduced the young man who was acting as his counterpart for the ~ay. Mayor Smekta presented a Scroll to Mayor Hall on behalf of Toastmaster Interna$ional, expressing appreciatiea to the City of Santa Aha and its Officers for the cordial relations and community support which Toastmasters has received since iSs founding forty years ago. DIST. 21~ Mayor Hall announced that this was the time and place fixed for hearing protests, objections or appeals in respect to the diagram, assessment and wor~ done in Assessment District No. 21~ (B~lsa-Andres) under and pursuant to resolution of intention, Resolution No. 6~-~9, end the Improvement Act of 1911. ~he Clerk presented the affidavit of publication and the certificates of mailing and posting notice of hearing on the assessment. On motion of C~uncilman Hubbard~ seconded by Co~uci~a~ Schlueter and carried, Council received and ordered filed the~ffidavit certificates. The Clerk presented the diagram and assessment to the Council. Franklin T. Hamilton, 611 Wilshire Boulevard, Los Angeles, Special Counsel for the City, Briefly explained the purpose of the hearing. Hmgh Foreman, Director of Pmblic Works, ~estified that the work was constructed in substantial c~a~liance with the plans and specifications, and that the assessment was prepared and spread by him, and that in his opini~m the assessment had been spread upon the lots or parcels of land in the district subject to assessment in proportion to the benefit~ arising from the work to be received by each such lot or parcel. The Clerk read a letter from ~t~.lph R. Garza, 4733 W. Melric Drive, protesting the assessment. There being no response to the Mayor's call for oral protests, the hearing was closed. APP. ~65 - Mayor Hall opened the hearing on Amendment MEP~iTn Application 465, filed by ~kldy Meredith proposing to amend Sectional District MaP 5-5-9 by reclassifying free the A 1 to the R 3 district property on the south side of Santa Clara between Wright and Tustin Avenue. Planning C~ission Resolution 5671 rec ..... ended denial. The Clerk reported that notice of the hearing was published in The Register on February 29, 1964 and that letters opposing the rezoning had been received from Herbert L. Hill, 15B3 E. 19th Street, Harry Tancredi, 1104 E. 17th Street; and a petition in opposition with 144 signatures. The c~unications were received and ordered filed on motion of Councilman Hubbard, seccuded by Councilmau Schlueter and carried. Dale Heinly, 611 W. 8th Street, representing the applicant, stated that none of the persons signing the letters add petition resided within 300 feet of the area; that at the time of annexation the applicant was assured he would have no z~ming problem. He requested that the application be considered for R ~ instead of R 3 development. On advice from the Planning Director that the R 4 is a more restrictive zoning, the Council proceeded. Mr. Heinly described the proposed developeaent of fourplexes and the buffer which would be provided by the proposed park site. Patrick Dug~an, 1~02 E. 21et Street, stated he had signed the opposition petition because of misrepresentation of the location and now spoke in favor if the developer c~uld enter the area free the north, south, or east. Sally Rosaa, 133~ E. 21et Street, spoke in opposition, citing as reasons the ma,y vacancies in the area, the traffic c~ngestion, and the probable increase in school children. She also requested that action be delayed until the General Plan is c~leted, noting that it w~ul~ ceet the city more to purchase the park area if it were rezoned R ~. Noel G. Conway, 1521 E. Catalina, asked those in opposition to rise, and about hO or ~5 persons erect. Mr. Co,way stated that if the park site is rezoned R the City woul~ not have sufficient fun~e to purchase it. He suggested that a variance procedure would give better controls over the devel~l~ent. George Hare, 1610 E. 19th Street, urged that the area be retained ae choice residential, and James M. $cherer, 1~9 E. 21et Street, also spoke in opposition. Mr. ~ sp~ke a~ain stating he would be opposed to a carte blanche rezoning but would favor a variance procedure. Hrs. William E. York, 1522 E. Catalina, pointe~ out crow~ed school facilities and low water pressure as reasons for opposition. Mrs. Hugh L. Wright, 2001 N. Ly~n, George Hare, 1610 E. 19~h, James M. Scherer, 1529 E. 21et, and Patrick M. Hurley, 2009 N. Lyes, also spoke in opposition. The Planning Director stated the Planniu~ C~issima's recommendation was unanimous against the zone c~e as they rec:-..~.~uded R 1 usage in this area. Mr. Heinly ma~e an oral request that the westerly nine acres planned for park use he eliminated frem the application and noted none of the streets would have access westerly, but access would be frem Santa Clara. There being no further testimony, the hearing was closed. CITY COUNCIL - 343 - March 16, 196~ On motion of Councilw~n Harvey, seconded by Councilman Schlueter and carried, Council approved the reclassification to R 4, deleting from the application the westerly nine acres, and instructed the City Attorney to prepare an amending ordinamce according to Embibit AA 465 B. AMEND. !APP. 490 - Mayor Hall opened the hearing on TAKENAGA Amendment Application 490 filed by Tsutomu Takenaga proposing to amend Sectional District Map 16-~t0 by reclassifying from the R 1 to the C 5 district property on the south side of Bolsa between Andres Place and Verano (Euclid). plan~ing C~a~aission Resolution 5672 recummend~d approval of Exhibit AA 490 A. The Clerk reported that notice of the hearing was published in The Register on February 29, 1964 and that no written commmications had been received. Arthur]Tatsuno, 1533 E. Catalina, representing the owner, spoke in favor of the application. There being no further testimony, the hearing was closed. On motion of Councilman Nubbard, seconded by Councilman Schlueter and carried, Council approved the reclassification and instructed the City Attorney to prepare an amending ordinance accord~nE to E~hibit AA 490 A. ~. APP. 491 - Mayor Hall opened the hearing on WE~T Amendment Application 491 filed by Walter West propOsing to amend Sectional District Map 7-5-9 by reclassifying from the R 3 to the P district property en the north side of Washington between French and Garfield. Planning Cow~ssion Resolution 5673 recommended approval of ~hibit AA 491 A. The Clerk reported that notice of the hearing was published in The Register on February 29, 196~ and that no written c~nications had been received. There being no response to the call for testimony, the hearing wes closed. AMEND. ~ APP. 492 - ARCHDIOCESE OF LOS ANG~T.wM proposing to amend Sectional District Map May~r Hall opened the hearing on Amendment Application 492 filed by the Archdiocese of Los Angeles EdUcation and Welfare Corporation 24-5-10 by reclassifying from the R 2 to the C 5 district property on the south side of Edinger between Bristol end Baker. Planning C.-...~Zssion Resolution 5674 recc~mended approval of ~hibit AA 492 B, which would reclassify to the C 5 and R 2 B districts. The Clerk reported that notice of the hearing was published in The Register on February 29, 1964 and that no written communications had been received. Earvey and carried, Council approved the reclassification and instructed the City Attorney to prepare an amending ordinance according to wxbibit AA 492 B. APPEAL - Mayor Hall opened the hearing on G~,:.:m Wilfred L. Green~ s appeal from the Chief of Police's refusal to issue a permit to operate a taxicab. Mr. Green made a brief statement regardi~ the circumstances. There being no further testimony, the hearing was closed. CITY COUNCIL - 3~3* - March 16, 1964 It was moved by Councilm~n Hubbard, seconded by Councilman Harvey and carried that the City Council grant the appeal and instruct the Chief of Police to issue an operator's permit to Mr. Green. ~ APP. ~89 - Mayor Hall opened the hearing on Amendment BODNAR Application ~89 filed by John Bodnar proposing to amend Sectional District Map 8-5-9 by reclassifying from the R 2 to the C 5 district property at the southeast corner of 4th Street and McClay. Planning Ccmmnission Resolution 5670 recommended denial. The Clerk reported that notice of the hearing was published in The Register on February 29, 196~ and that no written communications had been received. Dale Heinly, 611 W. 8th, attorney for the applicant, requested that the hearing be continued to May 18, 196~. On motion of Councilman Hubbard, seconded by Councilman Gilmore and carried, Council continued the hearing to May 18, 1964, 7:30 p.m., in the Council Chamber. APPEAL 121 - Mayor Hall opened the hearing on Appeal S~J. 0IL CO. 121 filed by Shell 0il Company appealing condition requiring street dedication imposed by the Zondng Administrator in his approval of Variance Application 1895, to relocate two free standing signs in the setback area at 220 W. 17th Street. The Clerk reported that notice of the hearing was mailed to adjacent property owners on Narch 9, 196~ and that no written cc.....unications had been received. George Murphy, 9829 E. Oak Street, Belmont, representing the appellant, stated that the two signs involved were not being relocated, but were being replaced at the same location and height, and to require dedication was imposing a penalty; that the ccmpany was willing to move the sign when right of way is required. APPEAL 122- Mayor Hall opened the hearing on Appeal ROBB 122 filed by W. F. Robb, appealing the Zoning Administrator' s denial of Variance Application 1~91 to construct two one-bedromm apartment units on au R 1 lot having an existing single family residence and to reduce required rear yard at 705 Orange Avenue. The Clerk reported that notice of the hearing was mailed to adjacent property owners on March 9, 1964 and that no written c.~?,~'.Auications had been received. August Lillaud, 988 N. Cambridge, Orange, representing the appellant, cmapared the property to others nearby which were granted variances, and also stated that the property is about 75 feet wide instead of 50 feet as reported in the Findings of Fact. David H. Dicksou 701 Orange, protested that there would be insufficient parking and an increase in noise. Henry Feenhouse, 316 E. Bishop, and Mrs. Dicks~ also spoke in opposition. W. F. Robb, appel!~t, stated a garage is proposed for each unit. There being no further testimony, the Bearing was closed. On motion of Councilman Gilmore, seconded by Councilman Schlueter and carried, Ce~ucil overruled the action of the Zoning Administrator and instructed the City Attorney to prepare a resolution granting, subject to applicable couditions, Variance 1891. It was moved by Councilman Hubbard, seconded by COUncilman Schlueter that Mrs. Loule Boer, be removed as a member of the Citizens Advisory Patrick Duggan, 1~02 E. 21st Street, member of the Citizens Advisory Committee, referred to an editorial in The Independent which urged citizens to take an active part in Government, end he expressed the opinion that no action should be taken against Mrs. Boer, ~ut that she could instead relinquish the chairm-=- ship of the sub-c,~ttee and continue to serve on the c~ittee. Mrs. Boer state~ that no charges had been filed against her in the City Clerk's office and that her removal was instigate~ by a group favoring an Urban Renewal Program. Dr. Donald Lind, 26~3 N. Main, member of the CAC and Inter-City Sub-Co,,,~ttee, requesting that the contents of the petition be reveale~ before a vote was taken; noted he had net observed Mrs. Boer to be an obstructionist. Joseph Gilmaker, 308 W. 4th Street, stated he felt the charges were unduly made and suggested a co~lete reorganization of the c~ittee. Clifford Frazier, 20~9 S. Halladay, requested that the contents of the petition be revealed, and agreed with the suggestion that the committee be reorganized. Mrs. Boer stated three members of the E~ecutive Board were there illegally; criticized the creed of the committee, which she claimed was from the Cmmunist Manifesto; read from Executive Board Minutes of October 16th regarding dropping members frem the Citizens Advisory Cemaittee only by request; read from Executive Board Minutes of February llth regarding her request that rules be established and the creed be 'removed; asked for reorganization of committee. Gordon Bricken, 811 N. Minter, Sub-C~ttee Chair-~ of Governmental Services and member of the Executive Board, stated that he had not signed the petition because he did not agree with the petitioners' tactics; that he had tried to assist in ironing out the difficulty between Mrs. Boer and the Executive Board a~ter asking the Council not to accept her resignation several months ago, without success; that there was a conflict of nine or ten people against one, and Council CITY COUNCIL - 350 - March 16, 196~ must Judge which should be considered. He concurred with Mr. Duggan's suggestion that she continue to serve as member of the General committee if she wished, but not on the E~ecutive Board. Mrs. Boer questioned the number of members on the E~ecutive Board versus the number signing petition. Mr. Frazier noted her sub-committee voted to retain her as Chairman with seven voting aye; none voting no, and four abstaining. Mrs. Barbara McNeal, ?03 W. Washington, member of the Inter-City sub-committee, spoke of Mrs. ~oer's competency. Mayor Hall commented that members of bcards~ committees, and commissions are appointed by the Council~ and this carries vith it the authority to remove, according to the legal ruling of the City Attorney. The moticm that Mrs. Loule Boer be removed as a member of the Citizens Advisory Committee for the General Plan Programwas thereupon carried byunanimous voice vote.
