RESTR00M FACILITIES The City Manager reported on bids received for construction of a concrete block restroom building for Santiago Park, stating that one bid had been received in the amount of $6,932.00, this being close to the est~=-ted cost. 0~ motion of Councilman Euhbar~, seconded by Counc~lm-u Narvey and carried, Council awarded the contract to R. L. Steimmetz. HEARING - WINDH AMBULANCE Councilman Gilmore returned to the Council Cb-tuber and took his seat at the Council table. Mayor Hall opened the continued hearing on application of WinCh Ambulance Service to operate sm ambulance in the City. ~emmeth Bryant, 900 N. Broadway, attorney for the applicant, reviewed the acti~s takan to date, ~oted the co~fusion caused by having a conflict in ordinances, am~ asked that clarification be made by rewriting the ordinance. Stan~ey Gould, 900 N. Broadway, attorney for Acker Ambulance Company and Margam Ambulance C~pamy, submitted a letter to the Council stating that the Superior Cour~ had continued the hearing of the restraining order against the City to August ~rd, a~d asking for contin,,~nce of the Council hearing to August 17, 1~64. HEARING - ROm~ Mayor Eall opened the hearing on Amendment Application 494 filed by Vera B. Rohrs proposing to amend Sectional District Map 6-5-9 by reclassifying from the R 1 to the R 4 district, property on the east side of Santiago between 17th and Catalina. Plam~img Commission Resolution 5679 recommended denial. The Clerk reported that evidence of giving notice of the hearing was on file in the office of the Clerk and that written communications had been received fram the following: W. C. Bertrand, 2~05 N. Hathaway and Charles R. Moller, ~r., 2637 N. Larchmont, oppos~ng the application; and a letter from C. E. Poush, favoring the application. PROPON~T'S Robert Rick. les, 611 W. 8th Street, attoruey TESTIMONY representing the Rohrs and ~eller interests, reviewed a report of Ruth & Krushchk~v which indicated that Santa Ana's population would double in the next 16 years, and that the eight units to an acre should increase by necessity to 12 units an acre. He cited a Pl-n~ing Department survey indicatfng that apartments yield less children per unit than single homes; compared property values, tax production, and public services for R 1 and R 4 developments; cited sales records of properties adjacent to other garden apartments, showing an increase in values; and cited other R 4 develop- ments adjacent to R 1. OPPONENTS Nathan Tart, 90S E. Avalon, TESTIMONY representing s~,~- property owners opposing the rezoning, referred to Section 9~5 of the Santa Aaa Municipal 0o4~, stating that public necessity, convenience and welfare must be affected befOre a zoning cha-_-e could be initiated, requirements which he felt ware not met. Mr. Tart questionei whether proper notice of the hearing had been given, an~ accepted Counei~m-n Eabbard's explanation that there are alternative methods of notifying l~COperty owners, and one of these had been met; Eerwin ~acobs, 915 E. Avalon, ~escribed the area with the aid of charts, point- ing out buffers established by the COuncil between the R 1 area and Guaranty. ChevrOlet, and referred to a Pla-~tng Department report of 1960 which he felt refuted moat of Mr. Rick. les' contentions. Walter Earwood, 2110 Santiago, stated that he had been an appraiser for twelve years an~, in his opinion, apartment ~evelo~ment in an R 1 zone devaluates the R 1 properties; cited Buffalo Street houses at $~0,000 as an example that R 1 development is feasible in the area. Walter Neubrander, 1202 E. 3uffalo, with graphs of vacancy rates in Santa Aaa for apartments an~ single homes, indicated shortage of single hcmes available conpared to apartments. Gene Westmyer, 20th and Santiago, expressed fear that approval of this develop- merit would lead to other apartments. Also. speaking in opposition were Mrs. john Madden, 2ll~ Poinsettia; Clark Bertram, 2405 N. Hathaway Lane; Robert l~udson, 120~ E. Avalon; and Mrs. Russell Macy, 1720 Santiago. A. H. Jones, 910 E. Santa Clara, expressed doubt that increased assessed values of apartment develolmzent would offset increase in governmental services. Howard Parker, 702 E. Santa Clara, commented on traffic problems that would result from R ~ development. Richard segerblom, 923 E. Jonquil Road, quoted Planning Department regarding community pride encouraged by individ,,~ home ownership. Harry Craig, 806 E. Catalina, pointed out apartments referred to by Mr. Rickles are on another sectional district map and that subject property is surrounded by R 1 or R 1 B and does not ad. Join any C ~. Mrs. Janice Boer, 912 N. Lowell, commented on owners in southeast desiring rezoning for apartments, and the lack of high grade R 1 area. P~UTTAL Mr. Rickles interpreted Santa Aha Municipal Code Section 9255 regarding public necessity, convenience, and welfare to apply to the Council or C~-..~sion initiating proceedings on their own motions and not to verified applications. He noted the project is economically sound or the lending agencies would not approve; noted that responsible persons live in apartments as well as single homes; cited the apartment development at Warner and Raitt as being surrounded by R 1. There being no further testimony, the hearing was closed. Eastsid~, Industrial Co-or&inator for the Chamber of Cm~erce, reviewed the Background of industrial zoning in the area, noting that in 1957 the P~a-wimg Director, had proposed that the south Grand area be zoned to agriculture entil a pattern developed. Ne maimtained that a pattern of iadustr~-~ ~evelolm~nt now exists, and stressed the importance of keeping the area intact for industries. Ne also reviewed the history of the Zonin~ 0rd~nance, statin~ that industries that had moved into the area had been led to believe they would be protected from residential encroachment. l~obert Our~is, 121 E. 6th Street, Los Angeles, attorney for the Santa Fe Railway, spoke in opposition to the proposed rezoning, stating that Santa And is ripe for industrial developaent. Mr. Markel refuted these statements, saying the Santa Fe Railway had talked about new industries coming here for the past five years. There being no further testimony, the hearing was closed. Broadway, attorney for the applicant, said that two requests to operate the service station had been received; that the service station had been vacant for many years, and was an eyesore which needed improving. Mm. Ne~nly also stated that requesting a variance was not feasible because the applicant could not prove hardship. The Planning Director explained that since the station had been aband~ued for about seven years, its statue as a non-conforming use had been forfeited. Segerstrom & Sons for abandonment of a portion of Alton Street. BO-PEEP LAUNEI~/ John Stanley, 512 First Western Bank Building, attorney for certain property owners in the area of the Bo-Peep Laundry, reviewed the Building Director's report dated May 11, 1964 of his investigation of the c~aplaint that the laundry's extraction machine is a nuisance to the occupants of nearby properties because of its vibration. It was Mr. Stanley's opinion that the report warranted legal action by the City. Councflm-n Hubbard asked the City Attorney whether or not the nuisance would ' be considered public or private, and the City Attorney responded that it was not a public nuisance. The following persons spoke regardt~ the vibrations: Mrs. George Hatfield, 124 Owens Drive, J~ma_s T. Nance, 120 E. Owens Drive, and George Hatfield, 124 Owens Drive. Boyd Van Wyckhouse, 1835 Manchester, Anaheim, asked if anyone had felt the vibrations recently. Mr. Hatfield responded that he had not noticed the vibrations since May 12th. Mr. Van Wyckhouse replied that the laundry had stopped using the extractor portion of the machine on that date, and would not use it until the manufacturer checks the equilmnent. Hazard Parent-Teacher Association, discussed the need for a crossing On motion of Councilman Hubbard, seconded by CouncJlm-u Schlueter and carried, Council received and ordered filed a petition requesting a crossing guard signed by approxtm-tely 368 persons, presented by Mrs. Richard. The City Manager stated that traffic is even more hazardous at this school than at Rosita School, and a crossing guard was warranted. On motion of Councilman Hubbard, seconded by Councllm~ Schlueter and carried, Council authorized establishment of an adult crossing guard, effective ~-w~diately, for the remainder of the school year, and for the next school year, during which time efforts will be mede to establish a school boy patrol program. Council noted that the new suffix would be presented at the next Council meeting.
