Main Street. Roll call was answered by Councilmen Royal E. Hubbard, Harry H. Harvey, James Gilmore, Henry Schlueter and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocatien was delivered by the Reverend Bennie C. Flint, First Baptist Church. APPROVAL OF MII~JTES On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, the Minutes of the Regular Meeting of March 16, 196~, and the Adjourned Regular Meeting of March 30, 196~ were approved as mailed. PROPERTY SALE On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council instructed the Clerk to open the one sealed bid received on unimprove~ parcel north of alley behind fire station on 17th .Street. The Clerk read the bid frcm Allison Honer Company, 1073 W. 17th, in the amottnt of $12,000. The Mayor called for oral bids, and received a bid of $12,900 from Jehn L. Sentesy, 1728 W. 17th Street. Richard Honer, representing Allison Honer Co., bid $13,500. The biddlng thereafter was as follows: Sentesy: $14,000 Honer: $14,500 Sentesy: $15,000 Honer: $15,250 Sentesy: $15,500 Honer: $15,750 Sentesy: $16,000 Honer: $16,250 Sentesy: $16,500 Honer: $16,750 Sentesy: $16,925 Honer: $17,200 There being no further response to three further calls for bids, the property was declared sold to Allison Honer Cce~may in the amount of $17,200. A written statement of bid and cashier's check for $2,000 were deposited with the Clerk. HEARING - Mayor Hall opened the hearing on A~. APP. ~87 Amendment Application ~87 filed by PETERS Walter and Bertha Peters proposing to amend Sectional District Map 13-5-10by reclassifying fr~nthe R 1 to the C 5 district, property on the north side of Myrtle between Baker and Bristol. Planning Co-~.~ssion Resolution 5677 rec~,mended denial of the proposal. The Clerk reported that evidence of giving notice of the hearing was on file in the Clerk's office and that no ~itten communications had been received. Council heard~r, and~rs. Walter A. Peters, 1241Myrtle, applicants, who outlined their plan to establish a typewriter repair shop in the garage. Mr. Peters stated that he would not object to havi~ a variance instead of a zene mhange if the business could be expanded or continued after his death. There being no further testim~, the hearing was closed. Vice Mayor Hubbard stated he had no objection to proposed use but was concerned about setting a precedent for street by a zone change. CITY COUNCIL - 356 - April 6, 196~ On motion of Councilm-- Hubbard, seconded by Councilman Harvey and carried, Council denied the reclassification but instructed the Planning Department to accept an application for a variance for the same usage without an additional fee. APP. ~8 Mayor Hall opened the hearing on J0~EPE Amendment Application ~88 filed by Jack Joseph, proposing to amend Sectional District Map 12-5-10 by reclassifyt~E fr~a the R 2 to the R ~ H district, property on the south side of between Ross and Van Ness. Planning C.~m~ission Resolution 5676 recc~maended approval of w~ibit AA 488 A o The Clerk reported that evidence of giving notice of the hearing was on file in the Clerk's office and that no written cvmm~uications had been received. There being no response to the call for testimony, the hearing was closed. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, Council approved the reclassification and instructed the City Attorney to prepare an ame~af~ ordiuance according to Exhibit AA 488 A. WA~N AMI~JLANCE Mayor Hall opened the hearing on Windh Ambulance~s application for Certificate of Public Convenience and Necessity to operate one ambulance in the City of Santa A~. The City Attorney notified Council the Court had set a hearin~ On the matter and rec~nded action be postponed until after a Court determination had ~een made. Stanley C. Goml~, 900 N. ~r~adway, attorney representing Acker Ambulance Service amd M~rgan Amb,,1-~ce Service~ suggested that a study be made of the ordinances reg-lating ambulances by a Council c~=m~ttee and that Council make a determimation prior to the Ccm~t hearing on May 14th. Mayor Hall noted that the City Attorney had been instructed to review the ordinamces and to clarify certain sections before that time. ~n Rryamt, 900 No Broadway, attorney for Windh Ambulance, concurred with waiting for the City Attorney's ruling. On motion of Couucilm-~ Hubbard, seconded by Councilman Schlueter and carried, Council continued the hearing to May 4, 1964, 7:BO porn., in the Council Chamber, 217 North Main Street. APPEAL 123 Mayor Hall opened the hearing on Appeal E & R DEVELOPMENT 12~ filed by E & R Development Co., Imco, COo from the Zoning Administrator's denial of Variance Application 1910 to construct six, single-famfly residential u~its on an R 1 lot at 5105 W. 7th Street. The Clerk reported that evidence of givtnE notice of the hearing was on file in the Clerk's office end that no written communications had been received. Phillip Schindler, Union Bank B~ilding, Orange, representing E & R Development Co., submitted a revised plot plan, and spoke in support of the appeal noting that adjacent property is R 2. There being no further testimony, the hearing was closed. On motion of Councl~m-n Harvey, seconded by Coumcilman Hubbard and carried, Council upheld the action of the Zcming Administrator and instructed the City Attorney to prepare a resolution denying Variance 1910. CITY COUNCIL - 357 - April 6, 196~ APPEAL - H1U~TON Mayor Hall opened the heari~ on W~ll~rd H. Hilton*s appeal frc~ the Chief of Police's refusal to issue a permit to operate a taxicab. The Clerk reported that notice of the hearing had been mailed to the Chief of Police and the appellant three days prior to the hearing. There being no testimcuy the hearing was closed. On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council granted the appeal and instructed the Chief of Police to issue an operator's permit to Mr. Hiltan. ~A/Jf APPEAL 124 - AGUILAR Mayor Hall opened the hearing c~ Appeal Applicatio~ 12~ filed by Joe and Eula Aguilar from the Zonin~ Administrator's denial of Variance Applicatiom 1914 to construct a second single famil.v unit on an R 1 lot which would reduce the required rear yard at 1502 W. 8th Street. The Clerk reported that evidence of giving notice of the hearing was on file in the Clerk's office and that no written cusaaunications had been received. Thomas w. Marshall, 12021 Westminster, representing the almpel!an~t, cited six lots in the block with R 2 zcuing and noted Mr. Aguilar pl---ed to put in side- walks, curbs, an~ paving. Manuel Serrano, 120~1 Westm~-ster Avenue, also spoke ~n b-bAlf of the applicant. In answer to a question from Councilman Harvey, the Acting P~-~_= Director, Mr. Stevens, reported the area to Be single f-~ly in the opinion of the Planning staff. There being no further testimony, the hearing was closed. Fairview. The Clerk reported that evidence of giving notice of the hearing was on file in the Clerk's office and that no written ¢~,-~¢ations had Been received. The Planning Director stated that at the time of the hearing before the Zoning ~istrntor, the applicant's intended p~ans were not clear].V understood; that the department now approved his proposal, subject to the conditions that the temporary sales office Be permitted for a Period not to exceed one year; and that development be according to plot plan.
